K.S.RADHAKRISHNAN)<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the appellant-petitioner has submitted that the District<br \/>\nCollector has rejected the application for change of use possibly on<br \/>\nthe basis of the report dated 11.01.2007 submitted by the Mamlatdar,<br \/>\nNadiad (City). Learned counsel submitted that the report along with<br \/>\nother materials submitted by the Mamlatdar was also not supplied to<br \/>\nthe appellant-petitioner and as such, no opportunity was given to the<br \/>\nappellant-petitioner to submit his objections against the report of<br \/>\nthe Mamlatdar.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances, we feel that the appellant-petitioner<br \/>\nshould be given an opportunity to move the District Collector to<br \/>\nraise his objections against the report of the Mamlatdar and the<br \/>\nDistrict Collector shall re-consider the application of the<br \/>\nappellant-petitioner for change of use afresh. It will be open for<br \/>\nthe appellant-petitioner, if so advised, to submit his objections to<br \/>\nthe report submitted by the Mamlatdar dated 11.01.2007 as well as any<br \/>\nother material, if required.\n<\/p>\n<p>\tHowever,<br \/>\nwe make it clear that we express no opinion on merits of the case and<br \/>\nit is for the District Collector to consider the application of the<br \/>\nappellant-petitioner afresh in accordance with the law and rules<br \/>\nwithout delay within a period of two months from the date of receipt<br \/>\nof copy of this order.\n<\/p>\n<p>\tWith<br \/>\nabove observations and directions, this Letters Patent Appeal  as<br \/>\nwell as Civil Application for stay stand disposed of.\n<\/p>\n<p>\tNotice<br \/>\nstands discharged.\n<\/p>\n<p>    (K.S.
