Mr.  Issac Mohanlal for R-1\t\t\n\t\t\t\n\t\t- - - - - - - -\n\n:JUDGMENT\n<\/pre>\n<p>(Judgment of the Court was delivered by D.MURUGESAN, J.)<\/p>\n<p>\t Mr. Issac Mohanlal, learned counsel takes notice for the first<br \/>\nrespondent.\n<\/p>\n<p>\t\t2. This Writ Appeal is filed at the instance of the Secretary,<br \/>\nDepartment of Government Examinations, Chennai, questioning the order dated<br \/>\n16.07.2010 allowing the writ petition in W.P.(MD)No.8458 of 2010.\n<\/p>\n<p>\t\t3. The Writ Petition pertains to Question No.19 of Part III &#8211;<br \/>\nBIOLOGY (English Version) paper  for Higher Secondary Examinations conducted<br \/>\nduring March 2010 and the corresponding answer.  Question No.19 of Section &#8211; B<br \/>\nof that Question Paper is as follows:-\n<\/p>\n<p>\t\t&#8220;19. Draw and label the parts of acrocentric chromosome&#8221;.\n<\/p>\n<p>\t\t4. The candidate viz., the first respondent herein has answered the<br \/>\nquestion in the following manner:-\n<\/p>\n<p>The answer to the question carries three marks. The first respondent was not<br \/>\ngiven that three marks on the ground that he had not correctly positioned the<br \/>\ndiagram.\n<\/p>\n<p>\t\t5.  The first respondent \/ candidate had approached this Court with<br \/>\na specific case that Acrocentric Chromosome do not have static position as it is<br \/>\nmovable and the long arm can be vertically upward or the long arm can also be<br \/>\ndownward and the entire Chromosome may also be in a horizontal position. Hence,<br \/>\nthe answer given by the first respondent is correct. Further, the grievance of<br \/>\nthe candidate is that by that question, a candidate could understand that he<br \/>\nshould draw the diagram without reference to its position of the Acrocentric<br \/>\nChromosome and thereafter, label the parts. Inasmuch as he had chosen to draw<br \/>\nthe Acrocentric Chromosome and had shown its part viz., Centromere in the just<br \/>\nbelow the middle of Chromosome, there is nothing wrong in drawl of the diagram<br \/>\nand the answer given mentioning the parts. His further grievance is that he had<br \/>\nbeen unjustly denied of three marks. In support of the said claim, the learned<br \/>\ncounsel appearing for the first respondent had relied upon the following books:-\n<\/p>\n<p>1.&#8221;Genetics and Evolution&#8221; by P.L.Kochhar;\n<\/p>\n<p>2.&#8221;Gentetic and Eugenics&#8221; by Dr. O.P.Saxena\n<\/p>\n<p>3.&#8221;Elements of Cytology&#8221; by Prof. T.S.Gopalakrishnan.<br \/>\nWith the above grievance, the first respondent had prayed for grant of award of<br \/>\nfull three marks to the said question.\n<\/p>\n<p>\t\t6. While opposing the writ petition, the appellant herein had merely<br \/>\nstated that in such event, the matter may be referred to the examiner himself<br \/>\nfor clarification to find out as to why he had not awarded the marks.\n<\/p>\n<p>\t\t7. At this stage, we may refer that it is not as if the appellant<br \/>\nhad objected to the writ petition on the ground that the question was wrong and<br \/>\nonly the objection was that the reason for not awarding mark was not known.\n<\/p>\n<p>\t\t8. Having considered the three books relied on by the learned<br \/>\ncounsel appearing for the candidate and having taken note of the fact that it is<br \/>\nnot a matter to be referred to the concerned examiner himself in view of the<br \/>\nspecific answers in those books, the learned Single Judge directed to award full<br \/>\nthree marks to the candidate, which order has given a cause for the present Writ<br \/>\nAppeal.\n<\/p>\n<p>\t\t9. We have heard the submissions of Mr.V.Rajasekaran, learned<br \/>\nSpecial Government Pleader appearing for the appellants and Mr. Issac Mohanlal,<br \/>\nlearned counsel appearing for the first respondent.\n<\/p>\n<p>\t\t10. According to Mr. V. Rajasekaran, learned Special Government<br \/>\nPleader, in the authorized Text Book of BIOLOGY subject, the position of<br \/>\nCentromere is shown just above the middle portion of Acrocentric Chromosome.  On<br \/>\nthe other hand, in the answer given by the candidate, &#8220;Centromere&#8221; has been<br \/>\nshown just below the middle of Chromosome, which is not as per the said Text<br \/>\nBook. The examiner has considered the answer only with reference to the actual<br \/>\nanswer given in the Text Book.  Learned Special Government Pleader would further<br \/>\nsubmit that even otherwise, in a matter like this regarding the valuation of<br \/>\nanswer sheets, the learned Single Judge ought to have referred the matter to the<br \/>\nexperts instead of placing reliance on the books relied on by the candidate and<br \/>\nought not to have ordered adding of three marks to the answer.\n<\/p>\n<p>\t\t11. Mr. Issac Mohanlal, learned counsel appearing for the first<br \/>\nrespondent, on the other hand, would submit that the learned Single Judge is<br \/>\nright in directing to add three full marks in the given facts of the case as the<br \/>\nposition in the diagram of Acrocentric Chromosome may vary as it is not static.