Justice V.GIRI\n\n Dated :25\/09\/2009\n\n O R D E R\n                           V.GIRI, J\n                         -------------------\n                      W.P.(C).26901\/2009\n                        --------------------\n          Dated this the 25th day of September, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>      Petitioners have acquired Diploma in Homeopathic<\/p>\n<p>Medicines    and   Surgery     conducted by the         Board of<\/p>\n<p>Examinations in Homeopathy, Government of Kerala. This is<\/p>\n<p>evidenced by Exts.P1 and P2.            Petitioners are registered<\/p>\n<p>under the Travancore Cochin Medical Practitioners Act, 1953,<\/p>\n<p>as evidenced by Exts.P3 and P4. The qualifications acquired<\/p>\n<p>by the petitioners are included in the 2nd schedule of the<\/p>\n<p>Homeopathic Central Council Act, 1973 and are therefore,<\/p>\n<p>recognized diplomas.\n<\/p>\n<\/p>\n<p>2.    The State Mission Director of the National Rural Health<\/p>\n<p>Mission issued Ext.P5 notification inviting Homoeo and<\/p>\n<p>Ayurvedic Medical Graduates for appointment in different<\/p>\n<p>districts under the NRHM, on contract basis. It seems that<\/p>\n<p>initially certain diploma holders were also included in the<\/p>\n<p>rank list that was prepared, but later, on a complaint that<\/p>\n<p>applications were invited from Homeo and Ayurvedic Medical<\/p>\n<p>graduates and not from diploma holders, a verification was<\/p>\n<p>done and non graduates were excluded from the list. It seems<\/p>\n<p>W.P.(C).26901\/2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>that the petitioners also were therefore, excluded from the<\/p>\n<p>list. Petitioners contend that this process of verification was<\/p>\n<p>undertaken with reference to Ext.P8       Government Order<\/p>\n<p>dated 22.4.1995 wherein considering the recommendations of<\/p>\n<p>the Central Council of Homeopathy, Government of Kerala<\/p>\n<p>had ordered that medical qualifications in Homeopathy,<\/p>\n<p>acquired after undergoing a course of four years&#8217; duration,<\/p>\n<p>awarded prior to the enforcement of Homeopathy (Diploma<\/p>\n<p>Course) Regulations 1983, and included in the 2nd schedule of<\/p>\n<p>the Homeopathic Central Council Act, will be treated as<\/p>\n<p>equivalent to the degree in Homeopathy. Petitioners contend<\/p>\n<p>that Ext.P8 is illegal inasmuch as the Government has<\/p>\n<p>declared only such qualifications acquired prior to the<\/p>\n<p>enforcement of the 1983       Regulations as equivalent to a<\/p>\n<p>Degree.       Petitioners contend that similar qualifications<\/p>\n<p>acquired even after 1983, should be treated as equivalent to<\/p>\n<p>the same. Hence the challenge against Ext.P8 on the ground<\/p>\n<p>that it results in discrimination among similarly situated<\/p>\n<p>persons. There is also a prayer for a direction to the NRHM<\/p>\n<p>to consequently consider the petitioners also, as possessing<\/p>\n<p>qualification equivalent to a Degree in Homeopathy and<\/p>\n<p>include them in the list of Homeopathic Medical graduates<\/p>\n<p>W.P.(C).26901\/2009<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>for appointment to different posts under the NRHM.<\/p>\n<p>3.    I    heard    learned   counsel    for  the     petitioners<\/p>\n<p>Mr.Jayakumar, learned counsel for the NRHM Mr.M.Ajay and<\/p>\n<p>learned Government Pleader.\n<\/p>\n<\/p>\n<p>4.    The challenge against Ext.P8 is misconceived, in my<\/p>\n<p>view. It is in fact by Ext.P8 order, Government has declared<\/p>\n<p>certain non degree qualifications as equivalent to that of a<\/p>\n<p>Degree in Homeopathy, provided such qualifications were<\/p>\n<p>acquired       prior to the enforcement of           the Central<\/p>\n<p>Regulations, 1983.       Government had passed this order<\/p>\n<p>accepting the recommendations of the Central Council of<\/p>\n<p>Homeopathy. The order has not resulted in any unreasonable<\/p>\n<p>classification among similarly situated persons.           If the<\/p>\n<p>petitioners also pray for a similar treatment, it is upto them to<\/p>\n<p>see that the Central Council of Homeopathy makes a similar<\/p>\n<p>recommendation.       Government of Kerala had only accepted<\/p>\n<p>the recommendations of the Central Council. The order only<\/p>\n<p>grants a benefit to a certain class of people who otherwise<\/p>\n<p>may not have been able to claim that their qualification should<\/p>\n<p>be treated as equivalent to a Degree in Homeopathy.<\/p>\n<p>W.P.(C).26901\/2009<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>5.    Even otherwise the NRHM is entitled to stipulate that<\/p>\n<p>they need only graduates in Homeopathy and Ayurveda in<\/p>\n<p>different posts. They are always entitled      to    insist that<\/p>\n<p>persons with qualifications which might be treated as<\/p>\n<p>equivalent by the Government or the PSC are not acceptable<\/p>\n<p>and that only graduates be considered for appointment. The<\/p>\n<p>challenge against Ext.P8 is therefore, misconceived in the<\/p>\n<p>context of considering the prayer for a direction to the NRHM<\/p>\n<p>to consider the petitioners also.    If the NRHM insists on<\/p>\n<p>degree holders, then they are entitled to see that only degree<\/p>\n<p>holders should be appointed to posts forming part of the<\/p>\n<p>National Rural Health Mission.\n<\/p>\n<\/p>\n<p>      For all these reasons,     I  find no merit in the writ<\/p>\n<p>petition.
