L. Pandya, learned APP waives service of Rule on behalf<br \/>\nof respondent.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been preferred under Section 439 of the Code of<br \/>\nCriminal Procedure, in connection with the offence being<br \/>\nCR No.5030 of 2011 registered with Bapunagar<br \/>\nPolice Station, Ahmedabad for the offences u\/s. 66(B), 65(A) (E),<br \/>\n116(B), 81 of the Prohibition Act.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicant has contended that from the possession of<br \/>\nthe applicant, nothing is recovered and the applicant was wrongly<br \/>\nbooked by the police in the offence alleged against him.  The offence<br \/>\nis registered under the provision of Prohibition Act.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP has vehemently opposed this application.  However, learned<br \/>\ncounsel do not press for reasoned order.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned Counsel for both the sides.  The offence is registered<br \/>\nagainst the applicant under the Prohibition Act.  In the facts and<br \/>\ncircumstances of the case,  it seems that there is no definite<br \/>\nallegation made against the applicant, I am inclined to grant bail to<br \/>\nthe applicant.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above, this application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with CR No.5030 of 2011<br \/>\nregistered with Bapunagar Police Station for the offence alleged<br \/>\nagainst him in this application on his executing a Bond of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with one solvent surety of the<br \/>\nlike amount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge.\n<\/p>\n<p>f)\tmark<br \/>\npresence on 15th day of every English calender month<br \/>\nbetween 11:00 a.m. to 12:00p.m. before the concerned police station<br \/>\ntill the trial against the applicant is over.\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
