Abu Haidar, CGC\n                                           -----------\n<\/pre>\n<p>3   24.11.2010           Heard learned counsel for the petitioner, the for the<\/p>\n<p>                   State and the Union of India.\n<\/p>\n<p>                            Petitioner seeks bail     in a case registered for<\/p>\n<p>                   offences under Sections 20 and 22 of the N.D.P.S. Act.<\/p>\n<p>                            Petitioner&#8217;s prayer for bail was rejected by this<\/p>\n<p>                   Court vide order dated 24.12.2009 passed in Criminal<\/p>\n<p>                   Miscellaneous No. 26805 of 2009 at that stage.<\/p>\n<p>                            As per the allegation, the SSB had seen certain<\/p>\n<p>                   persons, who were carrying some articles on their heads.<\/p>\n<p>                   Upon challenge they threw away the same and tried to<\/p>\n<p>                   escape. However, one of them was apprehended and he<\/p>\n<p>                   disclosed his name as Jagdish Prasad. He revealed that the<\/p>\n<p>                   petitioner, who was also standing nearby, was monitoring<\/p>\n<p>                   the smuggling of Ganaja from Nepal to India. It is also<\/p>\n<p>                   stated that the petitioner allegedly confessed his guilt before<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>the SSB. Later on the seized articles and apprehended<\/p>\n<p>person were handed over to the State Police.<\/p>\n<p>         Learned counsel for the petitioner submitted that<\/p>\n<p>though it is alleged that about 200 kg of Ganja had been<\/p>\n<p>recovered from the field allegedly thrown by certain persons<\/p>\n<p>including co-accused Jagdish Patel, nothing has been<\/p>\n<p>recovered from the possession of the petitioner and the<\/p>\n<p>petitioner was apprehended at the instance of the co-accused<\/p>\n<p>on the pretext that he was monitoring the occurrence and<\/p>\n<p>was standing nearby. Learned counsel further submits that<\/p>\n<p>during the course of trial in their evidence the seizure list<\/p>\n<p>witnesses have not supported the seizure of the Ganja. That<\/p>\n<p>apart, it is also contended that the informant has also stated<\/p>\n<p>in his evidence that nothing has been recovered from the<\/p>\n<p>possession of the petitioner.\n<\/p>\n<p>         A counter affidavit has been filed on behalf of the<\/p>\n<p>Union of India.\n<\/p>\n<p>         Learned counsel for the Union of India as well the<\/p>\n<p>State of Bihar jointly stated that the petitioner was<\/p>\n<p>monitoring the smuggling of Ganja as per the statement of<\/p>\n<p>the co-accused Jagdish Patel and that apart, the petitioner<\/p>\n<p>has confessed his guilt before the SSB. However, learned<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>counsel for the Union of India has produced certified copy<\/p>\n<p>of the deposition of the witnesses examined at the time of<\/p>\n<p>trial and he could not deny that the seizure list witnesses did<\/p>\n<p>not support the case.\n<\/p>\n<p>         Learned counsel for the petitioner next submits that<\/p>\n<p>even after expiry of more than one year of the earlier<\/p>\n<p>rejection of the prayer of bail of the petitioner on<\/p>\n<p>24.12.2009 the trial has not been concluded and the<\/p>\n<p>petitioner has remained in custody for about 18 months<\/p>\n<p>without any recovery from his person or possession.<\/p>\n<p>          In above view of the matter, the petitioner,<\/p>\n<p>namely, Ramayan Patel, is directed to be released on bail<\/p>\n<p>on furnishing bail bond of Rs.10,000\/-(Rupees Ten<\/p>\n<p>Thousand) with two sureties of the like amount each to the<\/p>\n<p>satisfaction of the Ist Additional District and Sessions<\/p>\n<p>Judge, Bettiah, West Champaran, in connection with Sikta<\/p>\n<p>Police Station Case No. 20 of 2009 with a further condition<\/p>\n<p>that one of the bailors must be an employee of the<\/p>\n<p>State\/Central   Government      or   the   Semi-Government<\/p>\n<p>concern.
