2.       We \u00a0 took \u00a0 up \u00a0 these \u00a0 five \u00a0 cases \u00a0 together \u00a0 for \u00a0 hearing \u00a0 through\u00a0<\/p>\n
videoconferencing.\u00a0\u00a0The\u00a0Appellant\u00a0was\u00a0not\u00a0present.\u00a0Although\u00a0he\u00a0had\u00a0requested\u00a0<\/p>\n
in \u00a0 writing \u00a0 to \u00a0 adjourn\u00a0 these \u00a0 cases\u00a0 beyond\u00a0 Diwali,\u00a0 we \u00a0 did \u00a0 not \u00a0 accede\u00a0 to \u00a0 his\u00a0<\/p>\n
request\u00a0as\u00a0it\u00a0is\u00a0not\u00a0the\u00a0general\u00a0practice\u00a0to\u00a0adjourn\u00a0cases\u00a0on\u00a0such\u00a0grounds\u00a0as\u00a0<\/p>\n
transfer\u00a0of\u00a0an\u00a0employee\u00a0from\u00a0one\u00a0station\u00a0to\u00a0another.\u00a0 \u00a0The\u00a0Respondents\u00a0were\u00a0<\/p>\n
present \u00a0 in \u00a0 our \u00a0 chamber \u00a0 as \u00a0 well \u00a0 as \u00a0 in \u00a0 the \u00a0 NIC \u00a0 Studios \u00a0 at \u00a0 Ludhiana \u00a0 and\u00a0<\/p>\n
Chandigarh.\u00a0\u00a0We\u00a0heard\u00a0their\u00a0submissions.\n<\/p>\n<\/p>\n
3.       In\u00a0five\u00a0separate\u00a0applications,\u00a0the\u00a0Appellant\u00a0had\u00a0sought\u00a0more\u00a0than\u00a0100\u00a0<\/p>\n
items\u00a0of\u00a0information\u00a0regarding\u00a0a\u00a0variety\u00a0of\u00a0issues.\u00a0\u00a0The\u00a0CPIO\u00a0had,\u00a0in\u00a0each\u00a0case,\u00a0<\/p>\n
provided\u00a0him\u00a0with\u00a0a\u00a0large\u00a0number\u00a0of\u00a0information\u00a0against\u00a0most\u00a0of\u00a0his\u00a0queries\u00a0<\/p>\n
although \u00a0 against \u00a0 some \u00a0 queries \u00a0 the \u00a0 information \u00a0 was \u00a0 not \u00a0 provided \u00a0 either \u00a0 by\u00a0
\nCIC\/SM\/A\/2010\/000663,\u00a0666,\u00a0715,\u00a0814\u00a0&\u00a0910
\n claiming \u00a0 exemption \u00a0 under \u00a0 some \u00a0 provision \u00a0 or \u00a0 the \u00a0 other \u00a0 of \u00a0 the \u00a0 Right \u00a0 to\u00a0<\/p>\n
Information\u00a0(RTI)\u00a0Act\u00a0or\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0the\u00a0information\u00a0was\u00a0not\u00a0available.\u00a0<\/p>\n
In\u00a0his\u00a0second\u00a0appeals\u00a0filed\u00a0before\u00a0the\u00a0CIC,\u00a0the\u00a0Appellant\u00a0has\u00a0not\u00a0specifically\u00a0<\/p>\n
spelt\u00a0out\u00a0why\u00a0he\u00a0finds\u00a0any\u00a0of\u00a0the\u00a0information\u00a0provided\u00a0to\u00a0him\u00a0as\u00a0inadequate\u00a0or\u00a0<\/p>\n
incorrect.\u00a0\u00a0Instead,\u00a0he\u00a0has\u00a0generally\u00a0alleged\u00a0large\u00a0scale\u00a0bungling\u00a0and\u00a0corruption\u00a0<\/p>\n
in\u00a0the\u00a0functioning\u00a0of\u00a0the\u00a0Bank\u00a0in\u00a0general\u00a0and\u00a0some\u00a0of\u00a0its\u00a0superior\u00a0officers\u00a0in\u00a0<\/p>\n
particular.\u00a0\u00a0\n<\/p>\n<\/p>\n
4.       We\u00a0carefully\u00a0perused\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0RTI\u00a0applications\u00a0in\u00a0all\u00a0these\u00a0<\/p>\n
cases \u00a0 and \u00a0 the \u00a0 reply \u00a0 given \u00a0 by \u00a0 the \u00a0 CPIO. \u00a0 We \u00a0 do \u00a0 not \u00a0 find \u00a0 any \u00a0 particular\u00a0<\/p>\n
inadequacy\u00a0or\u00a0shortcoming\u00a0in\u00a0the\u00a0response\u00a0of\u00a0the\u00a0CPIO\u00a0in\u00a0any\u00a0of\u00a0these\u00a0cases\u00a0<\/p>\n
