The short question; that varises for our<\/p>\n
consideratioh.in this Writ Petition is whether
\nthe petitioner is entitied for fixation of his
\npay in_seieotion tide scale with effect from
\n“q~2; zitf is not in dispute that the<\/p>\n
petitioner had joined as a Police constable on<\/p>\n
d”\u00a2:12,4.i95S and he retired from the service<\/p>\n
4″ after attaining the age of superannuation on<\/p>\n
dhw’m30\ufb01’ April 1999 as Special Reserve Sub-<\/p>\n
Inspector. According to him, in the normal<\/p>\n
course he would have been entitled __for<\/p>\n
selection time scale of pay with effect”..::if<ror;1<\/p>\n

withdrawn by the Government. Challenging the<\/p>\n
 same, the present petition is filed.<\/p>\n

3. We have heard Mr.Nataraj, learned<\/p>\n
counsel appearing for the petitionerV and”<\/p>\n
Government Advocate for the respondents._\ufb01id=”<\/p>\n
4. The main contention of the petitioner-‘<\/p>\n
is that the Tribunal has r;ot.iapp:-ma<\/p>\n
properly and on i.account.2’_of;\u20ac\ufb02”wrong
\ninterpretation of Rnle 9, the petitioner case
\nhas been prejudiced yandi his erelief is not
\ngranted. “W i i i i<\/p>\n
5. Thereforeg whet is to be considered by<\/p>\n
us, in this writ Petition is that whether he
\nis entitied for fisation of pay in selection<\/p>\n
time scale with”effect from 21.5.1977.<\/p>\n
&im6;_itmis,not in dispute that Rule 9 can<\/p>\n
bejapplied go a person whose pay of scale has<\/p>\n
[not heen fixed based on the revised pay scale.<\/p>\n
‘.When%_once revision of pay scale has been<\/p>\n
* granted to a person, in such an event, Rule 9<\/p>\n
dxcannot be made applicable. Since, it is not<\/p>\n
