In spite of notice and appearance made by<\/p>\n<p>                         some of the respondents through Vakalatnama, nobody<\/p>\n<p>                         has appeared on behalf of private respondents.<\/p>\n<p>                                    3. This intra-court appeal has been preferred<\/p>\n<p>                         against order dated 9.4.2004 whereby a learned single<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>Judge of this Court has dismissed writ petition<\/p>\n<p>preferred by the appellant bearing CWJC. No.12489 of<\/p>\n<p>2003.\n<\/p>\n<p>            4. The appellant\/writ petitioner had applied<\/p>\n<p>for mutation over the concerned land in his favour<\/p>\n<p>which was allowed by the Circle Officer. Against that<\/p>\n<p>order the private respondents preferred appeal before<\/p>\n<p>learned Deputy Collector, Land Reforms, Saran at<\/p>\n<p>Chhapra, who allowed the appeal by order dated<\/p>\n<p>31.12.1998. The appellant preferred Mutation Revision<\/p>\n<p>Case No.41 of 2001 in which he subsequently filed an<\/p>\n<p>amendment petition which has been disallowed by the<\/p>\n<p>Collector-cum-District Magistrate, Saran at Chhapra by<\/p>\n<p>the order challenged in the writ petition dated<\/p>\n<p>22.08.2003 contained in Annexure-1 to the writ<\/p>\n<p>petition.\n<\/p>\n<p>            5. In order to appreciate as to whether the<\/p>\n<p>amendment will take away any admission etc. made by<\/p>\n<p>the appellant, we wanted the appellant to produce<\/p>\n<p>before us his application filed for mutation as well as<\/p>\n<p>his reply before the appellate court, if any. But the<\/p>\n<p>same could not be produced in spite of adjournment<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>given for that purpose.\n<\/p>\n<p>          6.   Learned counsel for the appellant has<\/p>\n<p>placed reliance upon a judgment of the Supreme Court<\/p>\n<p>in the case of <a href=\"\/doc\/1957714\/\">Prem Bakshi v. Dharam Deo<\/a> reported in<\/p>\n<p>(2002)2 PLJR (SC)187 . That judgment dealt with<\/p>\n<p>order 6 Rule 17 of the C.P.C. and the Apex Court took<\/p>\n<p>a view that amendment of pleadings should generally<\/p>\n<p>be allowed because there is very little chance of failure<\/p>\n<p>of justice on account of an amendment but refusal to<\/p>\n<p>allow amendment may cause failure of justice. In the<\/p>\n<p>present case, the prayer for amendment is not in respect<\/p>\n<p>of averments in the mutation application but the<\/p>\n<p>amendment sought for is in revision application before<\/p>\n<p>revisional authority. That would make a significant<\/p>\n<p>difference because at revisional stage the authority has<\/p>\n<p>to consider the legality and propriety of the order under<\/p>\n<p>revision on the basis of all the materials available on<\/p>\n<p>record. Some statements included or omitted in the<\/p>\n<p>revisional application cannot make much difference to<\/p>\n<p>the parties who are free to raise permissible grounds on<\/p>\n<p>the basis of materials on record.\n<\/p>\n<p>          7.   Hence, in our view no interference is<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>         required in the matter and accordingly, this L.P.A. is<\/p>\n<p>         dismissed.\n<\/p>\n<p>                   8.
