Justice K.T.SANKARAN\n\n Dated :14\/10\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                      B.A. NO. 3827 OF 2009\n             ------------------------------------------------------\n            Dated this the 14th day of October, 2009\n\n\n                                O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure.             The petitioner is the second<\/p>\n<p>accused in Crime No.164 of 2009 of Thrissur West Police Station.<\/p>\n<p>     2.   The offences alleged against the accused persons are<\/p>\n<p>under Sections 420 and 406 read with Section 34 of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<\/p>\n<p>     3.     When the Bail Application came up for hearing on<\/p>\n<p>29.9.2009, the following order was passed:<\/p>\n<blockquote><p>             &#8220;After having heard the learned counsel for the<\/p>\n<p>      petitioner and the learned Public Prosecutor, I am of the<\/p>\n<p>      view that before disposing of the Bail Application, an<\/p>\n<p>      opportunity should be given to the petitioner to appear<\/p>\n<p>      before the investigating officer. Accordingly, there will<\/p>\n<p>      be a direction to the petitioner to appear before the<\/p>\n<p>      investigating officer at        9 AM on          7.10.2009 and<\/p>\n<p>      8.10.2009.\n<\/p><\/blockquote>\n<p>B.A. NO. 3827 OF 2009<\/p>\n<p>                                      :: 2 ::\n<\/p>\n<p>              Post on 14.10.2009.\n<\/p>\n<p>              It is submitted by the learned Public Prosecutor that<\/p>\n<p>       the petitioner will not be arrested until further orders in<\/p>\n<p>       connection with Crime No.164 of 2009       of Thrissur West<\/p>\n<p>       Police Station.&#8221;\n<\/p>\n<\/p>\n<p>       4. It is submitted by the learned counsel for the petitioner as<\/p>\n<p>well as the learned Public Prosecutor that the petitioner has<\/p>\n<p>complied with the direction in the order dated 29.9.2009.<\/p>\n<p>       5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and the fact that the order dated<\/p>\n<p>29.9.2009 has been complied with by the petitioner, I am of the view<\/p>\n<p>that anticipatory bail can be granted to the petitioner. There will be a<\/p>\n<p>direction that in the event of the arrest of the petitioner, the officer in<\/p>\n<p>charge of the police station shall release her on bail on her executing<\/p>\n<p>bond for Rs.15,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p>B.A. NO. 3827 OF 2009<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<\/p>\n<p>      a)    The petitioner shall appear before the investigating<br \/>\n            officer for interrogation as and when required;<\/p>\n<p>      b)    The petitioner shall not try to influence the prosecution<br \/>\n            witnesses or tamper with the evidence;<\/p>\n<p>      c)    The petitioner shall not commit any offence or indulge in<br \/>\n            any prejudicial activity while on bail;<\/p>\n<p>      d)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Anitha Razak vs State Represented By The Public on 14 October, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3827 of 2009() 1.
