Sinha, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tThis appeal is directed against a judgment and order of a Division<br \/>\nBench of Delhi High Court dated 7.9.2005 passed in LPA No.404 of 2003.\n<\/p>\n<p>3.\tAppellant is a society registered under the Societies Registration Act.<br \/>\nIt runs an educational institution.  It applied for allotment of four acres of<br \/>\nland for running a senior secondary school before the Delhi Development<br \/>\nAuthority.  The Institutional Allotment Committee which was constituted by<br \/>\nthe Authority, made recommendations for allotment of four acres of land.<br \/>\nIndisputably the competent authority of the DDA took a policy decision only<br \/>\nto allot two acres of land.\n<\/p>\n<p>4.\tSeveral writ petitions were filed which by reason of the impugned<br \/>\njudgment have been dismissed by a Division Bench of the Delhi High Court.<br \/>\nBefore embarking on the questions raised before us, we may place on record<br \/>\nthat except the present appeal, other appeals were heard and dismissed by a<br \/>\nDivision Bench of this Court (Coram  Hon. B.P. Singh and P.K.<br \/>\nBalasubramanyam, JJ).  The said order, however, is not a reasoned one.\n<\/p>\n<p>5.\tMr. K.K. Rai, learned senior counsel appearing on behalf of appellant,<br \/>\nsubmitted that the factual scenario obtaining in the present appeal is different<br \/>\nfrom the others, inasmuch as recommendations of allotment of four acres of<br \/>\nland were made both in its favour as also in favour of one Shri<br \/>\nVenkateshwara Educational Society; but whereas in the case of the latter<br \/>\nsociety four acres of land was directed to be allotted; the appellant was<br \/>\ndenied of a similar grant.\n<\/p>\n<p>\tThe High Court, learned counsel argued, misdirected itself in passing<br \/>\nthe impugned judgment in so far as it failed to take into consideration that<br \/>\nthe said Shri Venkateshwara Educational Society was not a necessary party<br \/>\nin the writ petition as no relief was claimed against it, inasmuch as if the writ<br \/>\npetition were to be allowed, the said society would not have suffered any<br \/>\nprejudice.\n<\/p>\n<p>6.\tMr. V.B. Saharya, learned counsel appearing on behalf of the<br \/>\nrespondent, on the other hand, supported the impugned judgment.\n<\/p>\n<p>7.\tThe question which arose for consideration before the High Court was<br \/>\nas to whether the Delhi Master Plan having provided for allotment of four<br \/>\nacres of land for running of a secondary school, the Delhi Development<br \/>\nAuthority could take a policy decision of allotment only  of two acres of<br \/>\nland.\n<\/p>\n<p>8.\tWe have noticed hereinbefore that a large number of societies applied<br \/>\nfor allotment of land for setting up senior secondary schools.  A<br \/>\nrecommendation had been made in favour of the apellant by the Institutional<br \/>\nAllotment Committee on or about 23.10.1998.  Indisputably, similar<br \/>\nrecommendations had been made in favour of other societies as well,<br \/>\nincluding the said Shri Venkateshwara Educational Society.<br \/>\nRecommendations of the Committee, however, do not appear to have been<br \/>\napproved by the authority.  It furthermore appears that the appellant was<br \/>\nasked to send its latest bank balance certificate and\/or financial status.\n<\/p>\n<p>9.\tThe Lt. Governor, who is Chairman of the Society, had also asked for<br \/>\ncertain clarifications pertaining to constructions of the school building.  On<br \/>\nor about 9.3.2000, a provisional allotment was made but, allegedly, the<br \/>\nappellant society failed to furnish an undertaking within the period stipulated<br \/>\ntherefor.\n<\/p>\n<p>10.\tIndisputably, the Vice Chairman of the Delhi Development Authority<br \/>\nmade recommendations for allotment of only two acres of land in favour of<br \/>\nthe appellant.  Shri Venkateshwara Educational Society, however, was<br \/>\nallotted a land measuring four acres of land way back on 25.8.1999.\n<\/p>\n<p>11.\tThe policy decision of the Authority which was impugned in the writ<br \/>\npetition was taken in October 1999.  It has not been shown before us that<br \/>\nany allotment has been made in favour of any society allotting land having<br \/>\nan area of four acres, after October 1999.\n<\/p>\n<p>12.\tWe may furthermore notice that the plea of discrimination raised in<br \/>\nthe writ petition was absolutely vague as it was merely averred :<br \/>\nThe petitioner also wrote to Respondent No.1 on<br \/>\n24.03.2000 requesting for allotment of 1.6 hectares<br \/>\nof land at the prevailing rate of Rs.30 lakhs per<br \/>\nacre in 1996 when the application for land was<br \/>\nmade and other similarly situated institutions were<br \/>\nallotted land&#8230;<\/p>\n<p>13.\tGrounds taken in the writ petition in this behalf also did not specify<br \/>\nthat the appellant had been discriminated against, vis-`-vis the said Shri<br \/>\nVenkateshwara  Education Society or any other allottee.  Details of the grant<br \/>\nin favour of the said society was not furnished.  In absence of any specific<br \/>\ncontention having been raised, it was not possible for the respondent to<br \/>\nfurnish any reply thereto.\n<\/p>\n<p>14.\tNo argument also appears to have been advanced in this behalf before<br \/>\nthe learned Single Judge.  The memo of appeal of the appellant was not<br \/>\nsupported by any affidavit affirmed either by one of its authorized<br \/>\nrepresentatives who was present in court or by the advocate appearing on its<br \/>\nbehalf, stating that the contention in regard to the discriminatory treatment<br \/>\nwas raised before the learned Single Judge but was not dealt with.\n<\/p>\n<p>15.\tA Judges record, as is well known, must be accepted as correct.<br \/>\nAppellant, thus, could have filed an application for review before the learned<br \/>\nSingle Judge.  The same was not done.\n<\/p>\n<p>16.\tWe are, therefore, of the opinion that the High Court cannot be said to<br \/>\nhave committed any error in passing the impugned judgment.\n<\/p>\n<p>17.\tA feeble attempt was made by Mr. Rai to contend that the Central<br \/>\nGovernment also was of the opinion that the area to be allotted for senior<br \/>\nsecondary school cannot be reduced.  The High Court, in this regard held :<br \/>\nEqually importantly, the learned Single Judge has<br \/>\nnoted that the official records of the Central<br \/>\nGovernment dealing with the communications of<br \/>\nDDA were produced before him. The nothings in<br \/>\nthe file, which were apparently perused by the<br \/>\nlearned Single Judge, show that the<br \/>\nrecommendations of DDA were considered by the<br \/>\nCentral Government and thereafter finally<br \/>\napproved for implementation. In view of this<br \/>\nfactual position, we are quite satisfied that the land<br \/>\nrates were determined by the Central Government<br \/>\nand were not fixed by DDA. There was no<br \/>\nexcessive delegation of power or responsibility on<br \/>\nthe part of the Central Government and so this<br \/>\ncontention must be rejected.<\/p>\n<p>\tIn view of the said findings of the High Court which, as noticed<br \/>\nhereinbefore, have been accepted by this Court, we are not inclined to take a<br \/>\ndifferent view therefrom.\n<\/p>\n<p>18. \tFor the reasons aforementioned, there is no merit in this appeal.  It is<br \/>\ndismissed accordingly with costs.
