Sunder Pati and others                        ......Respondent(s)<\/pre>\n<p>CORAM:-     HON&#8217;BLE MR.JUSTICE RAKESH KUMAR GARG<\/p>\n<p>                        * * *<br \/>\nPresent:    Mr. Vikas Chatrath, Advocate for the appellant.<\/p>\n<p>Rakesh Kumar Garg, J(Oral)<\/p>\n<p>            This is    insurer&#8217;s appeal challenging the impugned award<\/p>\n<p>passed by the Motor Accident Claims Tribunal, Jhajjar whereby the<\/p>\n<p>respondent-claimants No.1 to 5         have   been allowed compensation on<\/p>\n<p>account of death of one Om Parkash in a motor vehicular accident caused<\/p>\n<p>due to rash and negligent driving of respondent No.6.<\/p>\n<p>            The only ground raised before this Court by the learned<\/p>\n<p>counsel for the insurer is that the quantum of compensation granted to the<\/p>\n<p>respondents is excessive because of applying a higher multiplier and<\/p>\n<p>granting reimbursement of medical expenses of deceased to which he was<\/p>\n<p>not entitled to being an employee of DTC.\n<\/p>\n<p>            I have heard learned counsel for the appellant.<\/p>\n<p>            The appeal filed by the insurer on the question of quantum is<\/p>\n<p>not maintainable as the aforesaid ground is not available to the insurer<\/p>\n<p>under Section 149(2)of the Motor Vehicles Act, 1988. Moreover, it is not<\/p>\n<p>the case of the appellant that they were allowed under Section 170 of the<\/p>\n<p>Motor Vehicles Act to raise all the grounds\/defence as available to owner<\/p>\n<p>and driver of the offending vehicle.\n<\/p>\n<p>            In view thereof, I am not inclined to entertain this appeal.<\/p>\n<p>            Dismissed.\n<\/p>\n<pre>August 17, 2009                        (RAKESH KUMAR GARG)\nps                                                JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court New India Insurance Company vs Smt.
