No one appears on behalf of the<\/p>\n<p>                     State.\n<\/p>\n<p>                                  The     prayer       of     the    petitioner            for<\/p>\n<p>                     bail    was    earlier          rejected        by       order    dated<\/p>\n<p>                     16.10.2009 in Cr. Misc. No. 32018 of 2009<\/p>\n<p>                     wherein       the    trial        court       was        directed         to<\/p>\n<p>                     expedite       the       trial    and     complete          the      same<\/p>\n<p>                     within a period of nine months.<\/p>\n<p>                                  When this bail application was filed<\/p>\n<p>                     on    10.3.2011,         even     after       the        expiry      of   a<\/p>\n<p>                     period of much more than nine months, with a<\/p>\n<p>                     grievance that the trial of the petitioner<\/p>\n<p>                     has    not    yet    been        taken    up,        a    report      was<\/p>\n<p>                     called       for    from    the        trial    court.          In    the<\/p>\n<p>                     resultant report dated 20.5.2011, it has been<\/p>\n<p>                     stated by the trial court that the charges<\/p>\n<p>                     were     framed          against        the      petitioner               on<\/p>\n<p>                     27.4.2011          and     thereafter,          not         a     single<\/p>\n<p>                     witness has appeared till date.<\/p>\n<p>                               Considering               the             aforementioned<\/p>\n<p>                     aspects        and        taking         into        account          the<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>      petitioner is in custody for more than three<\/p>\n<p>      and half years, this Court would direct for<\/p>\n<p>      release    of    the        petitioner,            namely,         Ramjee<\/p>\n<p>      Manjhi on bail on furnishing bail bond of Rs.<\/p>\n<p>      10,000\/- (ten thousand) with two sureties of<\/p>\n<p>      the like amount each to the satisfaction of<\/p>\n<p>      Additional Sessions Judge, F.T.C. Vth, Gaya<\/p>\n<p>      in connection with Sessions Trial No. 202 of<\/p>\n<p>      2010 \/ 735 of 2011 arising out of Wazirganj<\/p>\n<p>      P.S. Case No. 75 of 2007, subject to the<\/p>\n<p>      following conditions:-\n<\/p>\n<blockquote><p>                            (i) The two bail bonds will be<br \/>\n                furnished,             one     by        the    Government<br \/>\n                servant          and    the        other       by    a    close<br \/>\n                family relative.\n<\/p><\/blockquote>\n<blockquote><p>                             (ii)            The     petitioner            will<br \/>\n                remain present in course of trial on<br \/>\n                each and every day and his absence<br \/>\n                even        for         a     single           day        would<br \/>\n                automatically entail the consequences<br \/>\n                of cancellation of his bail.\n<\/p><\/blockquote>\n<blockquote><p>                            (iii) The petitioner in case<br \/>\n                is    now        made       accused       in    any       other<br \/>\n                criminal case, that would itself lead<br \/>\n                to cancellation of his bail.<\/p><\/blockquote>\n<p>                 Subject           to         the         aforementioned<\/p>\n<p>      conditions,          the     prayer          for     bail      of     the<\/p>\n<p>      petitioner is allowed.\n<\/p>\n<\/p>\n<p>                                              (Mihir Kumar Jha, J.)<br \/>\nRsh\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramjee Manjhi vs The State Of Bihar on 5 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
