JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tMr.\n<\/p>\n<p>Apurva R. Kapadia, learned advocate for the petitioner has submitted<br \/>\nthat the case of the petitioner is covered by judgment dated 21st<br \/>\nDecember, 2009 passed in Special Civil Application No.9523 of 2009<br \/>\nand connected matters. It is submitted that the petitioner has been<br \/>\nappointed after following the due procedure of selection and has<br \/>\ncompleted five years of services.\n<\/p>\n<p>\tThat<br \/>\nthe petitioner is eligible for regularization of his services as per<br \/>\nletter dated 03.05.2008 of respondents Nos.2 and 3, among others. It<br \/>\nis further pointed out by the learned advocate for the petitioner<br \/>\nthat pursuant to the above-mentioned letter, respondent No.2 has<br \/>\nregularized the services of five employees who are similarly situated<br \/>\nto the petitioner, relying upon letter dated 03.05.2008. Not only<br \/>\nthat, but the Principal Secretary, Urban Housing and Urban<br \/>\nDevelopment Department has addressed  letter dated 22\/27.05.2008 to<br \/>\nrespondent No.2, clearly stating that powers to regularize the<br \/>\nconcerned employees have been conferred upon the said respondent by<br \/>\nthe State Government. In spite of this situation, even though the<br \/>\npetitioner is eligible for regularization in view of letter dated<br \/>\n03.05.2008 of the State Government, respondents Nos.2 and 3 are not<br \/>\nregularizing his services, even though representation  dated<br \/>\n03.01.2009, 30.05.2009, 06.10.2009, 12.10.2009 and 11.11.2009 have<br \/>\nbeen made by the petitioner, to respondents Nos.2 and 3.\n<\/p>\n<p>\tOn<br \/>\n16.11.2010, the learned advocate for the petitioner had made<br \/>\nsubmissions as reproduced hereinabove. However, the Court was unable<br \/>\nto proceed with the matter in the absence of Mr. Nikhilesh J. Shah,<br \/>\nlearned counsel for respondents Nos.2 and 3. The matter was directed<br \/>\nto be listed on 23.11.2010 and, as stated in order dated 16.11.2010<br \/>\nof this Court, it was expected that Mr. Nikhilesh J. Shah would make<br \/>\nit convenient to attend the Court and represent respondents Nos.2 and<br \/>\n3, on that date.\n<\/p>\n<p>\tOn<br \/>\n23.11.2010, the matter had to be adjourned yet again, as Mr. Shah did<br \/>\nnot remain present though he was made aware of the order of this<br \/>\nCourt. Thereafter, on 30.11.2010, on the request of Mr. Nikhilesh J.<br \/>\nShah, the matter was adjourned to 13th December, 2010 in<br \/>\norder to enable him to file an affidavit-in-reply. The Court has<br \/>\nspecifically noted in the said order that the affidavit-in-reply be<br \/>\nfiled on, or before, 13th December, 2010 with an advance<br \/>\ncopy thereof to be supplied to the learned counsel for the<br \/>\npetitioner, who may file an affidavit-in-rejoinder, if so desired.<br \/>\nFour weeks have passed since the last date of hearing. However, no<br \/>\naffidavit-in-reply has been filed on behalf of respondents Nos.2 and<br \/>\n3, and neither has Mr. Nikhilesh J. Shah, the learned advocate, cared<br \/>\nto remain present to argue the matter on behalf of the said<br \/>\nrespondents.\n<\/p>\n<p>\tIn<br \/>\nview of the facts and circumstances of the case, as narrated<br \/>\nhereinabove, the matter could have been heard and decided after<br \/>\nhearing the learned counsel for the respective parties. However, due<br \/>\nto the absence of Mr. Shah, the Court cannot proceed further in the<br \/>\nmatter, for the third time.\n<\/p>\n<p>\tThe<br \/>\nmatter may now be listed on 15.12.2010. It is made clear that on the<br \/>\nnext date of hearing, the Court shall proceed to decide the matter,<br \/>\nwithout waiting for the learned advocate for respondents Nos.2 and 3.\n<\/p>\n<p>(Smt.
