Pandey\nCounsel for the respondents :- Standing Counsel\n\nHon'ble Dilip Gupta, J.\n<\/pre>\n<p>      The Committee of Management of Janta Adarsh Inter College,<br \/>\nKapsar, District Meerut (hereinafter referred to as the &#8216;Institution&#8217;) through<br \/>\nits Manager has filed this petition for setting aside the order dated 23 rd<br \/>\nDecember, 2009 passed by the Joint Director of Education, Meerut as also<br \/>\nthe Government Order dated 4th August, 2003. The petitioner has also<br \/>\nsought a direction upon the respondents to permit the petitioner-Committee<br \/>\nof Management to continue upto 21st October, 2013.\n<\/p>\n<p>      It is stated in the petition that the Institution is recognised under the<br \/>\nprovisions of the U.P. Intermediate Education Act, 1921 and receives grant<br \/>\nin aid from the State Government. It has its own Scheme of Administration<br \/>\nfor managing the affairs of the Institution. Clause 8 of the Scheme of<br \/>\nAdministration provides that the term of the Committee of Management<br \/>\nshall be three years but the office bearer shall continue for further period of<br \/>\none month but if within a period of three years and one month, newly<br \/>\nelected Committee of Management does not take charge, then the term of<br \/>\nthe existing Committee of Management shall automatically come to an end<br \/>\nand a Prabandh Sanchalak to be nominated by the Joint Director of<br \/>\nEducation who shall have the powers of the Committee of Management.\n<\/p>\n<p>      It is also stated that the Committee of Management in its meetings<br \/>\nheld on 6th June, 2004, 16th January, 2009 and the General Body in its<br \/>\nmeetings held on 16th June, 2004 and 13th February, 2009 resolved to<br \/>\namend various Clauses of the Scheme of Administration including Clause 8<br \/>\nwhich provides for term of the term of the Committee of Management of<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>the Institution by extending it from three years to five years. The Joint<br \/>\nDirector of Education by his letter dated 23rd December, 2009 approved the<br \/>\namendments, but the amendment made in Clause 8 has been made<br \/>\noperative for the Committee of Management elected subsequent to the<br \/>\nresolution and will not apply to the tenure of the existing Committee of<br \/>\nManagement. The Joint Director of Education has passed an order on the<br \/>\nbasis of the communication dated 4th August, 2003 sent by the Director of<br \/>\nEducation (Madhyamik) U.P. Lucknow.\n<\/p>\n<p>      Sri N.L. Pandey, learned counsel for the petitioner submitted that the<br \/>\nGovernment Order dated 4th August, 2003 in so far as it imposes a<br \/>\nrestriction that any amendment relating to the term of the Committee of<br \/>\nManagement will be applicable for the elections held subsequently and not<br \/>\nfor the existing Committee of Management deserves to be set aside as any<br \/>\namendment in the Scheme of Administration of the Institution comes into<br \/>\neffect immediately. In support of this contention he has placed reliance<br \/>\nupon a Division Bench Judge of this Court in Committee of Management<br \/>\nof M.M. I. Inter College, Nehtour, District Bijnor Vs. Deputy Director<br \/>\nof Education and Ors., (1995) 1 UPLBEC 162 and an interim order<br \/>\npassed by this Court on 29th September, 2003 in Writ Petition No.44650 of<br \/>\n2003 (C\/M, Kakori Shahid Intermediate College, Jalalabad Vs. State of<br \/>\nU.P. &amp; Ors.). He, therefore, submits that reliance placed by the Deputy<br \/>\nDirector of Education on the said Government Order while granting<br \/>\napproval to the amendments made in the Scheme of Administration of the<br \/>\nInstitution by the order dated 23rd December, 2009 is not justified and the<br \/>\nterm of the present Committee of Management should be taken as five<br \/>\nyears instead of three years and one month and the Committee of<br \/>\nManagement should be allowed to continue upto 2013.\n<\/p>\n<p>      Learned Standing Counsel appearing for the respondents has,<br \/>\nhowever, submitted that there is no infirmity in the restriction imposed in<br \/>\nthe Government Order dated 4th August, 2003 that any amendment made in<br \/>\nthe term of the Committee of Management should be made applicable only<br \/>\nfor the Committee of Management subsequently elected.\n<\/p>\n<p>      I have carefully considered the submissions advanced by the learned<br \/>\ncounsel for the parties.\n<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>      Challenge is to the communication dated 4th August, 2003 sent by<br \/>\nthe Director of Education, Lucknow to all the Joint Directors of Education<br \/>\nregarding the approval to be granted to the amendments made in the term<br \/>\nof the Committee of Management. The letter clarifies that approval to such<br \/>\namendments in the term of the Committee of Management shall be made<br \/>\noperative only for the subsequent elections of the Committee of<br \/>\nManagement and not for the existing Committee of Management.