Respondents\n\n\nCoram:      Hon'ble Mr. Justice Ajay Tewari\n\n\nPresent:    Mr.Raghbir Chaudhary, Advocate\n            for the appellant.\n                   ****\n\nAjay Tewari, J.\n<\/pre>\n<p>CM No.11544-C of 2009<\/p>\n<p>            CM allowed as prayed for.\n<\/p>\n<p>RSA No. 2047 of 2008 (O&amp;M)<\/p>\n<p>            This appeal has been filed against the concurrent judgments of<\/p>\n<p>the Courts below decreeing the suit of the respondent for specific<\/p>\n<p>performance to the extent of refund of double the amount of earnest<\/p>\n<p>money with regard to an agreement to sell dated 8.7.2002.<\/p>\n<p>            The following questions have been proposed&#8221;-<\/p>\n<p>            i) Whether the plaintiff was ready and willing to perform his<br \/>\n               part of the contract which arose in furtherance of agreement<br \/>\n               to sell dated 08.07.2002?\n<\/p>\n<p>            ii) Whether the courts below were justified in partly decreeing<br \/>\n               the suit of the plaintiff vis-a-vis the payment of double the<br \/>\n               amount of earnest money in spite of the fact that the main<br \/>\n<span class=\"hidden_text\"> RSA No.2047 of 2008 (O&amp; M)             2<\/span><\/p>\n<p>               prayer of the plaintiff (issue No.5) as regard to specific<br \/>\n               performance has been specifically declined by the courts<br \/>\n               below for the reasons returned on the said issue?\n<\/p>\n<p>            iii)Whether in view of the facts and circumstances f the present<br \/>\n               case, the judgments and decrees passed by the courts below<br \/>\n               against the defendant (appellant) are illegal, unjust and<br \/>\n               unsustainable in the eyes of law?\n<\/p>\n<p>            Learned counsel has only argued question No. (i). However, the<\/p>\n<p>said question is a pure question of fact. Learned counsel has taken me<\/p>\n<p>through the findings of both the Courts below recorded thereon but has not<\/p>\n<p>been able to persuade me that the said findings are either based on no<\/p>\n<p>evidence or on such perverse misreading of the evidence so as to be liable<\/p>\n<p>for interference under Section 100 CPC The same is decided against the<\/p>\n<p>appellant. Questions No. (ii) and (iii) are peripheral questions.<\/p>\n<p>            Consequently this appeal as well as application for stay are<\/p>\n<p>dismissed.
