Justice K.K.DENESAN\n\n Dated :16\/03\/2007\n\n O R D E R\n                            K.K.DENESAN, J.\n\n                     -----------------------------\n\n                         WP(C)No. 7440 OF 2007\n\n                     -----------------------------\n\n                    Dated this the 16th March, 2007.\n\n\n\n                                       JUDGMENT\n<\/pre>\n<p>      The petitioner is working as Selection Grade Typist in<\/p>\n<p>the   General   Education   Department.     The   second   respondent<\/p>\n<p>passed   Ext.P2   order   allowing   the   request   of   the   petitioner<\/p>\n<p>to   promote   her   notionally   to   the   post   of   Selection   Grade<\/p>\n<p>Typist         retrospectively          with         effect         from         18.6.2003.\n<\/p>\n<p>However,   it   was   stated   in   Ext.P2   that   she   will   not   be<\/p>\n<p>entitled for back arrears since the retrospective promotion<\/p>\n<p>granted  was only notional.\n<\/p>\n<p>      2. Counsel for the petitioner submits that Ext.P1 order<\/p>\n<p>would show that the petitioner is entitled for back arrears<\/p>\n<p>also and that Ext.P2 order is unsustainable.\n<\/p>\n<p>      3.     Govt.   Pleader   on   instruction   submits   that   the<\/p>\n<p>second   respondent   is   reconsidering   the   stand   taken   by   that<\/p>\n<p>respondent   in   Ext.P2   and   that   fresh   orders   will   be   passed<\/p>\n<p>after   taking   into   consideration   relevant   orders   and   rules<\/p>\n<p>on the subject.\n<\/p>\n<p>      4.     In   the   light   of   the   above   submission   the   writ<\/p>\n<p>petition   is   disposed   of   directing   the   second   respondent   to<\/p>\n<p>pass   fresh   orders   in   accordance   with   law   regarding   the<\/p>\n<p>right   of   the   petitioner   for   back   arrears   from   18.6.2003<\/p>\n<p>onwards   in   the   post   of   Selection   Grade   Typist.