\n<\/p>\n<p>      This issue was considered by a Division Bench of this Court in<br \/>\nCommittee of Management, Arya Kanya Inter College, Bulandshahar<br \/>\n&amp; Anr. Vs. State of U.P. &amp; Ors., 2008 (10) ADJ 398 (DB) and the Court<br \/>\nupheld the validity of the directions contained in the communication dated<br \/>\n4th August, 2003. It was observed :-\n<\/p>\n<blockquote><p>                          &#8220;Challenging the judgment and order of the<br \/>\n                   Hon&#8217;ble Single Judge, learned counsel for the appellant<br \/>\n                   contends that the power to make amendments in the<br \/>\n                   scheme of administration has been conferred under<br \/>\n                   Section 16-A (5) of the U.P. Intermediate Education<br \/>\n                   Act, 1921 (hereinafter referred to as the Act, 1921).<br \/>\n                   Such amendments in the scheme of administration take<br \/>\n                   effect from the date the amendments are approved by<br \/>\n                   the Director of Education. The petitioner&#8217;s Committee<br \/>\n                   of Management which was elected in the year 2005 had<br \/>\n                   proposed amendments in the scheme of administration,<br \/>\n                   whereby the term of the elected Committee of<br \/>\n                   Management has been changed from 3 years to 5 years<br \/>\n                   during subsistence to its 3 years term. The amendments<br \/>\n                   have infact been approved during the same period.<br \/>\n                   However, the Regional Joint Director of Education has<br \/>\n                   incorporated a totally unwarranted condition in the<br \/>\n                   order of approval that such amendment in the scheme of<br \/>\n                   administration (qua extension of the term) would take<br \/>\n                   effect only in respect of the Committee of Management,<br \/>\n                   which is elected subsequent to the approval of the<br \/>\n                   amendments. It is contended that the letter of the<br \/>\n                   Director of Education, U.P. at Allahabad dated 4th<br \/>\n                   August, 2003 which provided that such amendments<br \/>\n                   extending the term of the Committee of<br \/>\n                   Management from 3 years to 5 years would take<br \/>\n                   effect only in respect of the Committee of<br \/>\n                   Management, which is elected subsequent to the date<br \/>\n                   of approval of the amendments, is in excess to his<br \/>\n                   statutory powers under Section 16-A(5). It is<br \/>\n                   submitted that the Director of Education has no<br \/>\n                   authority under the provisions of Act, 1921, to control<br \/>\n                   the manner in which the amendments are to take effect.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                   4<\/span><\/p>\n<p>&#8230;&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>       The Regional Joint Director of Education by<br \/>\nmeans of the order dated 3rd September, 2007 approved<br \/>\nthe amendments so proposed in the scheme of<br \/>\nadministration with the condition that the said extension<br \/>\nof the term of the Committee of Management would be<br \/>\napplicable only in respect of the elections, which will<br \/>\ntake place subsequent to the amendments so approved.<br \/>\nReference in the letter has been made to the letters of<br \/>\nthe Director of Education, U.P. at Allahabad dated 30th<br \/>\nMarch, 1998 and dated 4th August, 2003, wherein it has<br \/>\nbeen provided that amendments in the scheme of<br \/>\nadministration for the purposes of extension of the term<br \/>\nof the Committee of Management, if approved, shall<br \/>\ntake effect only in respect of the Committee of<br \/>\nManagement, elections whereof are held subsequent to<br \/>\nthe date of resolution of the Committee of Management<br \/>\nproposing the amendments in the scheme of<br \/>\nadministration.\n<\/p>\n<p>&#8230;&#8230;&#8230;&#8230;..\n<\/p>\n<p>       We, therefore, arrive at a conclusion that the<br \/>\nDirector of Education, while approving the<br \/>\namendments in the scheme of administration, is<br \/>\nentitled to impose fair and just conditions. It is<br \/>\nwithin his competence to provide that if any existing<br \/>\nCommittee of Management seeks amendments in the<br \/>\nclause provided for the term of the elected office<br \/>\nbearers (in the facts of the present case 3 years to 5<br \/>\nyears), then while approving such amendments in<br \/>\nthe scheme of administration, it is always open to the<br \/>\nDirector of Education to provide that such extension<br \/>\nof term (3 years to 5 years) would be applicable only<br \/>\nin respect of the Committee of Management, which<br \/>\nis elected subsequent to the date of resolution of the<br \/>\nCommittee of Management proposing amendment.