Misc. No.44260 of 2010\n                     SURESH YADAV son of Jojan Yadav\n                                   Versus\n                          THE STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>2\/   15.03.2011               Heard learned counsel for the petitioner and the State.<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under sections 302 of the Indian Penal Code.<\/p>\n<p>                              It has been submitted that the present case is not one<\/p>\n<p>                  under section 304-B Indian Penal Code which would entail the<\/p>\n<p>                  prosecution to raise a presumption against the in-laws of the<\/p>\n<p>                  deceased and there is no material corroboration of the prosecution<\/p>\n<p>                  case.\n<\/p>\n<p>                              Considering the same, let the petitioner, above named,<\/p>\n<p>                  be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                  thousand) with two sureties of the like amount each or any other<\/p>\n<p>                  surety to be fixed by the court below to the satisfaction of the<\/p>\n<p>                  Additional Sessions Judge-cum-Fast Track Court No. V, Banka, in<\/p>\n<p>                  connection with Sessions Trial No.572 of 2010, subject to the<\/p>\n<p>                  conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                  petitioner, who will give an affidavit giving genealogy as to how he<\/p>\n<p>                  is related with the petitioner.
