Sharma)\n\n       Date of Hearing :             19.10.2009\n\n       Date of Decision              :         19.10.2009\n\n       FACTS<\/pre>\n<p> :\n<\/p>\n<blockquote><p>       By his RTI application dated 14.10.2008, the appellant had sought information<br \/>\n       on 07 paras relating to the air accidents ever since 1990 of all types viz. Fighter,<br \/>\n       Transport and Helicopters, of the Indian Air force; the causes thereof as<br \/>\n       established in the Court of Inquiry and the remedial action taken by the<br \/>\n       competent authority and the matters related therewith.\n<\/p><\/blockquote>\n<blockquote><p>       2.      The CPIO had refused to disclose this information vide letter dated<br \/>\n       25.10.2008. The Appellate Authority had affirmed the decision of the CPIO.\n<\/p><\/blockquote>\n<blockquote><p>       3.        The present appeal is directed against the orders of the CPIO\/AA.\n<\/p><\/blockquote>\n<blockquote><p>       4.       Heard on 19.10.2009. Appellant not present. The public authority is<br \/>\n       represented by the officers named above. Wg. Cdr. Sajjan produces the<br \/>\n       comments dated 16.10.2009 of Shri J.N. Verma, Air Marshall (AA) which is<br \/>\n       taken on record. He would forcefully plead that information sought by the<br \/>\n       appellant is sensitive in nature and can not be disclosed in terms of clauses (a) &amp;\n<\/p><\/blockquote>\n<blockquote><p>       (j) of section 8 (1) of the RTI Act. The appellant, however, is not before the<br \/>\n       Commission to contest this claim.\n<\/p><\/blockquote>\n<blockquote><p>                                 INTERIM DECISION\n<\/p><\/blockquote>\n<blockquote><p>       5.      In view of the above, the matter is adjourned to 9.11.2009 at 11.30 hrs.<br \/>\n       A fresh notice may be issued to the appellant to appear before the Commission<br \/>\n       and have his say in the matter, if so advised. Wg Cdr T. Sajjan is hereby<br \/>\n       directed to produce information in regard to para (1) of the RTI application<br \/>\n       before the Commission for perusal to determine whether clauses (a) &amp; (j) of<br \/>\n       section 8 (1) apply to it or not.\n<\/p><\/blockquote>\n<blockquote><p>                                                                                   Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>                                                                        (M.L. The<br \/>\nproceedings of the day are reproduced below :-\n<\/p>\n<blockquote><p>       &#8220;This is in continuation of this Commission&#8217;s Interim Decision dated<br \/>\n       19.10.2009. As scheduled, the matter is called for hearing today dated<br \/>\n       9.11.2009. Appellant present. The following represent the Indian Air<br \/>\n       Force :-\n<\/p><\/blockquote>\n<pre>       (i)     Wg Cdr T. Sajan;\n       (ii)    Wg Cdr K.K. Sharma\n       (iii) Wg Cdr S. Bhattacharjee\n        (iv)   Flt. Lt. D. Pankaj\n\n<\/pre>\n<blockquote><p>       2.      Wg Cdr Sajan produces a sealed envelope containing information<br \/>\n       about the accidents of Air Force Air Crafts which have occurred since<br \/>\n       1990. The document is perused and returned to Wg Cdr Sajan. Wg Cdr<br \/>\n       Sajan would submit that this information can not be disclosed to the<br \/>\n       appellant in supreme national interest and is exempted from disclosure<br \/>\n       under clause (a) of section 8 (1) of RTI Act. He would also submit that<br \/>\n       the Air Force essentially is a mission centric organisation where safety<br \/>\n       aspect is also paid adequate attention. According to him, the accidents<br \/>\n       basically take place due to 03 causes viz. (i) technical defects, (ii) human<br \/>\n       error &amp; inadequacy\/failure of support services. As regards the technical<br \/>\n       defects, he would submit that if the information regarding accidents due<br \/>\n       to technical defects is placed in public domain, the national security will<br \/>\n       be jeoparadised. Human error occurs due to the personal traits of the<br \/>\n       Pilots; training deficiencies, if any, and the violation of SOP etc. The<br \/>\n       Court of Inquiry contains all this information but disclosure thereof<br \/>\n       would, again, jeoparadise national security. The same would hold good<br \/>\n       for the deficiency in support services whether it is ATC or Fighter<br \/>\n       Controllers etc. He, thus, forcefully pleads that information regarding<br \/>\n       IAF Aircraft accidents should not be disclosed in the interest of national<br \/>\n       security.\n<\/p><\/blockquote>\n<blockquote><p>       3.      On the other hand, the appellant would plead that due to high<br \/>\n       accident rate in the Indian Air Force, lives of a large number of budding<br \/>\n       pilots have been lost, besides causing loss to the national resources and<br \/>\n       lives of civilians. He would also submit that the presumption that the<br \/>\n       findings of COIs are correct can not be taken on its face value. He would<br \/>\n       also submit that it is not his intention to jeoparadise national security but<br \/>\n       to expose the deficiencies in the system so that such accidents do not<br \/>\n       recur in future and if at all, it happens, remedial action is taken at<br \/>\n       appropriate levels. It is also his plea that a system should be put in place<br \/>\n       whereby the superior echelons of the IAF are held accountable for their<br \/>\n       acts of omission and commission. He would also suggest that COIs are<br \/>\n       not always conducted fairly and, therefore, civilian element should be<br \/>\n       introduced into the COIs for greater transparency.