<br \/>\nSuch condition imposed by the Director of Education<br \/>\ncannot be said to be arbitrary or unfair. The condition so<br \/>\nimposed would be within his statutory competence and<br \/>\nwithin the framework of the power as conferred by<br \/>\nSection 16-A(5) of 1921 Act.\n<\/p>\n<p>&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>       Even otherwise, we feel that it is appropriate<br \/>\nand it is fitness of things that the Committee of<br \/>\nManagement, which is elected in accordance with<br \/>\nthe provisions of the scheme of administration must<br \/>\nbe permitted to continue only for the term, which<br \/>\nwas applicable at the time of the elections. The<br \/>\nextension of the term so provided by seeking permission<br \/>\nof its own term and by suggesting amendments in the<br \/>\nscheme of administration cannot be approved of by this<br \/>\nCourt and therefore, we have little hesitation to hold<br \/>\n<span class=\"hidden_text\">                                       5<\/span><\/p>\n<p>                    that the provision as contained in the circular\/letter<br \/>\n                    of the Director dated 4th August, 2003 as also in the<br \/>\n                    condition imposed in the order of the Regional Joint<br \/>\n                    Director of Education dated 3rd September, 2007,<br \/>\n                    while approving the amendments in the scheme of<br \/>\n                    administration with the extended term applicable<br \/>\n                    only in respect of Committee of Management, which<br \/>\n                    are elected subsequent to the date of the approval<br \/>\n                    order, is fair and just. Such orders do not warrant any<br \/>\n                    interference in equitable jurisdiction under Article 226<br \/>\n                    of the Constitution of India.\n<\/p>\n<p>                           The judgments relied upon by the learned counsel<br \/>\n                    for the parties do not have any application in view of<br \/>\n                    the circular of the Director. Therefore, it is not<br \/>\n                    necessary for this Court to refer to any of the aforesaid<br \/>\n                    judgments relied upon by the parties. The amendments<br \/>\n                    incorporated in the scheme of administration qua<br \/>\n                    extension of the term of the elected Committee of<br \/>\n                    Management has to be approved of along with condition<br \/>\n                    as provided for under the circular\/order of the Director<br \/>\n                    of Education dated 4th August, 2003.&#8221;\n<\/p>\n<p>                     (emphasis supplied)<\/p>\n<p>      The judgment rendered in M.M.I. Inter College (supra) was<br \/>\nconsidered by the Division Bench in the aforesaid judgment in Committee<br \/>\nof Management (supra) and it was observed that it has no application in<br \/>\nview of the Circular dated 4th August, 2003. It needs to be pointed out that<br \/>\nin M.M.I. Inter College (supra) the term of the Committee of Management,<br \/>\naccording to the Scheme of Administration, was to continue till the newly<br \/>\nCommittee of Management is elected. The Scheme of Administration was<br \/>\namended in 1989 to bring it in conformity with the provisions of the U.P.<br \/>\nIntermediate Education Act, 1921. Since the Scheme of Administration<br \/>\nwas amended to bring it in conformity with the Act, the contention that the<br \/>\namendment in the term of the Committee of Management will apply to the<br \/>\nsubsequent elections and not to the existing Committee of Management<br \/>\nwas repelled and it was held that the amendments will apply with<br \/>\nimmediate effect.\n<\/p>\n<p>      Learned counsel for the petitioner has, however, placed reliance<br \/>\nupon a judgment of a learned Judge of this Court in Committee of<br \/>\nManagement, Bhartiya Adarsh Inter College, Gautam Budh Nagar Vs.<br \/>\nState of U.P. &amp; Ors, reported in 2005 (2) ESC 964 in support of his<br \/>\ncontention that the amendments come into effect immediately. This<br \/>\n<span class=\"hidden_text\">                                      6<\/span><\/p>\n<p>judgment in the case of Committee of Management, Bhartiya Adarsh Inter<br \/>\nCollege (supra) is not only contrary to the Division Bench judgment of this<br \/>\nCourt in Committee of Management, Arya Kanya Inter College,<br \/>\nBulandshahr (supra) but has also been explained by another learned Judge<br \/>\nof this Court in Committee of Management, Devraha Baba Inter<br \/>\nCollege, Deoria &amp; Anr. Vs. Regional Joint Director of Education, 7 th<br \/>\nRegion, Gorakhpur &amp; Ors., reported in 2005 (4) ESC 2692.\n<\/p>\n<p>      The contention of learned counsel for the petitioner, therefore,<br \/>\ncannot be accepted.\n<\/p>\n<p>      There is, therefore, no merit in the petition.
