SANKARAN, J.\n                     ---------------------------\n                      B.A. No. 7568 of 2009\n                 ------------------------------------\n            Dated this the 22nd day of December, 2009\n\n                             O R D E R\n<\/pre>\n<p>      This is an application for bail under Section 439 of the Code<\/p>\n<p>of Criminal Procedure. The petitioner is accused No.1 in Crime No.<\/p>\n<p>467\/2009 of Mattannur Police Station.\n<\/p>\n<p>       2. The offences alleged against the petitioner are under<\/p>\n<p>Sections 143, 147, 148, 323, 324, 452, 427 and 308 read with<\/p>\n<p>Section 149 of the Indian Penal Code.\n<\/p>\n<p>       3. The prosecution case is that on 24.10.2009, the accused<\/p>\n<p>persons trespassed into the bar hotel in which the de facto<\/p>\n<p>complainant was working as a supervisor, attacked him, the<\/p>\n<p>Manager and other staff of the bar hotel with deadly weapons<\/p>\n<p>and thereby caused serious injuries to one Jijesh. The de facto<\/p>\n<p>complainant and the other staff also had sustained injuries as a<\/p>\n<p>result of the attack. The motive alleged for commission of the<\/p>\n<p>offence is that the de facto complainant and others had<\/p>\n<p>questioned the act of the first accused in causing nuisance in the<\/p>\n<p>bar hotel on an earlier occasion.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 7568 of 2009               2<\/span><\/p>\n<p>         4. The petitioner was arrested on 21.11.2009 and he was<\/p>\n<p>remanded to judicial custody.\n<\/p>\n<p>         5. The petitioner had filed Bail Application No. 7240\/2009<\/p>\n<p>for Regular Bail. That application was dismissed by the order<\/p>\n<p>dated 09.12.2009. The investigation has progressed thereafter.<\/p>\n<p>         6. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p>         7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Mattannur subject to the following conditions:-<\/p>\n<blockquote><p>               A)    The petitioner shall report before the<br \/>\n                     Investigating Officer between 9 A.M. and<br \/>\n                     11 A.M. on all Mondays , till the final<br \/>\n                     report is filed or until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               B)    The petitioner shall      appear before the<br \/>\n                     Investigating Officer for interrogation as<br \/>\n                     and when required.\n<\/p><\/blockquote>\n<blockquote><p>               C)    The petitioner shall not try to influence<br \/>\n                     the prosecution witnesses or tamper with<br \/>\n                     the evidence.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 7568 of 2009              3<\/span><\/p>\n<blockquote><p>               D)      The petitioner shall not commit any<br \/>\n                     offence or indulge in any prejudicial<br \/>\n                     activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>               E)    In case of breach of any of the conditions<br \/>\n                     mentioned above, the bail shall be liable<br \/>\n                     to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                     K.T.
