UDAYABHANU, JJ.\n\n      ==============================\n\n                    W.A.NO.2400  OF 2006\n\n        ============================\n\n\n    DATED THIS THE 9TH DAY OF JANUARY  2007\n\n\n                            JUDGMENT\n<\/pre>\n<p>Abdul Gafoor,J.\n<\/p>\n<\/p>\n<p>      Heard   counsel   for   the     appellant   and   the<\/p>\n<p>standing counsel for the Union of India.  It is the case<\/p>\n<p>of   the   appellants\/writ   petitioners                 that   the<\/p>\n<p>employment   assistance to the second   appellant,son<\/p>\n<p>of   the     deceased     driver   in   the     Army   service,   was<\/p>\n<p>rejected.  The father of the 2nd appellant  died on 3-6-<\/p>\n<p>1994 and application for employment assistance  was<\/p>\n<p>submitted on 25-12-2002.  The reasons stated for the<\/p>\n<p>delay was that the   2nd   appellant was a minor at the<\/p>\n<p>time of death of his  father.  He preferred application<\/p>\n<p>soon after he became major.   It  was  rejected on the<\/p>\n<p>ground   of     the   delay.     This   was     challenged   in   writ<\/p>\n<p>petition,   W.P.(C)NO.18609\/2004   and   this   Court<\/p>\n<p><span class=\"hidden_text\">WA.2400\/2006                          -2-<\/span><\/p>\n<p>     quashed Ext.P4 letter on the finding that there was no<\/p>\n<p>     justification     to   reject   the   application   solely   on   the<\/p>\n<p>     ground   of   delay   in   submitting   the   application   and<\/p>\n<p>     directed   the   authorities   to     consider   the   matter<\/p>\n<p>     afresh.     Thereafter   Ext.P7   order   was   passed     again<\/p>\n<p>     rejecting   the   application   on   the   ground     of   non-<\/p>\n<p>     availability   of   enough   vacancies   and   also   on   the<\/p>\n<p>     ground of delay.   The learned single Judge  has found<\/p>\n<p>     force   in   the   submission     on   behalf   of   the   appellants<\/p>\n<p>     that   the   ground   of   delay   urged   in   Ext.P7   was   not<\/p>\n<p>     justified.  The learned single Judge taking note of the<\/p>\n<p>     contents   of   Clause   (k)   in   Ext.P7   found   that     the<\/p>\n<p>     administration   was   justified   in   considering   the<\/p>\n<p>     candidates   based   on   their   turn   included   in   the   list<\/p>\n<p>     prepared by the screening  committee and that     the<\/p>\n<p>     2nd  appellant   did   not   submit   his   details   in   the<\/p>\n<p>     prescribed   DD   form,            so   that   the   screening<\/p>\n<p>     committee  could  not   consider  his   case.   The  learned<\/p>\n<p>     single   Judge   also   found   that   100%   of   vacancies<\/p>\n<p>     cannot be  reserved for compassionate  appointments<\/p>\n<p><span class=\"hidden_text\">WA.2400\/2006                           -3-<\/span><\/p>\n<p>     and administration was justified in   reserving a quota<\/p>\n<p>     and   that       already   136   candidates   were   awaiting<\/p>\n<p>     appointments   on   compassionate   grounds.     So   no<\/p>\n<p>     appointment   could     have   been   given   to   the   2nd<\/p>\n<p>     appellant.  The writ petition was dismissed.<\/p>\n<p>            Any   how   rejection   of   his     application   on   the<\/p>\n<p>     ground of delay was   earlier quashed.       Necessarily<\/p>\n<p>     he   deserves     consideration   for   appointment   on<\/p>\n<p>     compassionate grounds and his name also have to  be<\/p>\n<p>     included     in   the   list   of   the   candidates   awaiting     for<\/p>\n<p>     compassionate   appointments.     Whether   he   will     get<\/p>\n<p>     appointment    before  he completes the  age bar is a<\/p>\n<p>     matter     that   may   arise   later.   Any   how   equal<\/p>\n<p>     consideration       shall   have   to   be   shown   to   the   2nd<\/p>\n<p>     appellant as well.\n<\/p>\n<\/p>\n<p>           Accordingly,   we   are   of   the   view     that   the   2nd<\/p>\n<p>     appellant shall be allowed to submit his details in the<\/p>\n<p>     prescribed DD form referred to in  Clause (k) in Ext.P7<\/p>\n<p>     as   he   has   already   submitted   the   application<\/p>\n<p>     immediately  after he became major.   If such form is<\/p>\n<p><span class=\"hidden_text\">WA.2400\/2006                        -4-<\/span><\/p>\n<p>      furnished   within   15   days   from   today,   the   4th<\/p>\n<p>      respondent   shall   consider   those   details   and   include<\/p>\n<p>      the  name of the  2nd appellant in the list, on approval<\/p>\n<p>      by   the   screening   committee,   so   that   he   can   be<\/p>\n<p>      considered at the   appropriate turn.
