No.1486 of 2009\n\n                   ----------------------------------\n\n              Dated this the 14th day of June, 2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>                         &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>Pius C.Kuriakose,J.\n<\/p>\n<p>           Delay is condoned since we are in a position to<\/p>\n<p>decide the appeal in favour of the contesting claimant\/<\/p>\n<p>respondent. According to us, this appeal is a surplusage.<\/p>\n<p>Against the judgment which is impugned in this appeal, State<\/p>\n<p>preferred L.A.A.No.927\/2009 and obviously the present<\/p>\n<p>appellant was also a party to that appeal. That appeal was<\/p>\n<p>dismissed by us by our judgment dt. 25.2.2010 finding that<\/p>\n<p>the enhancement granted under the impugned judgment is<\/p>\n<p>reasonable.
