The demand drafts for Rs. 3<\/p>\n<p>                  lacs which remained to be paid are ready as noted in the<\/p>\n<p>                  order dated 3rd December, 2010. So far as monthly<\/p>\n<p>                  maintenance @ Rs. two thousand per month from March<\/p>\n<p>                  to June, 2010 is concerned, the 3rd Supplementary<\/p>\n<p>                  affidavit filed on behalf of the appellant discloses that<\/p>\n<p>                  the said amount has been paid regularly each month<\/p>\n<p>                  when it became due.\n<\/p>\n<p>                            The main concern of the Court was whether to<\/p>\n<p>                  pay the demand drafts for Rs. 3 lacs to the respondent or<\/p>\n<p>                  not when a criminal case u\/s 498A and other sections of<\/p>\n<p>                  the IPC pending before a court of Judicial Magistrate, 1st<\/p>\n<p>                  class, Samastipur bearing G.R. no. 949\/2001, Tr. No.<\/p>\n<p>                  732\/2010 and also an Execution case bearing No. 25\/09<\/p>\n<p>                  for release of maintenance amount before the Family<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>Court at Samastipur have not been withdrawn as yet.<\/p>\n<p>Today certified copies of the order sheets have been<\/p>\n<p>produced on behalf of respondent to show that in both<\/p>\n<p>the cases withdrawal applications have been filed. In the<\/p>\n<p>Execution case the matter is to be taken up on the date<\/p>\n<p>fixed from before, that is, 29-12-2010 whereas in the<\/p>\n<p>criminal case the Presiding Officer was on leave on 4th<\/p>\n<p>December, 2010 when the application was filed.<\/p>\n<p>          In view of aforesaid stand of the respondent<\/p>\n<p>that she has already taken all the required steps and the<\/p>\n<p>cases shall be withdrawn as soon as the matter is taken<\/p>\n<p>up by the court concerned, let the demand drafts for Rs.<\/p>\n<p>3 lacs be handed over to learned counsel for the<\/p>\n<p>respondent in court just now.
