Balachandran, J.\n            --------------------------\n             W.P.(C)No.36357 of 2008 C\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Heard counsel for the petitioner\/defendant and<\/p>\n<p>the counsel for the respondent\/plaintiff.<\/p>\n<p>    2.  Petitioner, who is the defendant in O.S.No.<\/p>\n<p>280\/07 on the file of the Munsiff&#8217;s Court, Pala,<\/p>\n<p>filed I.A.No.244\/08 in the said suit to conduct an<\/p>\n<p>enquiry under Order XXXII Rule 15 CPC, as the suit<\/p>\n<p>was filed by the plaintiff represented by his wife<\/p>\n<p>as the next friend and guardian.   Counsel on both<\/p>\n<p>sides  submit   that  inquisition   had  not   been<\/p>\n<p>conducted  by  the  court  below   before  granting<\/p>\n<p>permission to the guardian to conduct the suit on<\/p>\n<p>behalf of the respondent\/plaintiff.     When it is<\/p>\n<p>vehemently  argued   by   the   counsel   for   the<\/p>\n<p>petitioner\/defendant that the respondent\/plaintiff<\/p>\n<p>is not one who is not capable of understanding<\/p>\n<p>things  and  managing  his  own   affairs  left  to<\/p>\n<p>himself, the court has a duty to ascertain by<\/p>\n<p>conducting an inquisition of the plaintiff and<\/p>\n<p><span class=\"hidden_text\">WPC 36357\/08               2<\/span><\/p>\n<p>satisfy itself as to whether the plaintiff is a<\/p>\n<p>person      who  is   competent   and   capable    of<\/p>\n<p>understanding things and managing his own affairs.<\/p>\n<p>For the purpose, the court should have conducted an<\/p>\n<p>inquisition    by  questioning   the  plaintiff   and<\/p>\n<p>ascertained    his  mental  capability.  Such  course<\/p>\n<p>having not been adopted at the stage of appointing<\/p>\n<p>his wife as the guardian, I direct the court below<\/p>\n<p>to conduct a proper inquisition to get satisfied as<\/p>\n<p>regards the mental condition of the respondent\/<\/p>\n<p>plaintiff. If the court finds that the plaintiff is<\/p>\n<p>competent to manage his own affairs and understands<\/p>\n<p>things as an ordinary prudent man, the court shall<\/p>\n<p>remove the guardian and direct the suit being<\/p>\n<p>prosecuted by the plaintiff himself.       If it is<\/p>\n<p>otherwise and the court is satisfied that the<\/p>\n<p>plaintiff    is  not  capable  of  managing  his  own<\/p>\n<p>affairs, the order permitting him to be represented<\/p>\n<p>by his wife as the next friend and guardian shall<\/p>\n<p>continue     to be  in   force.    Counsel  for   the<\/p>\n<p><span class=\"hidden_text\">WPC 36357\/08              3<\/span><\/p>\n<p>petitioner is directed to produce a copy of this<\/p>\n<p>judgment in the court below forthwith to enable the<\/p>\n<p>court below to act as per the directions given<\/p>\n<p>above.\n<\/p>\n<p>     The writ petition is disposed of with the above<\/p>\n<p>directions.
