None appeared on behalf of Respondent no.1\/ State.<\/p>\n<p>                              The present writ petition has been filed with a prayer to<\/p>\n<p>                  quash an order dated 24.10.2007 passed by the Respondent no.4\/<\/p>\n<p>                  Dy. Secretary, Bihar Legislative Council, Patna. It has further been<\/p>\n<p>                  prayed to direct the Respondents to pay the death-cum- retiral<\/p>\n<p>                  benefit of Late Manju Jaiswal @ Manju Kumari Jaiswal              to the<\/p>\n<p>                  petitioner. It is not in dispute that the petitioner is the daughter of<\/p>\n<p>                  one Arun Kumar Pandey and Smt. Surya Prabha Pandey , who were<\/p>\n<p>                  her natural guardian .The petitioner has claimed that she was<\/p>\n<p>                  adopted by Manju Jaiswal, who was Assistant in the Bihar<\/p>\n<p>                  Legislative Council,Patna and she died on 05.08.2006 while in<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>service. The petitioner has claimed that she was adopted by Manju<\/p>\n<p>Jaiswal , while she was only typist in the Bihar Legislative Council .<\/p>\n<p>After the death of the employee, the petitioner being her adopted<\/p>\n<p>daughter applied for payment of death-cum- retiral dues. However,<\/p>\n<p>the Respondent no.4\/ Dy. Secretary, Bihar Legislative Council<\/p>\n<p>instead of granting the benefit vide Annexure-2 to the writ petition<\/p>\n<p>has directed the petitioner to produce succession certificate.<\/p>\n<p>             Learned counsel for the petitioner has drawn my<\/p>\n<p>attention to the enclosures of Annexure-3 to the petition, particularly<\/p>\n<p>at page-19. It was submitted that the deceased employee had<\/p>\n<p>nominated the petitioner for claiming the amount under the head of<\/p>\n<p>group insurance. It has been argued that since the petitioner was<\/p>\n<p>made nominee by the deceased employee under the scheme of group<\/p>\n<p>insurance, the petitioner was entitled to get at least the amount under<\/p>\n<p>the head of group insurance and she is also entitled to get all the<\/p>\n<p>death-cum- retiral dues of deceased employee. Accordingly, it has<\/p>\n<p>been argued that Annexure-2 was issued without any basis and only<\/p>\n<p>with a view to defer the claim of the petitioner regarding death-cum-<\/p>\n<p>retiral dues of deceased employee. Learned counsel for the<\/p>\n<p>petitioner has heavily relied on the scheme of group insurance and<\/p>\n<p>has prayed that as per the scheme as well as being nominee, the<\/p>\n<p>petitioner is entitled to get the amount under the head of group<\/p>\n<p>insurance.\n<\/p>\n<p>             In this case, a counter affidavit has been filed on behalf<\/p>\n<p>of Respondent nos. 2 to 4. In its counter affidavit, it has been<\/p>\n<p>categorically stated that for death-cum- retiral dues at least three<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>claimants had approached the Respondents. The petitioner after the<\/p>\n<p>death of the deceased employee had filed an application for death-<\/p>\n<p>cum- retiral dues and also for her appointment on compassionate<\/p>\n<p>ground. Representation of the petitioner has been brought on record<\/p>\n<p>as Annexure-D to the counter affidavit. The Respondents has further<\/p>\n<p>stated that after the death of the employee , one Shreya Suman had<\/p>\n<p>filed an application on 01.09.2006 and had claimed pension,<\/p>\n<p>gratuity, group insurance etc. on behalf of the deceased ( Manju<\/p>\n<p>Jaiswal @ Manju Kumari Jaiswal. Similarly, the father of the<\/p>\n<p>deceased employee, namely, Bashishth Choudhary had also claimed<\/p>\n<p>for all death-cum- retiral dues of the deceased employee and, as<\/p>\n<p>such, since there was serious dispute regarding the claim of death-<\/p>\n<p>cum- retiral dues of the deceased employee, the Respondent no.4<\/p>\n<p>has rightly asked the person concerned to produce succession<\/p>\n<p>certificate. It has been argued by learned counsel for the Respondent<\/p>\n<p>nos. 2 to 4 that in view of the facts and circumstances, particularly<\/p>\n<p>number of claimants, the Respondent no.4 has rightly issued<\/p>\n<p>Annexure-2 to the petition, which requires no interference.<\/p>\n<p>           Besides hearing learned counsel for the parties, I have<\/p>\n<p>also perused the materials available on record. It is true that the<\/p>\n<p>nomination paper, which has been brought as enclosure to<\/p>\n<p>Annexure-3 to the petition, the petitioner&#8217;s name has been<\/p>\n<p>mentioned as nominee to the claimed amount under the group<\/p>\n<p>insurance scheme. The fact remains that the present writ petition has<\/p>\n<p>not been filed only for the purpose for direction to make payment of<\/p>\n<p>the amount of group insurance, but the petitioner has claimed for<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>        making payment of death-cum- retiral dues of the deceased<\/p>\n<p>        employee and compassionate appointment.\n<\/p>\n<p>                   In view of the different claimants, amongst them one of<\/p>\n<p>        the claimants is none else but own father of the deceased employee,<\/p>\n<p>        the Court is of the opinion that the Respondent no.4 has rightly<\/p>\n<p>        asked the parties to produce the succession certificate. Regarding<\/p>\n<p>        the claim of death-cum- retiral dues of deceased employee by way<\/p>\n<p>        of exercising writ jurisdiction, it would not be appropriate for this<\/p>\n<p>        Court to create a situation for generating litigation and disputes.<\/p>\n<p>                   In view of the facts and circumstances, the Court is of the<\/p>\n<p>        opinion that no relief can be granted to the petitioner.<\/p>\n<p>                   Accordingly, the writ petition stands dismissed.<\/p>\n<p>                                              ( Rakesh Kumar, J.)<br \/>\nNKS\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
