(ORAL)\n<\/pre>\n<p>            In view of prayer made by learned counsel for the<\/p>\n<p>petitioner, this execution petition is treated to have been filed<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>            The petitioner filed C.W.P No. 287 of 1983, inter-alia,<\/p>\n<p>seeking :\n<\/p>\n<blockquote><p>            1 (i)        to   regularize   her   services   as   Planning<\/p>\n<p>            Assistant;\n<\/p><\/blockquote>\n<blockquote><p>            2 (i)        to fix her pay in accordance with the Rules;<\/p>\n<p>            3 (i)        to pay her the arrears of salary, so fixed<\/p>\n<p>            and grant consequential benefits;<\/p>\n<p>            4 (i)        any other relief which this Court may deem<\/p>\n<p>            just and fit.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> C.W.P NO. 287 OF 1983                             -2-<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<p>The writ petition was allowed by a learned Single Judge of this<\/p>\n<p>Court vide judgment dated 27.11.1997, the operative part of<\/p>\n<p>which reads as follows :\n<\/p>\n<blockquote><p>           &#8221;    This argument is devoid of merit, Rule 4.4 (c )<\/p>\n<p>           clearly   envisages   that   a   government   employees<\/p>\n<p>           seeking its benefits may come to the higher post from<\/p>\n<p>           a lower post either by promotion or by a fresh<\/p>\n<p>           appointment.\n<\/p><\/blockquote>\n<blockquote><p>                The petition is, accordingly, allowed. Resultantly,<\/p>\n<p>           the respondents are directed to refix the pay of the<\/p>\n<p>           petitioner in the light of the observations made above<\/p>\n<p>           within a period of six months from the day that a<\/p>\n<p>           certified copy of this judgment is made available to<\/p>\n<p>           them and pay her all the arrears on the amounts due<\/p>\n<p>           with interest @ 12% p.a from the date the same fell<\/p>\n<p>           due till the date of payment. Costs of the petition are<\/p>\n<p>           also determined at Rs.500\/-&#8220;.<\/p><\/blockquote>\n<p>           This execution petition has been filed by the petitioner<\/p>\n<p>on the premise that her pay has not been fixed strictly as per<\/p>\n<p>Rule 4.4 (c ) 1 (i) of the Punjab Civil Service Rules, Volume &#8211; I,<\/p>\n<p>Part &#8211; I, as applicable to State of Haryana.<\/p>\n<p>           Notice was issued and in response thereto, the<\/p>\n<p>respondents have filed their reply.
