Mehrotra\n\nHon'ble Satya Poot Mehrotra,J.\n<\/pre>\n<p>Hon&#8217;ble Shyam Shankar Tiwari,J.\n<\/p>\n<p>Order on Appeal<\/p>\n<p>  Admit.\n<\/p>\n<p>  Issue notice.\n<\/p>\n<p>  Notice will be issued to the respondents by Registered Post A.D. fixing the<br \/>\nnext date fixed in the matter.\n<\/p>\n<p>Order on Stay Application<br \/>\n  Issue notice.\n<\/p>\n<p>  Notice will be issued to the respondents by Registered Post A.D. fixing the<br \/>\nnext date fixed in the matter.\n<\/p>\n<p>  Requisite steps will be taken within three weeks.<br \/>\n  Heard on the question of grant of interim relief.<br \/>\n   Having regard to the facts and circumstances of the case and having<br \/>\nconsidered the submissions made by Shri S.K. Mehrotra, learned counsel for<br \/>\nthe appellant, it is directed that the operation of the impugned Award dated<br \/>\n23.3.2010 will remain stayed until further orders of the Court, provided within<br \/>\nsix weeks from today, the appellant deposits the entire amount awarded under<br \/>\nthe impugned Award together with interest thereon before the Motor<br \/>\nAccidents Claims Tribunal, Mathura.\n<\/p>\n<p>   The amount so deposited by the appellant will be paid\/invested as under:<br \/>\n   (1) 50% of the amount awarded to the claimant-respondent no.1 under the<br \/>\nimpugned Award, will be paid to the claimant-respondent no.1 without<br \/>\nfurnishing any security.\n<\/p>\n<p>   (2) Balance 50% of the amount awarded to the claimant-respondent no.1<br \/>\nunder the impugned Award, will be invested in maximum interest-bearing<br \/>\nFixed Deposit in a Nationalized Bank, renewable from time to time, in the<br \/>\nname of the claimant-respondent no.1.\n<\/p>\n<p>   The amount invested in Fixed Deposit as per the directions given above,<br \/>\nwill not be permitted to be withdrawn by the claimant-respondent no. 1<br \/>\nwithout leave of this Court. However, 50% of the periodical interest accruing<br \/>\non such Fixed Deposit will be permitted to be withdrawn by the claimant-<br \/>\nrespondent no. 1 as and when the same accrues.
