No. 1762 of 2010\n                  ------------------------------------------\n              Dated this the 4th day of November, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>J.Chelameswar, C.J.\n<\/p>\n<p>            The respondent in W.P.(C) No.22338 of 2010 is the<\/p>\n<p>appellant herein, aggrieved by the judgment dated 7th September,<\/p>\n<p>2010. The sole respondent herein preferred the above mentioned<\/p>\n<p>writ petition.\n<\/p>\n<p>            2. The respondent herein had earlier approached      this<\/p>\n<p>Court by way of W.P.(C) No.15214 of 2010 with a grievance that an<\/p>\n<p>application filed by him seeking a building permit under the<\/p>\n<p>provisions of the Kerala Municipality Building Rules, 1999 was not<\/p>\n<p>being considered by the appellant herein and therefore sought a<\/p>\n<p>direction to the appellant herein to consider his application in<\/p>\n<p>accordance with law.\n<\/p>\n<p>            3. Inspite of service of notice, the appellant herein did<\/p>\n<p>not choose to appear and contest the matter. The matter had to be<\/p>\n<p>W.A.No.1762 of 2010\n<\/p>\n<p>                               &#8211; 2 &#8211;\n<\/p>\n<p>decided by this Court eventually ex parte against the appellant<\/p>\n<p>on the basis of the materials and averments placed before this<\/p>\n<p>Court by the writ petitioner\/respondent herein. The respondent<\/p>\n<p>herein, it appears, submitted before this Court that his<\/p>\n<p>application for building permit is not being finalized on the<\/p>\n<p>ground that the predecessor in title of the respondent was<\/p>\n<p>required under law to relinquish the right, title and interest in a<\/p>\n<p>certain property belonging to him and in view of such non-<\/p>\n<p>relinquishment the application of the respondent herein was not<\/p>\n<p>being considered.    In the absence of any rebuttal to the said<\/p>\n<p>statement the Court accepted the said statement and directed the<\/p>\n<p>appellant herein to consider the application of the respondent<\/p>\n<p>herein without reference to the relinquishment referred to above.<\/p>\n<p>            4.    The appellant herein subsequently moved a<\/p>\n<p>review petition in      W.P.(C) No.15214 of 2010            being<\/p>\n<p>R.P.No.580 of 2010. The said review petition was disposed of.<\/p>\n<p>Unfortunately, a copy of the order passed in the said review<\/p>\n<p>W.A.No.1762 of 2010\n<\/p>\n<p>                                  &#8211; 3 &#8211;\n<\/p>\n<p>petition is not made available to us.      But, from the judgment<\/p>\n<p>under appeal it appears that the appellant only sought in the<\/p>\n<p>review petition for deletion of the second paragraph of the<\/p>\n<p>judgment wherein it was recorded that inspite of service of<\/p>\n<p>notice the Panchayat had not entered appearance.       It does not<\/p>\n<p>appear from the materials on record that the appellant herein<\/p>\n<p>ever contended in the review petition that the application of the<\/p>\n<p>respondent herein cannot be considered in view of the fact that<\/p>\n<p>there was no approved lay-out in existence covering the area<\/p>\n<p>where the respondent proposes to construct the building.        If<\/p>\n<p>only the appellant had taken such a ground and invited decision<\/p>\n<p>on the issue, it is known as to what would have been the result<\/p>\n<p>of the earlier writ petition, i.e. W.P.(C) No.15214 of 2010. The<\/p>\n<p>appellant accepted the finality of the said judgment and now<\/p>\n<p>rejected the application of the respondent by the order impugned<\/p>\n<p>in W.P.(C) No.22338 of 2010 on the ground that there was no<\/p>\n<p>approved lay-out for the area wherein the respondent seeks to<\/p>\n<p>W.A.No.1762 of 2010\n<\/p>\n<p>                                     &#8211; 4 &#8211;\n<\/p>\n<p>construct a building.\n<\/p>\n<p>            5. By the judgment under appeal the learned Judge<\/p>\n<p>held as follows:\n<\/p>\n<blockquote><p>                   &#8220;So long as Ext.P2 judgment stands, the Panchayat<\/p>\n<p>           cannot be heard to contend that unless the lay out of the<\/p>\n<p>           internal roads, which provide access to the petitioner&#8217;s land<\/p>\n<p>           wherein he proposes to construct the building, is approved,<\/p>\n<p>           a building permit cannot be issued. In such circumstances I<\/p>\n<p>           am constrained to hold that Ext.P4 order passed by the<\/p>\n<p>           Secretary of the respondent Grama Panchayat is one which<\/p>\n<p>           is really in contempt of this Court.&#8221;<\/p><\/blockquote>\n<p>            6.    Though not expressly, the leaned Judge in<\/p>\n<p>substance held that the appellant herein is barred by the doctrine<\/p>\n<p>of constructive res judicata or a principle akin to it from raising<\/p>\n<p>such a contention as it was not their case in the earlier round of<\/p>\n<p>litigation between the appellant and the respondent. We do not<\/p>\n<p>see any reason to interfere with the conclusion reached by the<\/p>\n<p>learned Judge. On the other hand, we are of the opinion that the<\/p>\n<p>appellant is guilty of callousness and negligence in the conduct<\/p>\n<p>of litigation and the present appeal is a sheer abuse of the<\/p>\n<p>W.A.No.1762 of 2010\n<\/p>\n<p>                            &#8211; 5 &#8211;\n<\/p>\n<p>process of the Court.
