Respondents\n\n\n\tHabeas Corpus petition filed under Article 226 of the Constitution of\nIndia calling for the records of the second respondent passed in Cr.M.P.No.57 of\n2006 dated 6.8.2006 and set aside the order of detention dated 6.8.2006 and\ndirect the respondents to produce the detenu Muthuvel, Son of Karuppiah before\nthis Court now confined in the Central Prison, Tiruchirappalli, as a Boot-legger\nand set him at liberty.\n\n!For Petitioner\t\t...  Mr.T.M.Madasamy\n\n\n^For Respondents\t...  Mr.S.P.Samuel Raj,\n\t\t\t     Additional Public Prosecutor\n\n:ORDER\n<\/pre>\n<p>\tChallenging an order of detention passed by the first respondent dated<br \/>\n6.8.2006, whereby the petitioner&#8217;s husband Muthuvel, was termed as Boot-legger,<br \/>\nthe wife has brought forth this petition.\n<\/p>\n<p>\t2.The order under challenge is perused.  It is seen from the impugned<br \/>\norder that there were six ground cases registered against the detenu all<br \/>\nrelating to prohibition offences.  On the strength of the recommendation made by<br \/>\nthe sponsoring authority, the order came to be passed.  According to the<br \/>\ndetaining authority, the activities of the detenu were prejudicial to the<br \/>\nmaintenance of public order and public health.  Now, the said order is sought to<br \/>\nbe assailed by the petitioner stating that there are discrepancies found.\n<\/p>\n<p>\t3.The learned Counsel for the petitioner would submit that as could be<br \/>\nseen, in three of the cases, the detenu was fined, and he also paid the fine of<br \/>\nRs.500\/- in each case; but, the order would read that there was a fine of<br \/>\nRs.750\/- in one case, and thus, there was a discrepancy found.  The learned<br \/>\nCounsel would further add that in the instant case, one of the witnesses by name<br \/>\nMuthusami, has given a statement under Sec.161 of Cr.P.C. to the police that on<br \/>\n10.7.2006, he had the arrack supplied by the detenu; that the detenu was not<br \/>\npresent in the arrack shop on the very day; that at that time, he was actually<br \/>\npresent before the Criminal Court, when he was fined; that he paid the fine<br \/>\namount also; and that under the circumstances, the detenu could not have been in<br \/>\nhis arrack shop as stated in the statement which was relied on by the authority.<br \/>\nThe learned Counsel would further add that the detaining authority has pointed<br \/>\nout that he was aware that the detenu was in remand in connection with<br \/>\nManapparai Police Station Crime No.310\/2006 and has not moved for bail; but,<br \/>\nfactually, he moved bail application on 3.8.2006, and it was dismissed; that the<br \/>\nsaid fact was not brought to the notice of the authority; that under the<br \/>\ncircumstances, the authority could not apply his mind, and all would go to show<br \/>\nthat there was non-application of mind.\n<\/p>\n<p>\t4.The Court heard the learned Additional Public Prosecutor on the above<br \/>\ncontentions.\n<\/p>\n<p>\t5.After careful consideration of the rival submissions made, this Court is<br \/>\nof the considered opinion that no case is made out for allowing this petition.<br \/>\nIt is an admitted position that six cases under the Tamil Nadu Prohibition Act<br \/>\nwere registered against him, out of which three cases already ended in<br \/>\nadmission.  It is true that in all the three cases, he has been fined and has<br \/>\npaid Rs.500\/- in each case.  According to the petitioner, the detenu has made<br \/>\nthe payment of fine of Rs.500\/- only in each case and not Rs.750\/- as recorded<br \/>\nby the detaining authority in respect of one case.  Once it is a case of<br \/>\nadmission, in the opinion of this Court, the amount of Rs.250\/- would, in no<br \/>\nway, cause prejudice to the detenu or could, in no way, be called as non-<br \/>\napplication of mind.\n<\/p>\n<p>\t6.So far as the other contention was concerned, bail application was not<br \/>\npending at that time; but, it was filed on 3.8.2006 and also dismissed.  But,<br \/>\nthe detaining authority has pointed out that no bail application was pending.<br \/>\nIt cannot be stated that there was non-application of mind for the simple reason<br \/>\nthat all the papers were placed by the sponsoring authority before the detaining<br \/>\nauthority even much earlier.  Under such circumstances, it cannot be a ground at<br \/>\nall.\n<\/p>\n<p>\t7.As regards the other ground that the detenu could not have been in his<br \/>\narrack shop in the evening of 10.7.2006, since he was fined that day by the<br \/>\ncriminal Court, and he was available in the Court, the same cannot be accepted<br \/>\nat all, since no time is mentioned in the statement recorded from Muthusami by<br \/>\nthe Investigator on 11.7.2006; but, it refers to the evening hours of 10.7.2006.<br \/>\nIn such circumstances, it cannot be stated that a person fined by the criminal<br \/>\nCourt, will be in the Court till the evening.  That apart, it is not a case<br \/>\nwhere he was directed to be there till the rising of Court.  It is only a case<br \/>\nof admission, and if immediately fine was paid, he would have come out, and<br \/>\nhence, that cannot be a ground to set aside the order.
