Road\tand  Chamber<br \/>\nRoad,  Guwahati along with others.  The appellant arrived at<br \/>\nthe  scene with a sword like weapon and with it dealt  blows<br \/>\nto  Hara  Kanta\t Das  who  fell down  on  the  ground.\t The<br \/>\nappellant  amputed the right hand and thereafter severed the<br \/>\nhead of Hara Kanta Das (the deceased).\tWith the head of the<br \/>\ndeceased  in  one hand and the blood dripping weapon in\t the<br \/>\nother hand, he moved majestically towards Fancy Bazar Police<br \/>\nOut  Post.  The occurrence was witnessed by persons standing<br \/>\nthere  of  whom PW 3, Kalu Das, PW5, Gaya Prasad and  PW  8,<br \/>\nGauri  Sankar Thakur were examined as eye witnesses.   Ratan<br \/>\nRai,  PW  1,  the sweeper rushed to the\t police\t station  to<br \/>\ninform\tabout  the incident.  There he found  the  appellant<br \/>\nentering  into the Police Out Post.  PW 2, Rateshwar  Barman<br \/>\nwas on duty.  The appellant asked PW 2, where he should keep<br \/>\nthe  head and the weapon and placed them in the verandah  of<br \/>\nthe  police  station.  The weapon was seized and  marked  as<br \/>\nExt.1  after conducting inquest over the head.\tAfter taking<br \/>\nthe  head  to  the scene of occurrence where  the  body\t was<br \/>\nlying,\tanother inquest was conducted and the body was\tsent<br \/>\nto  the Doctors for conducting post mortem examination.\t  PW<br \/>\n9,   Dr.Pratap\t Ch.Sarmah,  conducted\t the   post   mortem<br \/>\nexamination  and  sent report, Ext.14.\tPW 9 noted that\t the<br \/>\nhead  of  the deceased was severed from the body  which\t was<br \/>\nhaving as many as nine injuries on it.\tThe learned Sessions<br \/>\nJudge,\tKamrup,\t Guwahati having considered the evidence  of<br \/>\neye  witnesses,\t which\twas   corroborated  by\tthe  medical<br \/>\nevidence,  found  the  appellant  guilty  of  offence  under<br \/>\nSection\t 302  IPC.  On the question of sentence the  learned<br \/>\nSessions Judge gave an opportunity to the appellant to state<br \/>\nthe  mitigating circumstances, if any, and noted that he did<br \/>\nnot  state anything relevant and that he even refused to put<br \/>\nhis signatures on his statement.  The learned Sessions Judge<br \/>\nmentioned  that\t the  appellant remained  uncooperative,  on<br \/>\nbeing asked further questions in regard to sentence.  In the<br \/>\ncircumstances of the case having applied the principles laid<br \/>\ndown  by  this Court, the learned Sessions  Judge  concluded<br \/>\nthat it is rarest of the rare case and accordingly sentenced<br \/>\nthe  appellant\tto death and referred the case to  the\tHigh<br \/>\nCourt  under Section 366(1) Cr.P.C.  for confirmation of the<br \/>\ndeath  sentence.   The\treference was numbered\tas  Criminal<br \/>\nDeath\tRef.No.2  of  1997.    Against\this  conviction\t and<br \/>\nsentence,  the appellant filed Criminal Appeal No.254 (J) of<br \/>\n1997  in  the  High  Court of  Assam,  Nagaland,  Meghalaya,<br \/>\nManipur,  Tripura, Mizoram and Arunachal Pradesh at Gauhati.<br \/>\nThat  appeal and Criminal Death Ref.No.2 of 1997 were  heard<br \/>\ntogether.   After  elaborate consideration of all the  facts<br \/>\nand  law,  the\tHigh  Court  confirmed\tthe  conviction\t and<br \/>\nsentence  of  death passed by the learned Sessions Judge  by<br \/>\nits  judgment  dated  February 3, 1998, referred  to  above.<br \/>\nMr.Goswami,  learned  senior  counsel\tappearing  for\t the<br \/>\nappellant,  submitted  that the appellant was  not  properly<br \/>\nrepresented before the Trial Court as well as the High Court<br \/>\nat  the\t material time;\t he is a young man of 33  years\t and<br \/>\nhaving\tthree  unmarried sisters and aged parents;   he\t was<br \/>\nalso  not well at the time of occurrence.  The case has also<br \/>\nnot  been investigated properly and there is no material  to<br \/>\nshow  that  he has become menace to the society.  He  prayed<br \/>\nthat   the   death  sentence  may   be\tcommuted   to\tlife<br \/>\nimprisonment.\n<\/p>\n<p>      Mr.Sunil\tJain,  learned\tcounsel\t appearing  for\t the<br \/>\nState, contended that the cruel manner in which the crime is<br \/>\ncommitted  did not admit of any leniency;  the deceased came<br \/>\npre-determined\tduly  armed  with  sword  and  targeted\t the<br \/>\ndeceased among the crowd of persons standing there while the<br \/>\ndeceased was unarmed and was taking his morning tea and that<br \/>\nit  is\ta  fit\tcase to confirm\t the  death  sentence.