Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a  Writ  of  Habeas  Corpus to call for the records of the first\nrespondent herein in C.M.P.No.32\/B.L.\/Salem City\/2005, set aside the order  of\ndetention passed therein dated 16.12.2005 and direct the respondents herein to\nproduce  the  detenu  by  name  Chinnadurai  before  this Court setting him at\nliberty now detained in the Central Prison, Salem.\n\n!For Petitioner :  Mr.S.Panneerselvam\n\n^For Respondents        :  Mr.M.K.Subramanian\n                Govt. Side)\n\n:O R D E R \n<\/pre>\n<p>                (Order of the Court was made by P.SATHASIVAM, J.)<br \/>\n        The petitioner, who is the wife of the detenu by name Chinnadurai, who<br \/>\nwas detained as a &#8220;Bootlegger&#8221; as contemplated under the Tamil Nadu Prevention<br \/>\nof Dangerous Activities of  Bootleggers,  Drug  Offenders,  Forest  Offenders,<br \/>\nGoondas,  Immoral  Traffic  Offenders,  Slum  Grabbers  and Video Pirates Act,<br \/>\n1982(Tamil Nadu Act 14  of  1982),  by  the  impugned  detention  order  dated<br \/>\n16.12.2005, challenges the same in this Petition.\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is enormous delay in disposal of the representation of the detenu, which<br \/>\nvitiates the ultimate order of detention.  With reference to the above  claim,<br \/>\nlearned Government Advocate has placed the details,<br \/>\nwhich show that the representation of the detenu dated 10.01.2006 was received<br \/>\nby  the  Government  on  17.01.2006 and remarks were called for on 18.01.2006.<br \/>\nThereafter, the remarks were received by the Government on 27.01.2006 and  the<br \/>\nFile  was  submitted  on  28.01.2006  and the same was dealt with by the Under<br \/>\nSecretary and the Deputy Secretary on 30.01.2006 and finally, the Minister for<br \/>\nProhibition and Excise passed orders on 31.01.2006.  The rejection letter  was<br \/>\nprepared on 0 7.0 2.2006 and the same was sent to the detenu on 08.02.2006 and<br \/>\nserved to  him  on  10.02.2006.  As rightly pointed out by the learned counsel<br \/>\nfor the petitioner, though the Minister for Prohibition and Excise  passed  an<br \/>\norder  on  31.01.2006,  there  is  no  explanation  at all for taking time for<br \/>\npreparation of rejection letter till  07.02.2006.    In  the  absence  of  any<br \/>\nexplanation  by  the  person  concerned  even  after excluding the intervening<br \/>\nholidays, we are of the view that the time taken for preparation of  rejection<br \/>\nletter  is  on  the higher side and we hold that the said delay has prejudiced<br \/>\nthe detenu in disposal of his representation.  On this ground,  we  quash  the<br \/>\nimpugned order of detention.\n<\/p>\n<p>        4.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>To<\/p>\n<p>1.
