No.214 OF 1998\n        ----------------------------------------------\n                 Dated 27th May,      2009.\n\n                        JUDGMENT\n<\/pre>\n<p>       Petitioner, the proprietrix of St.Thomas Modern<\/p>\n<p>Rice Mill, a Small Scale Unit, preferred this writ petition<\/p>\n<p>challenging Ext.P3 order issued by the Director of<\/p>\n<p>Factories and Boilers, Thiruvananthapuram and P4 order<\/p>\n<p>issued by the       Inspector of Factories and Boilers,<\/p>\n<p>Alappuzha.     As per     Ext.P3 order, the Director of<\/p>\n<p>Factories   and Boilers, while dismissing        the petition<\/p>\n<p>dated 30.6.1997 filed by the petitioner, the petitioner<\/p>\n<p>was directed to replace the present boiler immediately<\/p>\n<p>with proper boiler designed       and constructed as per<\/p>\n<p>provisions of Indian Boiler regulations.<\/p>\n<p>     2. The main contention raised by the petitioner is<\/p>\n<p>that the vessel installed in her factory premises is not<\/p>\n<p>using pressure and the same is being worked by using<\/p>\n<p>steam and therefore the direction issued by the Director<\/p>\n<p>of Factories and Boilers, Thiruvananthapuram is not<\/p>\n<p>O.P.No.214\/98<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>sustainable and illegal.\n<\/p>\n<p>     3. A detailed counter affidavit is seen filed by the<\/p>\n<p>2nd    respondent in which it is stated that the Ist<\/p>\n<p>respondent, during his inspection on 25.11.95 in the<\/p>\n<p>factory of the petitioner, found that a boiler was installed<\/p>\n<p>in the factory having an        approximate      volumetric<\/p>\n<p>capacity of 4170 litres generating       steam above the<\/p>\n<p>atmospheric pressure.      During his inspection it is also<\/p>\n<p>noted that that particular boiler was not designed and<\/p>\n<p>constructed as per the provisions of the Indian Boiler<\/p>\n<p>Regulation 1950.      So, necessary instruction was given<\/p>\n<p>to the petitioner to replace the boiler.   It is also stated<\/p>\n<p>that on examination of the system of piping, which is<\/p>\n<p>very small compared to the size of boiler, whenever the<\/p>\n<p>boiler is under fire, the pressure is bound to develop and<\/p>\n<p>that there is a steam stop valve in the line.      It is also<\/p>\n<p>disclosed that whenever the stop valve is closed fully or<\/p>\n<p>partially, the pressure is bound to rise again.  The above<\/p>\n<p>factual assertion is not disputed.<\/p>\n<p>O.P.No.214\/98<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>        In the light of the above fact, I find no merit in<\/p>\n<p>the writ petition and, accordingly, the petitioner is not<\/p>\n<p>entitled to get any relief.
