At the end of<br \/>\n\ttrial, learned J.M.F.C., Savli convicted the applicant awarding SI<br \/>\n\tfor 12 months with a fine of Rs.5,000\/- and also awarding<br \/>\n\tcompensation of Rs.540\/-. Against the said order, appeal being<br \/>\n\tCriminal Appeal No.41 of 2007 was filed before the learned Session<br \/>\n\tJudge, Vadodara. After hearing learned advocates for the parties,<br \/>\n\tmatter was remanded for retrial. Said order is challenged in this<br \/>\n\trevision.\n<\/p>\n<p>This<br \/>\n\tCourt has gone through the impugned order passed by the appellate<br \/>\n\tcourt. Para 15 of the order reads as under:\n<\/p>\n<p>&#8220;Sec.59<br \/>\n\tof Indian Evidence Act provides-Proof of facts by oral evidence. All<br \/>\n\tfacts except the contents of documents or electronic records may be<br \/>\n\tproved by oral evidence. In view of Sec.61 of this Act, the<br \/>\n\trespondent-original complainant can prove contents of documents by<br \/>\n\tway of producing primary or in certain circumstances secondary<br \/>\n\tevidence. On perusal of proceedings (Rojnama), it does not become<br \/>\n\tclear that such original\/secondary evidence has been produced by the<br \/>\n\tcomplainant. Such original documents are lying scattered in the<br \/>\n\tbunch of papers which are not marked as exhibit. Neither it reflects<br \/>\n\tfrom examination-in-chief, cross-examination of complainant or<br \/>\n\twitnesses nor it reveals from proceedings of this case. Although<br \/>\n\tsuch documents are mentioned in the impugned judgment as proved<br \/>\n\tdocuments. Such embarrassing situation might have arisen due to the<br \/>\n\tfact that complainant might have not followed procedure regarding<br \/>\n\tproduction and proof of documents. Any how these old documents came<br \/>\n\ton record in which manner such documents presumed as proved<br \/>\n\tdocuments. It does not become clear from R &amp; P or from impugned<br \/>\n\tjudgment.&#8221;\n<\/p>\n<p>It<br \/>\n\tis observed by the trial court  that certain documents  are not<br \/>\n\texhibited and it is neither  reflected from examination-in-chief and<br \/>\n\tcross-examination of the complainant or witnesses nor revealed from<br \/>\n\tthe proceedings of the case. In view of the above, the learned<br \/>\n\tAppellate Court has rightly remanded the matter for retrial. No<br \/>\n\tillegality or pervasiveness is found in the impugned order. In view<br \/>\n\tof the above, this revision is dismissed.
