Sharma, AGP for Respondent(s)\n: 1, \nNOTICE SERVED for Respondent(s) : 2 - 3. \nNOTICE SERVED BY\nDS for Respondent(s) : 2 - 3. \nMR BS PATEL for Respondent(s) :\n4, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocate Mr. Paresh Upadhyay for petitioners and learned<br \/>\n\tAdvocate Mr. BS Patel for respondent no.4 as well as Mr. Anand L.<br \/>\n\tSharma, learned AGP for respondent NO.1,2 and 3.\n<\/p>\n<p>In<br \/>\n\tpara 7A, petitioners are praying to direct respondent authorities of<br \/>\n\tGovernment to accord approval for revision of pay of petitioners on<br \/>\n\tthe lines of recommendations made by 6th Pay Commission<br \/>\n\tas adopted by Government for all Government employees with effect<br \/>\n\tfrom 1.1.2006 within time period which this Court may consider just<br \/>\n\tand proper in facts and circumstances of case   and also to direct<br \/>\n\trespondent authorities to revise pay of petitioners accordingly and<br \/>\n\talso pay arrears flowing from prayer clause A.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Paresh Upadhyay appearing for petitioners in this group<br \/>\n\tof petitions has submitted that respondent no.4 has received one<br \/>\n\treply dated 19th November, 2010 from respondent NO.2  in<br \/>\n\trespect to prayers made by petitioners in present petitions. He<br \/>\n\tsubmitted that according to aforesaid reply page 24 Annexure J,<br \/>\n\tChairman\/Secretary, APMC, Rajkot has been informed by respondent<br \/>\n\tno.2 that the demand made by petitioners claiming benefit as per<br \/>\n\trecommendations made by 6th Pay Commission at par with<br \/>\n\tGovernment employees is under consideration of State Government but<br \/>\n\tso long approval is not given by State Government, such benefit<br \/>\n\tcannot be made available to petitioners by respondent no.4.Proposal<br \/>\n\thas been made by respondent NO.4 on 26.10.2010 as mentioned at<br \/>\n\tAnnexure J page 24 against which aforesaid reply is given by<br \/>\n\trespondent no.2 that proposal made by respondent no.4 is pending<br \/>\n\tunder consideration with State Government looking to averments made<br \/>\n\tin aforesaid reply. Therefore, in interest of justice, it is<br \/>\n\tdirected to respondent no.1 to consider resolution No.21 passed by<br \/>\n\trespondent no.4 in General Board Meeting dated 13.5.2009 which is at<br \/>\n\tpage 13 Annexure B and also examine detail which has been supplied<br \/>\n\tby respondent no.4 at page 16 Annexure E and page 20 Annexure H<br \/>\n\tdated 2nd November, 2010 and, thereafter, consider one<br \/>\n\tfact that at present, petitioners are getting pay scale on the basis<br \/>\n\tof recommendations made by 5th Pay Commission at par with<br \/>\n\tother Government employees and then to pass appropriate reasoned<br \/>\n\torder in accordance with policy of Government as early as possible<br \/>\n\twithin period of three months from date of receiving copy of present<br \/>\n\torder and communicate decision to present petitioners as well as<br \/>\n\trespondent no.4. Respondent NO.1 is also directed to consider that<br \/>\n\trespondent No.4 is not receiving any grant from State Government for<br \/>\n\tmanaging its affairs.
