Ghose\n\nOrder No. 07                     ------         Dated 07th June, 2011\n\n     Heard learned counsel for the parties.\n\n     The appellant is aggrieved against the order dated\n\n18.05.2010<\/pre>\n<p>, by which, the appellant&#8217;s writ petition was dismissed<\/p>\n<p>by the learned Single Judge after observing that admittedly<\/p>\n<p>mediclaim policy of the petitioner was expired on 18th July, 2004<\/p>\n<p>and after about six months the petitioner sent a blank cheque<\/p>\n<p>along with a letter requesting for renewal of his mediclaim policy.<\/p>\n<p>     Learned counsel for the appellant submitted that in view of<\/p>\n<p>the judgment passed by the Hon&#8217;ble Supreme Court delivered in<\/p>\n<p>the case of Biman Krishna Bose Vs. United Insurance<\/p>\n<p>Company Ltd. reported in {2001} 6 J.T. 125, the Insurance<\/p>\n<p>Company had a right to renew the policy retrospectively,<\/p>\n<p>therefore, the Insurance Company should have renewed the<\/p>\n<p>policy. Learned counsel for the appellant also submitted that vide<\/p>\n<p>annexure-7 the Insurance Company rejected the petitioner&#8217;s<\/p>\n<p>claim because of his ailment which they have found as old one<\/p>\n<p>and, therefore, on this ground the Insurance Company could not<\/p>\n<p>have rejected the prayer for renewal of the policy.<\/p>\n<p>     We considered the submissions of learned counsel for the<\/p>\n<p>appellant and perused annexure 7 as well as considered the<\/p>\n<p>judgment rendered in the case of Biman Krishna Bose<br \/>\n (Supra). It is not in dispute that petitioner&#8217;s mediclaim policy<\/p>\n<p>was expired on 18th July, 2004 and according to the petitioner he<\/p>\n<p>was misled by the agent of the Insurance Company. Therefore,<\/p>\n<p>he could not get the policy renewed in time and for that he made<\/p>\n<p>a complaint against the agent to the company and then he sent a<\/p>\n<p>blank cheque and a letter to the company for renewal of the<\/p>\n<p>insurance policy. In view of the above facts, it is clear that the<\/p>\n<p>petitioner has sought renewal of the policy on the basis of an<\/p>\n<p>allegation against the agent, who was not a party in the writ<\/p>\n<p>petition or before us.\n<\/p>\n<p>      Be that as it may, the policy can be renewed if the renewal<\/p>\n<p>is sought in time and admittedly in the present case, the policy<\/p>\n<p>ought to have been renewed within a period of seven days from<\/p>\n<p>the date of expiry of the policy and that has not been done and<\/p>\n<p>application for renewal of policy has been given after six months<\/p>\n<p>from the date of expiry of the mediclaim policy. In the case of<\/p>\n<p>Biman Krishna Bose (Supra), the Hon&#8217;ble Supreme Court has<\/p>\n<p>considered the issue which has no relevance to the facts of the<\/p>\n<p>present case. In the said case, it has been held that the applicant<\/p>\n<p>applied within time for renewal of the Insurance Policy and<\/p>\n<p>rejection of the prayer for renewal by the Insurance Company<\/p>\n<p>was quashed by the Hon&#8217;ble High Court and, therefore, the policy<\/p>\n<p>stand renewed. So far as other conditions which was sought to be<\/p>\n<p>invoked was that in Clause of exclusion which provided for pre-<\/p>\n<p>existing decease cannot not be covered under the fresh policy<\/p>\n<p>and in that situation, the matter was considered by the Hon&#8217;ble<\/p>\n<p>Supreme Court and the Hon&#8217;ble Supreme Court considered the<\/p>\n<p>consequence of such Clause in the matter of renewal of policy<\/p>\n<p>and held that this will have disastrous effect of wrongful refusal<\/p>\n<p>of renewal of the insurance policy, the mischief and harm cannot<br \/>\n                    be remedied. The Hon&#8217;ble Supreme Court considered the<\/p>\n<p>                   difference between the renewal of the policy and a fresh policy<\/p>\n<p>                   for the same risk coverage.\n<\/p>\n<p>                        Here in this case, there is no dispute that the petitioner<\/p>\n<p>                   applied for renewal of the policy after expiry of the period of<\/p>\n<p>                   limitation and it is not a case that he applied within a period of<\/p>\n<p>                   limitation so as to cover his pre-existing decease. It is a case<\/p>\n<p>                   when the contract came to an end by        the lapse of time and<\/p>\n<p>                   renewal was not sought well in time, therefore, the petitioner is<\/p>\n<p>                   not entitled to any relief and the case of Biman Krishna Bose<\/p>\n<p>                   (Supra) has no relevance with this case.\n<\/p>\n<p>                        In view of the above, there is no merit in this appeal, which<\/p>\n<p>                   is accordingly dismissed.\n<\/p>\n<\/p>\n<p>                                                              (Prakash Tatia, A.C J)<\/p>\n<p>                                                                (Jaya Roy, J)<\/p>\n<p>Alankar\/Sudhir\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Niraj Maheshwari vs United India Insurance Company on 7 June, 2011 IN THE HIGH COURT OF JHARKHAND AT RANCHI L.P.A.
