In this revision petition, order dated<br \/>\n14-06-1980 passed by the Rent Controller, Jagadhari, and<br \/>\norder dated 08-10-1982 passed by the Appellate Authority,<br \/>\nAmbala, under the Haryana Urban (Control of Rent and<br \/>\nEviction) Act, 1973 (for short &#8220;the Act&#8221;) have been<br \/>\nassailed under which the ejectment of the petitioner has<br \/>\nbeen ordered from the premises let out to him. There is<br \/>\nconcurrent finding of both the authorities under the Act<br \/>\nthat the petitioner could not prove if he had paid to the<br \/>\nlandlord, now respondent, the rent of the premises let out<br \/>\nto him. Learned counsel for the petitioner has referred<br \/>\nto the evidence on the file. However, this Court is of<br \/>\nthe considered opinion that the revisional jurisdiction of<br \/>\nthis Court has limited scope in view of the law laid down<br \/>\nby the Apex Court in the case of  Smt. Rajbir Kaur and<br \/>\nAnr. v. Chokosiri and Company, AIR 1988 S.C.<br \/>\n1845 wherein it has been observed as under:-\n<\/p>\n<p>  The scope of the revisional jurisdiction<br \/>\ndepends on the language of the statute<br \/>\nconferring the revisional jurisdiction.<br \/>\nRevisional jurisdiction is only a part of the<br \/>\nappellate jurisdiction and cannot be equated<br \/>\nwith that of a full-fledged appeal. Though the<br \/>\nrevisional power &#8211; depending upon the language<br \/>\nof the provision &#8211; might be wider than<br \/>\nrevisional power under Section 151 (or 115?)<br \/>\nof the Code of Civil Procedure, yet a revisional<br \/>\nCourt is not a second or first appeal. When<br \/>\nthe findings of fact recorded by the Courts<br \/>\nbelow are supportable on the evidence on record<br \/>\nthe revisional Court must indeed be reluctant<br \/>\nto embark upon an independent reassessment of<br \/>\nthe evidence and to supplant a conclusion of<br \/>\nits own, so long as the evidence on record<br \/>\nadmitted and supported the one reached by the<br \/>\nCourts below. With respect to the High Court,<br \/>\nwe are afraid, the exercise made by it in its<br \/>\nrevisional jurisdiction incurs the criticism<br \/>\nthat the concurrent finding of fact of the<br \/>\nCourts below could not be dealt and supplanted<br \/>\nby a different finding arrived at on an<br \/>\nindependent reassessment of evidence as was<br \/>\ndone in this case. We think in the<br \/>\ncircumstances, we should agree with Sri Sanghi<br \/>\nthat the concurrent finding as to exclusive<br \/>\npossession of M\/s. Kwality Ice-Cream was not<br \/>\namendable to reversal in revision. Contentions\n<\/p>\n<p>(a) and (b) in our opinion are well taken and<br \/>\nwould require to be held in appellants&#8217; favour.&#8221;\n<\/p>\n<p>2. I have perused the record of the case as well<br \/>\nand find that the consistent findings of the authorities<br \/>\nbelow are in accordance with the evidence on the record.<br \/>\nThe solitary plea of the petitioner was that he had been<br \/>\npaying the rent to one Parshottam Lal Chopra, Property<br \/>\nDealer, through whom he had obtained the premises on rent.<br \/>\nBut said Parshottam Lal Chopra when appeared as<br \/>\npetitioner-tenant&#8217;s witness could not show any authority<br \/>\non behalf of the landlord to collect rent from the<br \/>\npetitioner. It is also on the record that the shop in<br \/>\nquestion is a part of the residential premises of the<br \/>\nlandlord. If the petitioner had any intention to pay the<br \/>\nrent to the landlord, there was no necessity of going to a<br \/>\nthird person staying at a distance of the shop to pay the<br \/>\nrent by means of serving tea to Parshottam Lal Chopra<br \/>\ntowards payment of rent as per evidence adduced by the<br \/>\npetitioner-tenant. Since the petitioner has miserably<br \/>\nfailed to prove any payment of rent to the landlord, there<br \/>\nis no scope for interference in the order of ejectment<br \/>\npassed against him.
