SAHAI)<\/p>\n<p>\tHeard<br \/>\nMr.H.S.Munshaw,<\/a> learned counsel for the appellant and<br \/>\nMr.K.B.Pujara,learned counsel for the respondent.\n<\/p>\n<p>2.\tRule<br \/>\nreturnable on 17.3.2011. Mr.K.B.Pujara, learned counsel waives<br \/>\nservice of Rule on behalf of respondent.\n<\/p>\n<p>3.\tMr.Pujara,<br \/>\nlearned counsel for the respondent prays for time to file<br \/>\naffidavit-in-reply. Three weeks&#8217; time is granted.\n<\/p>\n<p>4.\tMs.Sejal<br \/>\nMandavia, learned counsel states that her matter being Letters Patent<br \/>\nAppeal No. 1408 of 2010 is wrongly tagged with Letters Patent Appeal<br \/>\nNo.3075 of 2010. The matter is de-linked and shall be listed<br \/>\nseparately.\n<\/p>\n<p>5.\tThe<br \/>\napplication dated 1.11.1987, which, according to the respondent was<br \/>\nan application for Voluntary Retirement Scheme (&#8216;VRS&#8217; for short)<br \/>\nwhich was not accepted.  The second application dated 15.12.1987 is<br \/>\nan application where the respondent states that he was to voluntarily<br \/>\nretire, but with effect from 30.11.1991, after four years.  Learned<br \/>\ncounsel for the appellant has urged that none of these applications<br \/>\nhas reached the applicant\/ appellant, but when his the application<br \/>\nwas given on 1.11.1987, at that time, the respondent was in USA.<br \/>\nFurther, in what manner these applications have been sent is not<br \/>\ndisclosed. There is no application by the respondent even after<br \/>\nreturning from USA. Therefore, prima facie, the appellant had not<br \/>\ndenied VRS deliberately to the respondent and terminated the services<br \/>\nof the respondent.  Prima facie, we are of the opinion that the<br \/>\nlearned Single Judge has not examined the matter regarding the<br \/>\nfindings on record.
