Civil Application No.527\/2010 and to<br \/>\nrestore the same on file.\n<\/p>\n<p>2.\tBefore<br \/>\nthis Court looks into the relief claimed by the applicant, it would<br \/>\nbe pertinent to refer to the observations made by this Court in<br \/>\nPara-5 of the order dated 26.02.2009 passed in the captioned<br \/>\npetition, which reads as under;\n<\/p>\n<p>\t 5.\tHaving heard learned<br \/>\n\tadvocates appearing for the parties for the purpose of considering<br \/>\n\tad-interim relief, the Court is of the view that the order is passed<br \/>\n\tby the Court on 05.02.2009. 15 days time is granted to the Gujarat<br \/>\n\tMaritime Board to effect the transfer in favour of the petitioner.<br \/>\n\tThe said period is over. Yet, nothing has happened in the matter.<br \/>\n\tThere is no stay against the order passed by this Court till this<br \/>\n\tdate. In the above view of the matter, Gujarat Maritime Board cannot<br \/>\n\trefuse the transfer in favour of the petitioner nor it can refuse<br \/>\n\tbeaching permission to the petitioner. In any case, the policy of<br \/>\n\tthe Gujarat Maritime Board as contained in the notification dated<br \/>\n\t30.09.2006 says that if the permission holder allows to beach the<br \/>\n\tvessel not belonging to him for breaking without the prior<br \/>\n\tpermission of the Gujarat Maritime Board on the plot for which<br \/>\n\tpermission is given to him, the permission to utilise the plot for<br \/>\n\tbreaking the vessel shall be liable to be cancelled. However, the<br \/>\n\tGujarat Maritime Board may grant permission to beach such vessel as<br \/>\n\tits own discretion, subject to condition that there is no<br \/>\n\toutstanding of any dues by the  permission holder  as well as<br \/>\n\tthe vessel owner to the Board in respect of the plot on which vessel<br \/>\n\tis to be beached and the party to whom vessel belongs.  The fees<br \/>\n\tto be charged for permission to beach the vessel in such case shall<br \/>\n\tbe Rs.10 Lacs.\n<\/p>\n<p>3.\tPursuant to the passing<br \/>\nof the above order, the opponent-Board filed M.C.A. No. 527\/2010<br \/>\npraying to remit the said amount of Rs.10,00,000\/- deposited by the<br \/>\napplicant mainly on the ground that by way of order dated 26.02.2009<br \/>\n(as referred to herein above) provisional beaching permission was<br \/>\ngranted to the applicant subject to the condition that the applicant<br \/>\ndeposits an amount of Rs.10,00,000\/- with the Registry of this Court<br \/>\nand that the said order has merged with the main challenge in L.P.A.<br \/>\nNos.205\/2009 &amp; 217\/2009.\n<\/p>\n<p>4.\tIn the meanwhile, the<br \/>\nopponent-Board had L.P.A. No.205\/2009 challenging the order passed in<br \/>\nS.C.A. No.11766\/2008 dated 05.02.2009, whereby, the opponent-Board<br \/>\nhad been directed to transfer the plot in question in favour of the<br \/>\napplicant herein. The opponent-Board had also challenged the order<br \/>\ndated 26.02.2009 passed in the captioned petition by way of filing<br \/>\nL.P.A. No. 217\/2009. Both the appeals came to be disposed of vide<br \/>\norder dated 02.11.2009, which reads as under;\n<\/p>\n<p>\t Heard learned counsel<br \/>\nfor either side.\n<\/p>\n<p>\tWhen the matter came for<br \/>\nhearing earlier, we have suggested that considering the peculiar<br \/>\nfacts and circumstances of the case, it will be appropriate that<br \/>\nGujarat Maritime Board may consider the request of the 1st<br \/>\nRespondent-Western Shipbreaking Corporation in Letters Patent Appeal<br \/>\nNo. 205 of 2009 to transfer the permission to utilize the<br \/>\nShipbreaking Plot No.61 in favour of  M\/s. N.B.M. Iron and Steel<br \/>\nTrading Private Limited. Such a suggestion was made as it was pointed<br \/>\nout that  M\/s. N.B.M. Iron and Steel Trading Private Limited had<br \/>\ndischarged huge liabilities of the 1st Respondent-Western<br \/>\nShipbreaking Corporation and also settled the liabilities of the 1st<br \/>\nRespondent-Western Shipbreaking Corporation with Bank of Baroda as<br \/>\nwell.   Considering these facts, it will be in the interest of<br \/>\njustice that the request of 1st Respondent to transfer the<br \/>\nShipbreaking Plot No.61 in favour of  M\/s. N.B.M. Iron and Steel<br \/>\nTrading Private Limited be considered.