PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.BK Bhatnagar,for the appellant.\n<\/p>\n<p>     Heard learned counsel for the appellant.<\/p>\n<p>     The appellant has preferred this appeal to challenge<\/p>\n<p>the order of the trial court dated 28th July, 2008 by which<\/p>\n<p>the appellant&#8217;s application for grant of temporary injunction<\/p>\n<p>filed under Order 39 Rule 1 and 2 CPC was dismissed.<\/p>\n<p>     The suit for cancellation of sale deed was filed as back<\/p>\n<p>as in the year 1994. There were 67 defendants. According<\/p>\n<p>to learned counsel for the appellant since there were 67<\/p>\n<p>defendants in the trial court, therefore, time took in<\/p>\n<p>deciding the application as most of the defendants could not<\/p>\n<p>have been served.    According to learned counsel for the<\/p>\n<p>appellant the trial court committed serious error of law by<\/p>\n<p>observing that since the original vendor with whom the<br \/>\n                                                        SBCMA No.1527\/2008<br \/>\n                                     Prithvi Singh Vs. Smt Jadav Devi &amp; Ors.\n<\/p>\n<p>                                                              Dtd. 2.2.2009<\/p>\n<p>                           !! 2 !!<\/p>\n<p>plaintiff had agreement to sell has already died, therefore,<\/p>\n<p>no prima facie case is made out in favour of the plaintiff-<\/p>\n<p>appellant. Learned counsel for the appellant submitted that<\/p>\n<p>appellant sought relief that the property in question may<\/p>\n<p>not be alienated during the pendency of the suit.<\/p>\n<p>     I have considered the submissions of learned counsel<\/p>\n<p>for the appellant and perused the record.<\/p>\n<p>     It is very convenient to say that the injunction<\/p>\n<p>application was not decided by the trial court in 14 years<\/p>\n<p>because there were 67 defendants-non-applicants. Neither<\/p>\n<p>the court was powerless nor the CPC is of such nature that<\/p>\n<p>for effective service of large number of defendants cannot<\/p>\n<p>be effected in time and particularly, in the matter where<\/p>\n<p>relief sought is of urgent nature. All other more modes of<\/p>\n<p>service of the defendants could have been used for serving<\/p>\n<p>the defendants by the plaintiff and at the same time, it was<\/p>\n<p>the duty of the court to see that misc. Application for grant<\/p>\n<p>of urgent reliefs may not be dragged for decades as has<\/p>\n<p>been done in this case.\n<\/p>\n<p>     Even if it would have been a good case for grant of<br \/>\n                                                          SBCMA No.1527\/2008<br \/>\n                                       Prithvi Singh Vs. Smt Jadav Devi &amp; Ors.\n<\/p>\n<p>                                                                Dtd. 2.2.2009<\/p>\n<p>                            !! 3 !!<\/p>\n<p>temporary injunction in favour of the plaintiff, the court<\/p>\n<p>after 14 years without any interim relief may have said that<\/p>\n<p>after 14 years, the plaintiff is not entitled to the relief<\/p>\n<p>simply because the plaintiff was not vigilant in prosecution<\/p>\n<p>the application for interim relief and when plaintiff can wait<\/p>\n<p>for 14 years for interim order then it is not a case where if<\/p>\n<p>interim relief is not granted there will be irreparable loss to<\/p>\n<p>the plaintiff.\n<\/p>\n<p>      Be it as it may be, the injunction application of the<\/p>\n<p>appellant has been dismissed by the trial court by impugned<\/p>\n<p>order and from facts, it appears that plaintiff&#8217;s case is only<\/p>\n<p>for cancellation of sale deed executed in favour of the<\/p>\n<p>defendants-respondents     on    the      basis       of    an      earlier<\/p>\n<p>agreement to sell in his favour which according to the<\/p>\n<p>plaintiff is dated 6th Oct., 1993 and according to the<\/p>\n<p>plaintiff, he paid the entire amount of the sale consideration<\/p>\n<p>by 17th March, 1994 amounting to Rs.5,61,000\/-.                         The<\/p>\n<p>plaintiff for the reasons best known to him did not file the<\/p>\n<p>suit for specific performance of contract and now more than<\/p>\n<p>14 years have already passed to the said agreement.
