DAVE\n\t\t\n\t\n\n \n\nDate\n: 18\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>RULE.\n<\/p>\n<p>\tLearned APP waives service of notice of Rule for the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.203\/2008 with Kagdapith Police Station, Ahmedabad for the<br \/>\n\toffences punishable under Sections 356 and 114 of Indian Penal Code.\n<\/p>\n<p>Heard<br \/>\n\tlearned Counsel appearing for the applicant and learned APP Mrs.<br \/>\n\tManisha L. Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No. 203\/2008 with<br \/>\n\tKagdapith Police Station, Ahmedabad, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>a) not take undue advantage of liberty<br \/>\n\tor misuse liberty;\n<\/p>\n<p>b) not act in a manner injurious to<br \/>\n\tthe interest of the prosecution;\n<\/p>\n<p>c) surrender his passport, if any, to<br \/>\n\tthe lower court within a week;\n<\/p>\n<p>d) not leave the State of Gujarat<br \/>\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n<p>e) mark presence at the concerned<br \/>\n\tPolice Station on the first Sunday of every month between 10.00 a.m.<br \/>\n\tand 3.00 p.m. for three months only;\n<\/p>\n<p>f) furnish the present address of his<br \/>\n\tresidence to the Investigating Officer and also to the Court at the<br \/>\n\ttime of execution of the bond and shall not change the residence<br \/>\n\twithout prior permission of this Court;\n<\/p>\n<p>g) not enter within the City and<br \/>\n\tDistrict limits of Ahmedabad for three months, except, for the<br \/>\n\tpurpose of attending the trial or marking presence.\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
