Of<br \/>\ncountry made liquor were found from the possession of the detenue. On<br \/>\nthe basis of registration of this case, the detaining authority held<br \/>\nthat the present detenue was carrying on activities of selling<br \/>\nforeign made liquor which is harmful to the health of the public. It<br \/>\nis held by the detaining authority that as the detenue is indulged in<br \/>\nillegal activities, it is required to restrain him from carrying out<br \/>\nfurther illegal activities, i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offences and<br \/>\nstatements of unnamed witnesses.  In the opinion of this Court, the<br \/>\nactivities of the detenue can, by no stretch of imagination, be said<br \/>\nto be disturbing the \u00fdSpublic order.\u00fd\u00fd It is seen from the grounds<br \/>\nthat a general statement that has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health.  In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which  are mentioned in the order are in reference to the<br \/>\nsituation of \u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenu is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n\u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the \u00fdSpublic  order\u00fd\u00fd<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to \u00fdSpublic order\u00fd\u00fd. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tI<br \/>\nam fortified by in my view by the decision taken by this Court in the<br \/>\ncase of <a href=\"\/doc\/662396\/\">Sandip Omprakash Gupta v. State of Gujarat<\/a> (2004)(1) GLR\n<\/p>\n<p>865) that solitary incident of  violation of prohibition law,<br \/>\nnormally would not be a problem to the maintenance of public order<br \/>\nand for such solitary offence, no person can be detained under the<br \/>\nAct.\n<\/p>\n<p>7.\tIn<br \/>\nthe result, this Special Civil<br \/>\nApplication is allowed. The impugned order of detention passed by the<br \/>\ndetaining authority is hereby quashed and set aside. The detenue is<br \/>\nordered to be set at liberty forthwith, if not required in any other<br \/>\ncase. Rule is made absolute accordingly.
