No.1756 of 2006\n             RAMA NAND PRASAD @ RAMA NAND KUMAR\n                               Versus\n                     NARESH PRASAD &amp; ORS\n                              -----------\n<\/pre>\n<p>16\/   08.04.2011            I.A. No. 892 of 2011<\/p>\n<p>                            The present interlocutory application has<\/p>\n<p>                   been filed on behalf of the petitioners in compliance<\/p>\n<p>                   of order dated 14.01.2011, and a prayer has been<\/p>\n<p>                   made that substituted service may be effected upon<\/p>\n<p>                   opposite party nos. 7 and 12, who are deliberately<\/p>\n<p>                   avoiding the service of notice issued by this Court<\/p>\n<p>                   as per orders passed on previous occasion.<\/p>\n<p>                            It is submitted that opposite party no. 7 is<\/p>\n<p>                   residing at Kolkata, whereas opposite party no.12 is<\/p>\n<p>                   residing at Jamshedpur under Jharkhand State.<\/p>\n<p>                   Therefore, a prayer has been made that notices be<\/p>\n<p>                   published in daily English newspaper &#8220;Telegraph&#8221;<\/p>\n<p>                   published   from   Kolkata   as   also   Hindi   daily<\/p>\n<p>                   newspaper     &#8220;Prabhat   Khabar&#8221;.    Daily   English<\/p>\n<p>                   newspaper &#8220;Telegraph&#8221; is under wide circulation in<\/p>\n<p>                   the town of Kolkata, where opposite party no.7 is<\/p>\n<p>                   said to be residing, and daily Hindi newspaper<\/p>\n<p>                   &#8220;Prabhat Khabar&#8221; is under wide circulation in the<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          town of Jamshedpur, where opposite party no.12 is<\/p>\n<p>          said to be residing.\n<\/p>\n<p>                    In the aforesaid facts and circumstances,<\/p>\n<p>          the present interlocutory application is allowed. Let<\/p>\n<p>          the notice\/advertisement       in proper format be<\/p>\n<p>          published in English daily newspaper &#8220;Telegraph&#8221; in<\/p>\n<p>          its Kolkata edition, and Hindi daily newspaper<\/p>\n<p>          &#8220;Prabhat Khabar&#8221; published from Ranchi. In both<\/p>\n<p>          notices\/advertisements, a tentative date of four<\/p>\n<p>          weeks from the date of publication of such notices<\/p>\n<p>          for the appearance of aforesaid opposite party nos.<\/p>\n<p>          7 and 12 shall be indicated.\n<\/p>\n<p>                    Office is hereby directed to issue a slip to<\/p>\n<p>          the counsel for the petitioners intimating him about<\/p>\n<p>          tentative cost of such publication within a period of<\/p>\n<p>          two weeks, whereafter the petitioners shall be<\/p>\n<p>          obliged to deposit the aforesaid costs within further<\/p>\n<p>          period of two weeks.