except\u00a0that\u00a0the\u00a0CPIO\u00a0has\u00a0not\u00a0explained\u00a0how\u00a0the\u00a0certain\u00a0items\u00a0of\u00a0information\u00a0<\/p>\n
denied\u00a0by\u00a0him\u00a0would\u00a0be\u00a0covered\u00a0under\u00a0the\u00a0exemption\u00a0provision\u00a0cited\u00a0by\u00a0him.\u00a0<\/p>\n
For \u00a0 example, \u00a0 the \u00a0 Appellant \u00a0 had \u00a0 sought \u00a0 details \u00a0 of \u00a0 the \u00a0 Annual \u00a0 Maintenance\u00a0<\/p>\n
Contracts \u00a0 (AMC) \u00a0 entered \u00a0 into \u00a0 by \u00a0 the \u00a0 Bank \u00a0 during \u00a0 a \u00a0 certain \u00a0 period. \u00a0 \u00a0 This\u00a0<\/p>\n
information\u00a0has\u00a0been\u00a0denied\u00a0by\u00a0citing\u00a0the\u00a0exemption\u00a0provisions\u00a0of\u00a0Section\u00a08(1)<\/p>\n
(d)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act.\u00a0Claiming\u00a0AMC\u00a0contracts\u00a0to\u00a0be\u00a0in\u00a0the\u00a0<\/p>\n
nature\u00a0of\u00a0commercial\u00a0confidence\u00a0is\u00a0not\u00a0justifiable\u00a0at\u00a0all.\u00a0 \u00a0The\u00a0AMC\u00a0is\u00a0like\u00a0any\u00a0<\/p>\n
other\u00a0contract\u00a0and\u00a0the\u00a0citizens\u00a0have\u00a0a\u00a0right\u00a0to\u00a0know\u00a0to\u00a0whom\u00a0such\u00a0contracts\u00a0<\/p>\n
have\u00a0been\u00a0awarded\u00a0and\u00a0for\u00a0what\u00a0consideration.\u00a0 \u00a0Even\u00a0if\u00a0it\u00a0is\u00a0agreed\u00a0that\u00a0the\u00a0<\/p>\n
Appellant\u00a0has\u00a0not\u00a0sought\u00a0this\u00a0information\u00a0very\u00a0specifically\u00a0and\u00a0had\u00a0only\u00a0sought\u00a0<\/p>\n
the\u00a0details\u00a0without\u00a0explaining\u00a0what\u00a0he\u00a0means\u00a0by\u00a0‘details’,\u00a0the\u00a0CPIO\u00a0should\u00a0have\u00a0<\/p>\n
provided\u00a0 the \u00a0 list \u00a0 of \u00a0 AMCs\u00a0 awarded\u00a0 during\u00a0 that \u00a0 period\u00a0 along\u00a0 with \u00a0 the \u00a0 exact\u00a0<\/p>\n
consideration\u00a0in\u00a0each\u00a0case\u00a0and\u00a0for\u00a0what\u00a0activity.\n<\/p>\n<\/p>\n
5.       In\u00a0the\u00a0backdrop\u00a0of\u00a0the\u00a0above,\u00a0we\u00a0would\u00a0like\u00a0the\u00a0CPIOs\u00a0in\u00a0all\u00a0these\u00a0cases\u00a0<\/p>\n
to\u00a0provide\u00a0the\u00a0available\u00a0information\u00a0against\u00a0those\u00a0items\u00a0where\u00a0the\u00a0information\u00a0<\/p>\n
had\u00a0been\u00a0denied\u00a0by\u00a0invoking\u00a0the\u00a0various\u00a0exemption\u00a0provisions.\u00a0 \u00a0If\u00a0the\u00a0CPIO\u00a0<\/p>\n
CIC\/SM\/A\/2010\/000663,\u00a0666,\u00a0715,\u00a0814\u00a0&\u00a0910
\n decides\u00a0not\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0in\u00a0some\u00a0of\u00a0these\u00a0instances,\u00a0he\u00a0must\u00a0pass\u00a0<\/p>\n
a\u00a0speaking\u00a0order\u00a0stating\u00a0how\u00a0exactly\u00a0the\u00a0desired\u00a0information\u00a0would\u00a0be\u00a0covered\u00a0<\/p>\n
by\u00a0the\u00a0said\u00a0exemption\u00a0provisions.\u00a0 \u00a0We\u00a0direct\u00a0the\u00a0CPIOs\u00a0to\u00a0comply\u00a0with\u00a0this\u00a0<\/p>\n
direction\u00a0within\u00a015\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0\u00a0<\/p>\n
6.       With\u00a0the\u00a0above\u00a0directions,\u00a0all\u00a0the\u00a0fives\u00a0are\u00a0disposed\u00a0off.\u00a0\u00a0<\/p>\n
7.       Copies\u00a0of\u00a0this\u00a0order\u00a0be\u00a0given\u00a0free\u00a0of\u00a0cost\u00a0to\u00a0the\u00a0parties.<\/p>\n
