Nos.536, 538, 539, 540 &amp; 541 of 2010\n                  ------------------------------------------\n              Dated this the 23rd       day of March, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>J.Chelameswar, C.J.\n<\/p>\n<p>            All these writ appeals are preferred against the various<\/p>\n<p>judgments passed in different writ petitions.               The question<\/p>\n<p>involved in all those writ petitions is common.              Each of the<\/p>\n<p>appellants happens to be the owners of goods vehicles registered in<\/p>\n<p>the State of Kerala. On the allegation that these vehicles were<\/p>\n<p>found plying in violation of some of the provisions of the Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of Sand<\/p>\n<p>Act, 2001, each of these vehicles were seized and appropriate<\/p>\n<p>proceedings under the abovementioned Act are initiated. Under<\/p>\n<p>Section 23 of the abovementioned Act, the said vehicles are even<\/p>\n<p>liable for confiscation in an appropriate case.<\/p>\n<p>W.A.No.536 of 2010, etc.\n<\/p>\n<p>                                 &#8211; 2 &#8211;\n<\/p>\n<p>             2. In view of the pendency of the proceedings against<\/p>\n<p>each one of the vehicles, the owners of the vehicles approached<\/p>\n<p>the concerned District Collector for interim release of the vehicle<\/p>\n<p>so seized and in each of these cases, interim release of the vehicle<\/p>\n<p>was ordered by the District Collector subject to the condition that<\/p>\n<p>the owners should deposit certain amount. For example, in the<\/p>\n<p>context of W.A.No.536 of 2010, the condition was that the owner<\/p>\n<p>should deposit an amount of Rs.80,000\/-.<\/p>\n<p>             3. Aggrieved by the condition so imposed and pleading<\/p>\n<p>that this is an onerous condition, each of the appellants approached<\/p>\n<p>this Court by filing different writ petitions.   A learned Judge of<\/p>\n<p>this Court declined to interfere with the condition so imposed and<\/p>\n<p>hence the present appeals.\n<\/p>\n<p>             4.  Heard Sri.Babu S.Nair, learned counsel for the<\/p>\n<p>appellants and Smt.K.Meera, learned Senior Government Pleader<\/p>\n<p>W.A.No.536 of 2010, etc.\n<\/p>\n<p>                                 &#8211; 3 &#8211;\n<\/p>\n<p>appearing for the respondents.\n<\/p>\n<p>            5. Learned counsel for the appellants argued that the<\/p>\n<p>condition imposed by the District Collector with regard to the<\/p>\n<p>deposit is an onerous condition and, therefore, the same is liable to<\/p>\n<p>be relaxed.\n<\/p>\n<p>            6.      We are unable to accept this submission.<\/p>\n<p>Admittedly, the amount called upon to be deposited with reference<\/p>\n<p>to each of the vehicles is certainly much less than the value of the<\/p>\n<p>vehicle itself. As already indicated above, in an appropriate case,<\/p>\n<p>the vehicle is even liable for confiscation and if so confiscated, the<\/p>\n<p>owner would lose the entire value of the vehicle.             In the<\/p>\n<p>circumstances, calling upon the owners to deposit a part of the<\/p>\n<p>value of the vehicle for interim release of the vehicle pending the<\/p>\n<p>adjudication proceedings, in our view, cannot be termed as<\/p>\n<p>imposition of an onerous condition.\n<\/p>\n<p>W.A.No.536 of 2010, etc.\n<\/p>\n<p>                               &#8211; 4 &#8211;\n<\/p>\n<p>            We do not see any reason to interfere with the<\/p>\n<p>judgments under appeals.
