     Petitioner is presently the         Manager of S.N.B.U.P<\/p>\n
School, Vadakkumpad,        Thalassery in Kannur District. His<\/p>\n
father was the Manager of the School. After her father’s<\/p>\n
death her mother succeeded in that position and continued<\/p>\n
as Manager till 1989, when         she expired. Thereafter the<\/p>\n
rights over the school devolved on the 5 children of the<\/p>\n
deceased couple. It would appear that, with the majority<\/p>\n
support among the children, the petitioner was appointed as<\/p>\n
Manager and that was challenged by the 6th respondent in<\/p>\n
O.P.No.6666\/1990 before this court and that O.P was<\/p>\n
dismissed by Ext.P1 judgment.\n<\/p>\n
     2. According to the petitioner, the 6th respondent<\/p>\n
pursued the challenge before the AEO, who by Ext.P2<\/p>\n
WP(C).No. 27680\/08           2<\/span><\/p>\n
rejected the challenge. Ext.P2 order was the subject<\/p>\n
matter of WP(c).No.16936\/2007 which was disposed of by<\/p>\n
Ext.P3 judgment directing that the AEO shall reconsider<\/p>\n
the claim of the 6th respondent.        AEO     thereupon<\/p>\n
reconsidered the matter and passed Ext.P4 order holding<\/p>\n
that the petitioner, the provisional manager cannot be<\/p>\n
removed till the dispute among the legal heirs over the<\/p>\n
management right of the school is finally settled.<\/p>\n
      3. Ext.P4 order was challenged before this court in<\/p>\n
WP(c).No.24925\/2007, which was disposed of by Ext.P5<\/p>\n
judgment directing the DPI to consider the appeal that<\/p>\n
was pending. The DPI there upon considered the appeal<\/p>\n
and issued Ext.P7 authorizing the Deputy Director of<\/p>\n
Education, Kannur to take a fresh decision on the issue,<\/p>\n
after hearing all concerned. Against Ext.P7, the petitioner<\/p>\n
filed Ext.P8 revision before the Government. In Ext.P9<\/p>\n
judgment in WP(c).No.478\/2008 this court directed the<\/p>\n
Government to consider the revision with notice to all<\/p>\n
WP(C).No. 27680\/08              3<\/span><\/p>\n
concerned.\n<\/p>\n
     4. Accordingly Ext.P10 hearing notice was issued and<\/p>\n
Ext.P11 order was issued by the Government. The<\/p>\n
relevant      portion of Ext.P11 is extracted below for<\/p>\n
reference.\n<\/p>\n
                 “In the above circumstances, Ext.P8 revision<\/p>\n
                 petition filed by Smt. A. Padmavathy is<\/p>\n
                 rejected and the proceedings read as Ist<\/p>\n
                 paper above is upheld. Deputy Director of<\/p>\n
                 Education, Kannur is also directed to appoint<\/p>\n
                 a legal heir, nominated by majority of legal<\/p>\n
                 heirs as Manager of the school until a bye-<\/p>\n<\/blockquote>\n
                 law   is framed    and   approved    by  the<\/p>\n
                 educational authorities. This shall be done<\/p>\n
                 after hearing   all the legal heirs of late<\/p>\n
                 K.P.Govindan and verifying the majority in a<\/p>\n
                 foolproof manner. The court direction is<\/p>\n
                 accordingly complied with.”<\/p><\/blockquote>\n

     5. It is this order that is challenged by the petitioner<\/p>\n
in this writ petition.\n<\/p>\n
     6. The main contention raised by the learned counsel<\/p>\n
for the petitioner is that so long as Ext.P1, an inter-party<\/p>\n
judgment between the petitioner and the 6th respondent,<\/p>\n
has become final it is not open to either of the legal heirs<\/p>\n
to seek his change        of the petitioner’s     provisional<\/p>\n
managership.\n<\/p>\n
      7. I am not in a position to accept this contention.<\/p>\n
As is evident from the facts as disclosed in Ext.P11, the<\/p>\n
Manager has left behind 5 children and among them with<\/p>\n
the majority support of three, the petitioner was appointed<\/p>\n
as the provisional manager pending resolution of the<\/p>\n
dispute among the legal heirs. Ext.P11 itself shows that<\/p>\n
now one of the legal heirs, viz. Smt. Soumini withdrew her<\/p>\n
from the group which supported         the petitioner and is<\/p>\n
supporting the group lead by the 6th respondent. Thus the<\/p>\n
group opposing the petitioner has got the majority support<\/p>\n

now. It was taking into account these circumstances that<\/p>\n
the Government have in Ext.P11 ordered that the Deputy<\/p>\n
Director shall appoint a legal heir nominated by the<\/p>\n
majority of the legal heirs as the Manager of the School<\/p>\n
until a bye law is framed and is approved by the<\/p>\n
Educational Authority. In my view, the view taken by the<\/p>\n
Government is a fair and reasonable view and it does not<\/p>\n
warrant interference at the hands of this court exercising<\/p>\n
its jurisdiction under Art.226 of the Constitution.<\/p>\n
      8.   The counsel for the petitioner referred to me<\/p>\n
Ext.P1 judgment and with particular emphasis referred to<\/p>\n
the sentence therein that the provisional approval to the<\/p>\n
petitioner is not open to challenge. As I understand, the<\/p>\n
effect of this sentence is only that the provisional approval<\/p>\n
of the petitioner could not be challenged in a proceeding<\/p>\n
under Article 226. On the other hand, if I understand this<\/p>\n
sentence one conferring total immunity to his appointment<\/p>\n
as provisional Manager, the next sentence in paragraph 5<\/p>\n
WP(C).No. 27680\/08             6<\/span><\/p>\n
of Ext.P1 judgment, relegating the parties to peruse the<\/p>\n
legal remedies will not carry any meaning. In this view of<\/p>\n
the   matter, I cannot     understand Ext.P1 judgment as<\/p>\n
conferring an absolute immunity to the provisional<\/p>\n
appointment of the petitioner as Manager. On the whole, I<\/p>\n
do not find any substance in the challenge raising against<\/p>\n
Ext.P1.\n<\/p>\n
     Writ Petition fails and is dismissed.\n<\/p>\n<\/p>\n