\n<\/p><\/blockquote>\n<blockquote><p>       4.      When queried whether information regarding paras 02 and 06 of<br \/>\n       the RIT application can be disclosed, Wg Cdr Sajan would request for a<br \/>\n       short adjournment for consultations and formulating his opinion.\n<\/p><\/blockquote>\n<blockquote><p>                            INTERIM DECISION\n<\/p><\/blockquote>\n<blockquote><p>       5. However, keeping in view the sensitivity of the matter, the Commission<br \/>\ndecided to solicit the views of the Ministry of Defence. Hence, letter dated<br \/>\n8.12.2009 was addressed to the Defence Secretary accordingly. The query raised<br \/>\nin the Commission&#8217;s letter was whether any information regarding the accidents<br \/>\nof the IAF Air Crafts had been tabled in the Parliament by the Central<br \/>\n Government. The MoD responded to it vide letter dated 28.1.2010. Para 02 of<br \/>\nthe said letter is extracted below :-\n<\/p>\n<blockquote><p>        &#8220;2.      Comments of this Ministry on Paras 1, 2 &amp; 3 of the RTI<br \/>\n        application dated 14.10.2008 filed by Ex Sqn Ldr Vijay Prakash are as<br \/>\n        follows :-\n<\/p><\/blockquote>\n<blockquote><p>        Para 1 :-        While information in respect of date and time of Aircraft<br \/>\n        involved in accidents have been mentioned in reply to Parliament<br \/>\n        questions, the details of such accidents are not shared. Only the broad<br \/>\n        category of the cause of accidents namely, Human Error (Aircrew),<br \/>\n        Technical Defect, Bird Hit etc. is divulged. Copies of replies given in<br \/>\n        respect of Parliament Questions recently are enclosed. Each aircraft<br \/>\n        accident in the IAF is investigated thoroughly by a Court of Inquiry. The<br \/>\n        Court of Inquiry studies the accident threadbare, identifies the cause and<br \/>\n        recommends remedial\/corrective measures. The findings of the Court of<br \/>\n        Inquiry indicate weak areas\/shortcomings and remedial actions. The<br \/>\n        proceedings also contain an account of up-gradation\/revision of<br \/>\n        equipment\/procedures which is a reflection of operational potential<br \/>\n        preparedness and morale in the IAF. Therefore, providing details of such<br \/>\n        accidents would lead to divulging critical information which would be<br \/>\n        detrimental to the national security. In view of the above, it is opined that<br \/>\n        although such information as date of accident, make of the aircraft etc can<br \/>\n        be disclosed, however, details regarding Court of Inquiry should not be<br \/>\n        revealed.\n<\/p><\/blockquote>\n<blockquote><p>        Paras 2 &amp; 3 :- A Court of Inquiry into an aircraft accident of the IAF is<br \/>\n        conducted as per the provision of the Rules and Regulations fo the Air<br \/>\n        Force. A Court of Inquiry is conducted meticulously and is scrutinized at<br \/>\n        various levels. Punishment is awarded to the guilty\/defaulter and<br \/>\n        corrective\/remedial measures instituted to prevent recurrence of similar<br \/>\n        accidents as per the recommendations made by the Court of Inquiry. The<br \/>\n        kind and nature of departmental action is decided in accordance with the<br \/>\n        degree of culpability\/negligence of the erring individual, as established in<br \/>\n        the Court of inquiry proceedings. Disclosure of the names of the<br \/>\n        guilty\/defaulting personnel and subsequent effect on their career as a<br \/>\n        result of the accident has no relationship to any public activity or interest<br \/>\n        and would also amount to unwarranted invasion of the privacy of the<br \/>\n        concerned individuals and would adversely affect the morale of such<br \/>\n        individuals. It serves no larger public interest. Therefore, the information<br \/>\n        asked may be denied under provisions of section 8 (1) (j) of the RTI Act,<br \/>\n        2005.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                                      DECISION\n<\/p><\/blockquote>\n<blockquote><p>4.      As noted above, we have heard the appellant and also the officers of the<br \/>\nIndian Air Force. The views of MoD have been extracted above. Needless to<br \/>\nsay, the matter is highly sensitive in nature and impinges on the security of the<br \/>\ncountry. Any adventurism or cavalier approach in this regard would be counter<br \/>\nproductive. It needs to be emphasized that the security scenario in our<br \/>\nneighborhood is hostile and is deteriorating by the day. It does not need much<br \/>\nwisdom and sagacity to realise that disclosure of requested information in its<br \/>\nentirety may enable the hostile forces to assess the air potential of the IAF which<br \/>\nwould not be in best interest of the country.. Needless to say, the Ministry of<br \/>\nDefence is the watch dog of the security scenario in an around our country. What<br \/>\nwould prejudicially affect the sovereignty and integrity of India and its security<br \/>\nand strategic interests is best left to MoD&#8217;s appreciation. It would not be proper<br \/>\n for the Commission to substitute its own judgment for that of MoD in such a<br \/>\nsensitive matter.\n<\/p><\/blockquote>\n<p>5.     In view of the above, the Commission directs the CPIO to provide that<br \/>\nmuch information regarding Air Craft\/Helicopter accidents as was tabled in the<br \/>\nParliament by the Defence Minister on 13.7.2009, 9.12.2009 and 2.12.2009.\n<\/p>\n<p>6.