\n<\/p>\n<p>\tMr. Kamal Trivedi, learned<br \/>\nSenior Advocate appearing for the Gujarat Maritime Board, has<br \/>\nsubmitted that they will consider the request made by the 1st<br \/>\nRespondent-Western Shipbreaking Corporation favourably, provided the<br \/>\ntransferor and the transferee comply with all relevant Rules and<br \/>\nRegulations of the Board, and this cannot be treated as a precedent,<br \/>\nsince the Board has to urge various legal contentions. Therefore, in<br \/>\nthe peculiar facts and circumstances of the case, all the legal<br \/>\ncontentions raised by the learned counsel of either side be kept<br \/>\nopen.\n<\/p>\n<p>\tConsidering the assurance<br \/>\ngiven by the Gujarat Maritime Board, learned counsel appearing for<br \/>\nthe petitioner- M\/s. N.B.M. Iron and Steel Trading Private Limited in<br \/>\nS.C.A. No. 1674 of 2009 submitted that he would withdraw the<br \/>\npetition. Accordingly, Special Civil Application No. 1674 of 2009<br \/>\nstands disposed of as withdrawn.\n<\/p>\n<p>\t Under the<br \/>\ncircumstances, judgment of the learned Single Judge rendered in<br \/>\nS.C.A. No. 11766 of 2008 is set aside with a direction to the Gujarat<br \/>\nMaritime Board to consider the request made by the 1 st<br \/>\nRespondent-Western Shipbreaking Corporation to transfer the<br \/>\npermission to utilize Shipbreaking Plot No.61 in favour of  M\/s.<br \/>\nN.B.M. Iron and Steel Trading Private Limited, provided they comply<br \/>\nwith all relevant  Rules  and Regulations<br \/>\nof the Board.\n<\/p>\n<p>\tLetters Patent Appeals and<br \/>\nCivil Applications stand disposed of accordingly.\n<\/p>\n<p>5.\tThe main contention<br \/>\nraised on behalf of the applicant is that this Court had no<br \/>\njurisdiction to entertain the captioned Misc. Civil Application filed<br \/>\nby the opponent-Board in view of the order passed by the Division<br \/>\nBench on 02.11.2009, as reproduced herein above and that for seeking<br \/>\nbeaching permission, the opponent-Board was not justified in charging<br \/>\nRs.10,00,000\/- from the applicant.\n<\/p>\n<p>6.\tHowever, this Court is<br \/>\nnot impressed by the said contentions raised by the applicant<br \/>\ninasmuch as the said amount of Rs.10,00,000\/- deposited by the<br \/>\napplicant was for the purpose of seeking permission from the<br \/>\nopponent-Board for beaching. In the order dated 26.02.2009, it has<br \/>\nbeen stated in no uncertain terms that the<br \/>\nfees to be charged for permission to beach vessel shall be<br \/>\nRs.10,00,000\/- since, evidently, the applicant was not a  permission<br \/>\nholder  at the relevant time. Therefore, the said amount of<br \/>\nRs.10,00,000\/- paid by the applicant was the fees for beaching<br \/>\npermission and was not the amount deposited by the applicant for the<br \/>\npurpose of showing its bona fide, as has been contented by the<br \/>\napplicant. Apart from that in the order dated 02.11.2009, the<br \/>\nDivision Bench has set aside only the judgment rendered in S.C.A.<br \/>\nNo.11766\/2008 and has issued direction to the opponent-Board to<br \/>\nconsider the request of transfer of the plot in question in favour of<br \/>\nthe applicant. The direction qua charging Rs.10,00,000\/- as fees for<br \/>\nbeaching permission has not been disturbed by the Division Bench and<br \/>\nhas merged with the final order dated 02.11.2009. However, an attempt<br \/>\nhas been made by the applicant to show that the opponent-Board is not<br \/>\nhaving any authority to charge any fees from a party concerned, for<br \/>\ngranting beaching permission, by drawing attention of the Court to<br \/>\nthe relevant Regulations of the opponent-Board. Since the said issue<br \/>\nis not a subject matter in the present proceedings, I do not want to<br \/>\nmake any observations on it.\n<\/p>\n<p>7.\tIn view of the above<br \/>\nfactual scenario, it is not open to the applicant to seek withdrawal<br \/>\nof the said amount, particularly when, the applicant has taken<br \/>\nbenefit of beaching permission granted to it in pursuance of the<br \/>\norder dated 26.02.2009. Hence, the application deserves to be<br \/>\nrejected.\n<\/p>\n<p>8.\tFor the foregoing<br \/>\nreasons, the application is dismissed. No costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
