No.6629 of 2009) is<\/p>\n<p>allowed. Annexures P-10 to P-12 are taken on record.<\/p>\n<p>                   Learned          counsel           contends       that        the<\/p>\n<p>petitioner is entitled to release of grant-in-aid.<\/p>\n<p>The    same,     however,          is       not       being     released         and<\/p>\n<p>therefore,      the     petitioner-College                    is    not     in     a<\/p>\n<p>position to pay the salaries.\n<\/p>\n<p>                   In   this        regard,           learned      counsel       has<\/p>\n<p>relied on the decision dated 21.3.2009 of this Court<\/p>\n<p>in Civil Writ Petition No.4464 of 2009 titled &#8216;BLM Girls College, Arya<\/p>\n<p>Samaj, Nawanshahr vs. State of Punjab &amp; Others&#8217;.<\/p>\n<p>                   Notice of motion.\n<\/p>\n<p>                   Mr. Sandeep Moudgil, Deputy Advocate<\/p>\n<p>General, Punjab, on the asking of the Court accepts<br \/>\n CWP No.5367 of 2009                                          [2]<\/p>\n<p>notice. Copy of the petition has been handed over.<\/p>\n<p>                      Learned      counsel     for    the      respondents<\/p>\n<p>has not been able to dispute that the grant-in-aid<\/p>\n<p>is     required   to       be   released     in    terms      of     judgment<\/p>\n<p>relied upon on behalf of the petitioner.<\/p>\n<pre>                      Considering            the           facts           and\n\ncircumstances         of    the    case;     in    terms      of     judgment\n\n<\/pre>\n<p>rendered in BLM Girls College&#8217;s case (supra) and decision<\/p>\n<p>rendered     in    C.W.P.         No.5393    of    2008,       decided      on<\/p>\n<p>24.4.2008, in case titled &#8216;Ramgaria College of Education,<\/p>\n<p>Phagwara vs. State of Punjab and others&#8217;, it is directed that<\/p>\n<p>the respondents shall pay 85% of the grant-in-aid<\/p>\n<p>due to the petitioner within a period of 3 months<\/p>\n<p>after clearance of objections by the petitioner.
