Justice J.M.JAMES\n\n Dated :18\/09\/2006\n\n O R D E R\n                          J.M.JAMES, J.\n\n                             --------------\n\n                         B.A. 5613\/2006\n\n                           ------------------\n\nDATED THIS THE 18TH DAY OF SEPTEMBER, 2006\n\n\n\n\n                             O R D E R\n<\/pre>\n<p>             The   petitioner   is   before   this   Court,   under<\/p>\n<p>Section   438   Cr.P.C.,   as   he   apprehends   arrest   in   crime<\/p>\n<p>No.263\/2005   of   Kottayam   East   Police   Station,   for   the<\/p>\n<p>offence   punishable   under   Sections   143,   147,   148,   333<\/p>\n<p>and 332 read   with Section 149 IPC as well as Section 3<\/p>\n<p>(1)(c) of the P.D.P.P Act.\n<\/p>\n<\/p>\n<p>      2.     It   is   alleged   that   the   petitioner,     along   with<\/p>\n<p>others,   had   participated   in   an   unlawful   assembly   and<\/p>\n<p>remaining   in   that   assembly,     had   agitated   against   the<\/p>\n<p>educational  policy of the Government.   When they  were<\/p>\n<p>prevented,     they   had   assaulted   the   police   personnel,<\/p>\n<p>causing injuries.  Hence this application.<\/p>\n<p>      3.
