\n23.9.19\u00a3’3′}u  Tribunal, Anekal, which<\/p>\n
was chaiiengedvAinthedwrit petition and the RTC register<\/p>\n
  by.__the ‘parties couid not be relied upon to<\/p>\n
1   as the RTC shows two different entries<\/p>\n
 1 in two different documents, which are issued by the<\/p>\n
Joffice of” the revenue authority. Respondent No.5<\/p>\n
 t._a;;V)peared before the Tribunal and gave a, statement<\/p>\n
 “recognizing grant of occupancy rights and this Court<\/p>\n
Cannot interfere with the order passed by the Tribunal<\/p>\n
on 23.9.i98i in the writ petition, which was \ufb01led after<\/p>\n
twenty five years from the date of passing of the orders<\/p>\n

  ordet:._ppasscd.f~by the Tribunal is liable to be set aside.<\/p>\n

  appearing for the parties by order dated<\/p>\n

an affidavit consenting the grant of occupancy right in<\/p>\n
favour of the tenant. There was no material to show<\/p>\n
that it was not joint family property and thereforedno<\/p>\n
ground is made out to interfere with the  _<\/p>\n

3. We have heard the lpealriaedi__co1insel_appearing
\nfor the appellant.\n<\/p>\n
4. The learned counsel:atpp.e’aring  the appellant<\/p>\n

lllt\ufb02istrict granted as per Section 10 of the<\/p>\n
Mysore {13ers’onal and Miscellaneous) Inains Abolition<\/p>\n
 l9z54L:was a joint family property and respondent<\/p>\n
  could not have consented on behalf of other<\/p>\n
 members of the joint family and since all the members<\/p>\n
3′ of the joint family including the petitioners were not<\/p>\n
noti\ufb01ed, the order passed by the Land Tribunal is illegal<\/p>\n

contentions he relies upon the case of Anjanappd’…as.,<\/p>\n

\nrespondents that the order passed by<\/p>\n
the learnedfiinglle  justified and he has made<\/p>\n

was the  owner of the property and also made a<\/p>\n

  produced to show that the property was joint family<\/p>\n

6. At this stage we have given careful<\/p>\n
consideration to the contentions of the learned <\/p>\n
appearing for the parties and scrutinized   ~<\/p>\n

7. On scrutinizing the :’nat_erial’0n record;.ii.t.,_Vc’o1;ild<\/p>\n
be seen that respondent No.5 vvas:_arrayed  owner
\nof the land in the applicat.iyonp  respondent-
\ntenant before thP”TTlbuI1’al’   resgoondents 1(A] to
\nMD] are LRs.–al;:14dhva:s__sitated that  is the absolute
\nowner  oli’B:iiigi’p’ura and the names of the<\/p>\n
applicant i”s,__’enter’e_dlin”  cultivation column. In the<\/p>\n
 case. the sarr1’e-,dt_h_eA.land Tribunal has proceeded to<\/p>\n
 ..tuhe’o:eCu_pancy right and Form No.30 by order<\/p>\n
 The RTCs produced would show that<\/p>\n
the entries Inade are in favour of both the parties in two<\/p>\n
  “RTC produced and there is no material to<\/p>\n
 ____”‘l’.’substantiate the contention that the property belongs to<\/p>\n
\ufb02joint family. It is clear in absence of any Conclusive<\/p>\n
material to show that the affidavit filed by respondent<\/p>\n
No.5 before the Tribunal after he was served notice and<\/p>\n

the application filed by Byanna was false and the<\/p>\n
property in which occupancy right was claimed___ in<\/p>\n
respect of Sy.No.9\/ I measuring 3 acres 33 guntasj<\/p>\n
joint family property.\n<\/p>\n
8. The question of issuing <\/p>\n
members of the joint family__ would’ not.V\u00bb’aris:e. <\/p>\n
admittedly it is clear from the._:originaI- records that
\nrespondent No.5 is array_e:d_a.s has appeared
\nbefore the Tribunal claimi\u00abngf-theoccupancy’ right in his<\/p>\n
favour.\n<\/p>\n
9.  View  laches in filing the writ<\/p>\n
petition which vtrvasiifiled the year 2007 challenging the<\/p>\n
 “(m1\u00a2rfii–\u00a7{f  ‘l’:ibunaimdlated 23.9.1981 the learned Single<\/p>\n
 to interfere with the order dated<\/p>\n
  23.9.’1__98 lv;’:Xccordingly, We hold that the order passed<\/p>\n
if  the fribunal is justified and does not suffer from any<\/p>\n
 .error-or illegality as to call for interference, in exercise of<\/p>\n
if  ‘ Wri-‘t jurisdiction of this Court.<\/p>\n
Accordingly. appeal is dismissed.<\/p>\n