\t The<br \/>\nexercise   of  power  to  award\t  death\t sentence   is\t now<br \/>\ncircumscribed\tby   Section  354(3)   Cr.P.C.\t  The\tsaid<br \/>\nsub-section  provides  that  when the conviction is  for  an<br \/>\noffence\t punishable with death or, in the alternative,\twith<br \/>\nimprisonment  for life or imprisonment for a term of  years,<br \/>\nthe  judgment  shall  state  the reasons  for  the  sentence<br \/>\nawarded,  and, in the case of sentence of death, the special<br \/>\nreasons\t for  such sentence.  The principles with regard  to<br \/>\nawarding  punishment  of  death\t  are  now  well-settled  by<br \/>\njudgments of this Court in Bachan Singh vs.  State of Punjab<br \/>\n[AIR 1980 SC 989], <a href=\"\/doc\/545301\/\">Machhi Singh &amp; Ors.\tvs.  State of Punjab<\/a><br \/>\n[(1983) 3 SCR 413] and <a href=\"\/doc\/667073\/\">Kehar Singh &amp; Ors.  vs.\tState (Delhi<br \/>\nAdministration)<\/a>\t [(1988)  3  SCC 609.  Briefly\tstated,\t the<br \/>\nprinciples  are :  that on conviction under Section 302\t IPC<br \/>\nthe  normal rule is to award punishment of life imprisonment<br \/>\nand that the punishment of death should be reserved only for<br \/>\nthe  rarest of rare cases.  Whether a case falls within `the<br \/>\nrarest\tof rare&#8217; cases has to be examined with reference  to<br \/>\nthe  facts and circumstances of each case.  The Court has to<br \/>\ntake  note  of\tthe aggravating as well\t as  the  mitigating<br \/>\ncircumstances  and  conclude  whether  there  was  something<br \/>\nuncommon  about\t the  crime which renders  the\tsentence  of<br \/>\nimprisonment  for  life\t inadequate and calls  for  a  death<br \/>\nsentence.   The\t Court is also expected to consider  whether<br \/>\nthe  circumstances  of\tthe crime is such that there  is  no<br \/>\nalternative  but  to impose death sentence  after  according<br \/>\nmaximum\t weightage  to\tthe mitigating\tcircumstances  which<br \/>\nspeak in favour of the offender.  These principles have been<br \/>\napplied\t by  this Court in innumerable cases.\tThe  learned<br \/>\ncounsel\t for  the  appellant  has, however,  relied  on\t the<br \/>\njudgment  of this Court in Raja Ram Yadav &amp; Ors.  vs.  State<br \/>\nof  Bihar  [(1996) 9 SCC 287] in support of  his  contention<br \/>\nthat  the  death  sentence  has to  be\tcommuted  into\tlife<br \/>\nimprisonment.\tIn  that case the convicts- appellants\twere<br \/>\ntried for offences punishable under Section 302 IPC and were<br \/>\nsentenced  to  death by the trial court.  There\t were  feuds<br \/>\nbetween\t Rajputs and Yadavs in Chhechhani.  The incident  of<br \/>\ncarnage\t to  which the case related had taken place  as\t the<br \/>\nretaliation  of\t Yadavs by killing the Rajputs.\t  The  Trial<br \/>\nCourt awarded death sentence which was confirmed by the High<br \/>\nCourt.\tThe sole eyewitness of the occurrence was 9 year old<br \/>\nboy.  While reiterating the aforesaid principles this Court,<br \/>\non  the\t special  facts\t of the case, held  thus  :   &#8220;After<br \/>\nkeeping in mind the relevant considerations for awarding the<br \/>\nextreme\t penalty  of death and also on considering the\tfact<br \/>\nthat in the instance case, the sole eyewitness did not tell,<br \/>\naccording  to  PW 1, the names of four of the appellants  we<br \/>\nfeel  that  although  the murders had been  committed  in  a<br \/>\npre-meditated and calculated manner with extreme cruelty and<br \/>\nbrutality,  for\t which\tnormally sentence of death  will  be<br \/>\nwholly\tjustified, in the special facts of the case, it will<br \/>\nnot  be\t proper\t to award extreme sentence of death  on\t the<br \/>\nappellants.&#8221;\n<\/p>\n<p>      The  other case referred to by him is Ronny vs.  State<br \/>\nof  Maharashtra [(1998) 3 SCC 625].  There three  appellants<br \/>\nwere  convicted\t under\tSections  376  and  302\/34  IPC\t for<br \/>\ncommitting  rape  and gruesome murder and were sentenced  to<br \/>\ndeath by the Trial Court.  The High Court declined to take a<br \/>\ndifferent  view.  This Court while considering the  question<br \/>\nof  sentence observed that as it was not possible to predict<br \/>\nas to who among the three played which part and therefore it<br \/>\nmight  be  that\t the role of one had been more\tculpable  in<br \/>\ndegree than that of the others and vice versa and considered<br \/>\nit appropriate to commute the death sentence to imprisonment<br \/>\nfor  life.  <a href=\"\/doc\/975511\/\">In State of Himachal Pradesh vs.  Manohar  Singh<br \/>\nThakur<\/a>\t[(1998) 6 SCC 158] the evidence against the  convict<br \/>\nwas  circumstantial evidence.  The Trial Court convicted him<br \/>\nof  offence punishable under Section 302 but the High Court,<br \/>\non  appeal,  recorded acquittal.  On the State&#8217;s  appeal  to<br \/>\nthis  Court the judgment of the High Court was set aside and<br \/>\nthe  order  of\tconviction  passed by the  Trial  Court\t was<br \/>\nrestored.   On the question of sentence it was observed that<br \/>\nthough\tmurder\tby its very nature is shocking, that per  se<br \/>\ndoes  not  justify death penalty.  Further this Court  found<br \/>\nthat  it  was not a rarest of rare case.  In Allauddin\tMian<br \/>\nvs.   State of Bihar [AIR 1989 SC 1456] this Court laid down<br \/>\nthat unless the nature of the crime and the circumstances of<br \/>\nthe  offender  reveal that the criminal is a menace  to\t the<br \/>\nsociety\t and  the  sentence of life  imprisonment  would  be<br \/>\naltogether  inadequate,\t the Court should ordinarily  impose<br \/>\nthe  lesser  punishment\t and not the extreme  punishment  of<br \/>\ndeath  which should be reserved for exceptional cases  only.<br \/>\nThe ratio of these cases is of no help to the appellant.  We<br \/>\nmay,  however, note here that in Shankar vs.  State of Tamil<br \/>\nNadu  [(1994)  4 SCC 478], the finding recorded by the\tHigh<br \/>\nCourt\twas   that   the   crime  indulged   was   gruesome,<br \/>\ncold-blooded,\theinous,  atrocious  and   cruel   and\t the<br \/>\naccused-appellant  was\tproved to be an ardent criminal\t and<br \/>\nthus  a menace to the society.\tOn those findings, the death<br \/>\nsentence  was confirmed by this Court as the facts disclosed<br \/>\nthat  the  culpability of the accused-appellant has  assumed<br \/>\nextreme\t depravity and therefore special reasons can be said<br \/>\nto  exist  to  order the death penalty.\t Now coming  to\t the<br \/>\nfacts\tof  this  case,\t the   circumstances  of  the\tcase<br \/>\nunmistakably  show  that the murder committed was  extremely<br \/>\ngruesome,  heinous,  cold-blooded and cruel.  The manner  in<br \/>\nwhich  the murder was committed was atrocious and  shocking.<br \/>\nAfter giving blows with a sword to the deceased when he fell<br \/>\ndown  the appellant amputed his hand, severed his head\tfrom<br \/>\nthe  body carried it through the road to the police  station<br \/>\n(majestically  as the trial court puts it) by holding it  in<br \/>\none  hand  and the blood dripping weapon on the other  hand.<br \/>\nDoes  it not depict the extreme depravity of the  appellant?<br \/>\nIn  our view it does.  The mitigating circumstances  pointed<br \/>\nout by the learned counsel for the appellant are, though the<br \/>\nappellant himself did not state any mitigating circumstances<br \/>\nwhen  inquired about the same by the learned Sessions Judge,<br \/>\nthat  the  appellant is a young man of 33 years\t and  having<br \/>\nthree unmarried sisters and aged parents and he was not well<br \/>\nat  that time.\tThese circumstances when weighed against the<br \/>\naggravating  circumstances  leave us in no doubt  that\tthis<br \/>\ncase falls within the category of rarest of rare cases.\t The<br \/>\nTrial Court has correctly applied the principles in awarding<br \/>\nthe death sentence and the High Court has committed no error<br \/>\nof law in confirming the same.\tOn these facts, declining to<br \/>\nconfirm\t the death sentence will, in our view, stultify\t the<br \/>\ncourse\tof  law and justice.  <a href=\"\/doc\/808276\/\">In Govindasami vs.   State  of<br \/>\nTamil Nadu (JT<\/a> (1998) 3 260 ] Mukherjee,J.  speaking for the<br \/>\ncourt  observed, &#8220;If, inspite thereof, we commute the  death<br \/>\nsentence  to  life  imprisonment  we  will  be\tyielding  to<br \/>\nspasmodic  sentiment, unregulated benevolence and  misplaced<br \/>\nsympathy&#8221;.\n<\/p>\n<p>      In  these circumstances, we uphold the death sentence.<br \/>\nThe appeal is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sri Mahendra Nath Das Sri Gobinda &#8230; vs State Of Assam on 14 May, 1999 Author: S M Quadri Bench: D.P.Mohapatro, Syed Shah Quadri PETITIONER: SRI MAHENDRA NATH DAS SRI GOBINDA DAS Vs.