<br \/>\nAll that the candidate was asked to draw a diagram of that Acrocentric<br \/>\nChromosome and thereafter indicate its parts. He has also produced a typed set<br \/>\nof papers, containing the diagrams of Acrocentric Chromosome in different<br \/>\npositions to show that it is not static. Hence, the learned counsel appearing<br \/>\nfor the candidate would submit that the order of the learned Single Judge needs<br \/>\nno interference.\n<\/p>\n<p>\t\t12. We have carefully considered the rival submissions of the<br \/>\nlearned Special Government Pleader appearing for the appellants and the learned<br \/>\ncounsel appearing for the first respondent.\n<\/p>\n<p>\t\t13. At the out set, we may point out that in academic matters,<br \/>\nparticularly in valuation of question and answer, this Court should not venture<br \/>\nto consider as to whether the question and answer is correct or not and leave<br \/>\nthe matter to the experts for their decision. This is basically on the principle<br \/>\nthat finality must be attached to such question and answer and the Court is not<br \/>\nexpert on the subject. Nevertheless, in the event, on the face, an answer given<br \/>\nto a question is acceptable to the Court as correct answer, without any further<br \/>\nopinion of the experts on the same, the grant of relief cannot be denied.\n<\/p>\n<p>\t\t14. The Question No.19, which we have extracted in the earlier<br \/>\nportion of the Judgment, seeks the candidate first to draw the diagram of<br \/>\n&#8220;Acrocentric Chromosome&#8221; and thereafter to label its parts. The question<br \/>\ncontains two parts. As far as the first part is concerned, it does not refer to<br \/>\nthe position viz., whether the Acrocentric Chromosome would be vertically upward<br \/>\nor downward or horizontal. The opinion dated 05.07.2010 of the Professor, who is<br \/>\nthe Head of the Department of Botany (Rtd), N.M.Christian College, Marthandam,<br \/>\nis that Acrocentric Chromosome of the nucleus of living cells will remain in any<br \/>\nposition, The long arm may be vertically upward or it may be vertically downward<br \/>\nor the entire chromosome may be in horizontal position.(Page No.132 of the typed<br \/>\nset of papers filed by the candidate). Apart from the three books, which were<br \/>\nrelied on by the learned counsel for the candidate before the learned Single<br \/>\nJudge, certain books by different authors were placed before us. We can see that<br \/>\nin Page Nos.71, 77, 93, 101, 112 and 127 of the Typed set of papers filed by the<br \/>\nlearned counsel appearing for the first respondent, the position of Acrocentric<br \/>\nChromosome is shown like the following:-\n<\/p>\n<p>May be the authorized text book of BIOLOGY &#8211; Botany for the Higher Secondary &#8211;<br \/>\nSecond Year shows a different position of Acrocentric Chromosome, which by<br \/>\nitself does not indicate that Acrocentric Chromosome is static and it cannot<br \/>\nchange its position.\n<\/p>\n<p>\t\t15. When a doubt was entertained, the re-valuation was referred to a<br \/>\nCommittee, of course consisting of three Post Graduate Assistants of various<br \/>\nGovernment Higher Secondary Schools, they had given their opinion, which is as<br \/>\nfollows:-\n<\/p>\n<p>\t&#8220;Question No.19:-\n<\/p>\n<p>\t\tAccording to the question paper, the question No.19, based on the<br \/>\nkey and the text book given by the Education Department, the position of the<br \/>\narms in Acrocentric Chromosome diagram drawn by the candidate is wrong and the<br \/>\nbrief description is not necessary as per the key answers&#8221;.\n<\/p>\n<p>\t\t16. We have gone through the same and in our considered opinion, the<br \/>\nsame has been given by the Revaluation Committee as if the question was asked as<br \/>\nto the particular position of the arms of Acrocentric Chromosome. The said<br \/>\nopinion with reference to the position of the arms does not reflect in the<br \/>\nquestion paper, which we have extracted above. The candidates were expected to<br \/>\ndraw the Acrocentric Chromosome, which has no definite position as it is a<br \/>\nliving cell and it can move and can have a different position as could be seen<br \/>\nfrom the extract of the text books produced before us.\n<\/p>\n<p>\t\t17. That apart, when a slight doubt is entertained about the<br \/>\nquestion and the question is not clear, the benefit could be given to the<br \/>\ncandidate as denial of marks to such question and answer would certainly be not<br \/>\njustified.\n<\/p>\n<p>\t\t18. Having regard to the above factual position, especially when no<br \/>\nfurther opinion is required, we do not find any reason or justification to<br \/>\ninterfere with the order of the learned Single Judge.  It is true that the<br \/>\nCourt,  being not a expert in a subject cannot issue a positive direction.<br \/>\nNevertheless there may be cases where such a direction can be issued when no<br \/>\nfurther opinion of the expert is required and denial of such relief would<br \/>\nseriously affect the candidate.\n<\/p>\n<p>\t\t19. In that view of the matter, this Writ Appeal has no merits, and<br \/>\naccordingly, the same is dismissed.
