Justice K.M.JOSEPH\n\n Dated :23\/05\/2007\n\n O R D E R\n                                   K.M.JOSEPH, J.\n\n                    ------------------------------------------\n\n                        W.P.(C).No.15171 OF 2007\n\n                   --------------------------------------------\n\n                      Dated this the 23rd day of May, 2007\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>       Case of the petitioners is as follows:\n<\/p>\n<p>       Petitioners   are   owners   of   the   properties   covered   by   their<\/p>\n<p>respective title deeds and the properties are in the possession of the<\/p>\n<p>petitioners and their predecessors for last more than 40 years.  It is<\/p>\n<p>their   case   that   they   have   not   encroached   into   any   portion   of   the<\/p>\n<p>Aynithodu   of   the   northern   side   of   their   property.     Earlier   when<\/p>\n<p>there was an attempt, they approached this court and the matter is<\/p>\n<p>covered   by   Ext.P4   judgment   of   the   Division   Bench,   wherein   the<\/p>\n<p>Division Bench directed as follows:\n<\/p>\n<blockquote><p>               &#8220;Question   to   be   decided   is   whether<\/p>\n<p>        petitioners   have   encroached   thodu   or   canal<\/p>\n<p>        puramboke   land   or   not.     If   they   had   encroached<\/p>\n<p>        the puramboke land, they are liable to be evicted.<\/p>\n<p>        In   all   writ   petitions,   apart   from   the   ground   of<\/p>\n<p>        violation of principles of natural justice, it is also<\/p>\n<p>        pleaded   that   before   evicting   them,   property   shall<\/p>\n<p>        be   measured   after   considering   the   title   deeds<\/p>\n<p><span class=\"hidden_text\">WPC No.15171\/07                          2<\/span><\/p>\n<p>        produced by them.\n<\/p><\/blockquote>\n<blockquote><p>                In   the   above   circumstances,   we   direct   the<\/p>\n<p>        respondents   to   measure   out   the   property   with<\/p>\n<p>        notice  to   the   petitioners before   action  is  taken  to<\/p>\n<p>        evict   them.     Documents   of   title   can   be   produced<\/p>\n<p>        by   the   petitioners   before   the   authorities   at   that<\/p>\n<p>        time.     Water   logging   can   be   avoided   if   such<\/p>\n<p>        persons   are   evicted   from   the   puramboke   land<\/p>\n<p>        according   to  law.   But   orders  passed   and   notices<\/p>\n<p>        issued   without   measurement   and   in   violation   of<\/p>\n<p>        principles of natural justice, are set aside.&#8221;<\/p><\/blockquote>\n<p>      2.     Exts.P5 and P6 are notices issued indicating that survey<\/p>\n<p>will   be   done   on   17\/05\/2007.     Petitioners   approached   this   court<\/p>\n<p>praying   for   a   direction   to   the   respondents   not   to   evict   the<\/p>\n<p>petitioners   from   any   of   the   portions   of   the   property   under   their<\/p>\n<p>possession without following the procedure established by law and<\/p>\n<p>giving   a   reasonable   opportunity   to   submit   their   objections   to   the<\/p>\n<p>measurements   proposed   to   be   taken   on   17\/05\/2007   as   provided<\/p>\n<p>under law.\n<\/p>\n<p>      3.     I   heard   learned   counsel   for   the   petitioners   and   the<\/p>\n<p>learned counsel appearing for respondents 1 and 2.\n<\/p>\n<p>      4.     Learned   counsel   for   the   petitioners   submits   that   the<\/p>\n<p><span class=\"hidden_text\">WPC No.15171\/07                             3<\/span><\/p>\n<p>apprehension   of   the   petitioners   is   that   immediately   after<\/p>\n<p>measurement is over, they will be dispossessed. if it is found that<\/p>\n<p>there   are   unauthorised   occupation,   without   calling   for   objections<\/p>\n<p>and hearing them.\n<\/p>\n<p>       5.      Learned   counsel   for   the   Panchayat   submits   that   based<\/p>\n<p>on   the   measurements   carried   on   pursuant   to   Exts.P5   and   P6,<\/p>\n<p>Panchayat will, if it is found that there is unauthorised occupation<\/p>\n<p>of   Panchayat   land,   proceed   against   the   petitioners   in   accordance<\/p>\n<p>with law.\n<\/p>\n<p>       In   such   circumstances,   I   find   that   there   is   no   basis   for   any<\/p>\n<p>apprehension.
