Pardiwala for the applicants and learned A.P.P.<br \/>\nMr.Devang Vyas for the respondent-State at length and in great<br \/>\ndetail. I have considered the role attributed to the applicants which<br \/>\nis reflected in the F.I.R. at Annexure A to the application and dying<br \/>\ndeclaration produced by the learned A.P.P. The allegations against<br \/>\nthe applicants are general in nature and they used to instigate the<br \/>\nhusband. In view of the aforesaid aspect and considering the<br \/>\nprovisions of Sections 306,498A of the Indian Penal Code and Sections<br \/>\n3 and 4 of the Dowry Prohibition Act, gravity of offence, police<br \/>\npapers and quantum of punishment etc., I am of the view that the<br \/>\napplicants deserve to be enlarged on bail.\n<\/p>\n<p>3.\tFor the foregoing<br \/>\nreasons, the application is allowed and<br \/>\nthe applicants are ordered to be enlarged on bail in connection with<br \/>\nC.R.No.I-140 of 2009 with Palanpur Taluka Police Station on executing<br \/>\na bond of Rs.10,000\/- each [Rupees ten thousand only] with one surety<br \/>\neach of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that they shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b]\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender their<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Court concerned;\n<\/p>\n<p>[e]\tmark their presence<br \/>\nat the concerned police station on any day of first week of every<br \/>\nEnglish calendar month between 9.00 AM and 2.00 PM. till the trial is<br \/>\nover;\n<\/p>\n<p>[f]\tfurnish the present<br \/>\naddress of their residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change their residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain law and<br \/>\norder.\n<\/p>\n<p>4.\tIf breach of any of<br \/>\nthe above conditions is committed, the Sessions Judge concerned will<br \/>\nbe free to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>5.\tBail bond to be<br \/>\nexecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>6.\tAt the trial, the<br \/>\nTrial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicants on bail.\n<\/p>\n<p>7.\tRule is made absolute<br \/>\nto the aforesaid extent.
