RINDANI AGP for Respondent(s) :\n1, \nRULE SERVED BY DS for Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/01\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed to quash and set aside the order dated<br \/>\n19.05.2006 passed by respondent no.2, whereby, the appeal preferred<br \/>\nby the petitioner was rejected and the order dated 02.12.2005 passed<br \/>\nby respondent no.3 cancelling the arms licence of the petitioner was<br \/>\nconfirmed.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the petitioner was possessing an arms<br \/>\nlicence, which was renewed from time to time. Lastly, it was renewed<br \/>\nfor the period up to 31.12.2005. Before the renewal period expired,<br \/>\nan application was preferred by one Bhimji M. Chaudhary before<br \/>\nrespondent no.3 inter alia alleging that the petitioner was misusing<br \/>\nthe arms licence issued to him by using the same for killing cattle<br \/>\nand therefore, it may be cancelled. On the said application,<br \/>\nrespondent no.3 passed the order dated 02.12.2005 cancelling the<br \/>\nlicence issued in favour<\/p>\n<p>3.\tAgainst<br \/>\nthe said order, the petitioner preferred an appeal before respondent<br \/>\nno.2-authority. However, the said appeal was rejected. Hence, this<br \/>\npetition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It appears from the record that before passing the<br \/>\nimpugned order dated 19.05.2006, the respondent no.2-authority had<br \/>\nnot granted any reasonable opportunity to the petitioner to show that<br \/>\nhe was the owner of any agricultural land or not. It also appears<br \/>\nthat no reasonable opportunity of hearing was afforded to the<br \/>\npetitioner. In view of the above and in the fitness of things, it<br \/>\nwould be appropriate that respondent no.2-authority decides the issue<br \/>\nafresh, after affording reasonable opportunity to the petitioner to<br \/>\nproduce necessary documents on record and to present his case.\n<\/p>\n<p>5.\tConsequently,<br \/>\nthe impugned oder dated 19.05.2006 passed by respondent<br \/>\nno.2-authority is quashed and set aside. The matter is remanded to<br \/>\nrespondent no.2 for consideration afresh, in view of the reasons<br \/>\nstated in the foregoing paragraph. The petitioner shall make an<br \/>\napplication, along with necessary documents in support of his case,<br \/>\nto respondent no.2-authority within a period of Three Weeks<br \/>\nfrom today and if any such application is received from the<br \/>\npetitioner, the respondent no.2-authority shall render its decision<br \/>\non such application, within a period of Eight Weeks<br \/>\nthereafter. It is made clear that this Court has quashed the earlier<br \/>\norder of respondent no.2-authority not on merits and therefore, the<br \/>\nrespondent no.2-authority shall render its decision on merits,<br \/>\nwithout being influenced by the fact that this Court has quashed its<br \/>\nearlier order. With the above observations, the petition stands<br \/>\ndisposed of. Rule is made absolute to the above extent.
