Background<\/p>\n
1.     This\u00a0matter\u00a0was\u00a0last\u00a0heard\u00a0on\u00a022.12.2010\u00a0and\u00a0was\u00a0adjourned\u00a0for\u00a03rd\u00adparty,\u00a0Shri\u00a0Yograj\u00a0to\u00a0make\u00a0his\u00a0<\/p>\n
       submission.\u00a0It\u00a0was\u00a0also\u00a0made\u00a0clear\u00a0therein\u00a0that\u00a0if\u00a0the\u00a03rd\u00adparty\u00a0fails\u00a0to\u00a0appear\u00a0on\u00a0the\u00a0scheduled\u00a0date,\u00a0<\/p>\n
       matter\u00a0would\u00a0be\u00a0decided\u00a0ex\u00adparte.\u00a0\n<\/p>\n<\/p>\n
2.     The\u00a0Appellant’s\u00a0request\u00a0for\u00a0information\u00a0herein\u00a0was\u00a0in\u00a0respect\u00a0of\u00a0Shri\u00a0Yograj,\u00a0the\u00a03rd\u00adparty,\u00a0who’s\u00a0<\/p>\n
       Passport \u00a0 No., \u00a0 Date \u00a0 of \u00a0 its \u00a0 issue, \u00a0 Visa \u00a0 No. \u00a0 of \u00a0 Australia \u00a0 had \u00a0 been \u00a0 sought \u00a0 by \u00a0 the \u00a0 Appellant. \u00a0 This\u00a0<\/p>\n
       information\u00a0was\u00a0denied\u00a0by\u00a0the\u00a0Respondents\u00a0under\u00a0Section\u00a08(1)(j)\u00a0of\u00a0the\u00a0RTI\u00adAct.<\/p>\n
Decision<\/p>\n
3.     The \u00a0 Commission \u00a0 heard \u00a0 the \u00a0 matter\u00a0 on\u00a0 the\u00a0 scheduled\u00a0 date\u00a0 in\u00a0 the\u00a0 presence\u00a0 of\u00a0 the\u00a0 Respondents’\u00a0<\/p>\n
       Counsel\u00a0 and\u00a0 the\u00a0 representative\u00a0of\u00a0the\u00a0Appellant.\u00a0However,\u00a0the\u00a03 rd\u00adparty,\u00a0who\u00a0was\u00a0notified\u00a0to\u00a0 be\u00a0<\/p>\n
       present\u00a0through\u00a0letter\u00a0dated\u00a010.01.2011\u00a0issued\u00a0by\u00a0Regional\u00a0Passport\u00a0office,\u00a0Chandigarh,\u00a0was\u00a0absent.\u00a0<\/p>\n
4.     During\u00a0the\u00a0hearing,\u00a0the\u00a0Respondents’\u00a0Counsel\u00a0informed\u00a0the\u00a0Commission\u00a0that\u00a0their\u00a0notice\u00a0to\u00a0the\u00a03rd\u00ad<\/p>\n
       party\u00a0 intimating \u00a0 to \u00a0 \u00a0 him\u00a0 the\u00a0 schedule\u00a0 of\u00a0 hearing\u00a0returned\u00a0 undelivered\u00a0 with\u00a0the\u00a0postal\u00a0 authority’s\u00a0<\/p>\n
       remark \u00a0‘address \u00a0 is \u00a0 not \u00a0 correct’. \u00a0 He, \u00a0 however, \u00a0 maintained \u00a0 that \u00a0 the\u00a0 information\u00a0 requested\u00a0 by\u00a0 the\u00a0<\/p>\n
       Appellant\u00a0attracts\u00a0exemption\u00a0under\u00a0Section\u00a08(1)(j)\u00a0of\u00a0the\u00a0RTI\u00adAct.\u00a0He\u00a0also\u00a0pointed\u00a0out\u00a0that\u00a0one\u00a0of\u00a0the\u00a0<\/p>\n
       information\u00a0viz.,\u00a0Visa\u00a0No.\u00a0is\u00a0not\u00a0under\u00a0their\u00a0control.\n<\/p>\n<\/p>\n
5.     The\u00a0Appellant\u00a0reiterated\u00a0during\u00a0the\u00a0hearing\u00a0as\u00a0he\u00a0did\u00a0during\u00a0the\u00a0first\u00a0hearing\u00a0that\u00a0\u00a0he\u00a0had\u00a0sold\u00a0some\u00a0<\/p>\n
       crops\u00a0to\u00a0the\u00a03rd\u00adparty,\u00a0\u00a0from\u00a0whom\u00a0\u00a0his\u00a0Rs.\u00a04\u00a0lakh\u00a0are\u00a0due\u00a0and\u00a0that\u00a0now\u00a0the\u00a0person,\u00a03 rd\u00adparty\u00a0is\u00a0out\u00a0of\u00a0<\/p>\n
       his\u00a0reach\u00a0and\u00a0has\u00a0probably\u00a0left\u00a0the\u00a0country.\u00a0He\u00a0also\u00a0mentioned\u00a0a\u00a0decree\u00a0of\u00a0Additional\u00a0Civil\u00a0Judge\u00a0<\/p>\n
       (Senior\u00a0Division),\u00a0Faridkot\u00a0which\u00a0was\u00a0in\u00a0his\u00a0favour\u00a0and\u00a0that\u00a0he\u00a0had\u00a0filed\u00a0an\u00a0execution\u00a0petition\u00a0for\u00a0this.\u00a0
\n         He\u00a0further\u00a0added\u00a0that\u00a0the\u00a03rd\u00a0party\u00a0had\u00a0also\u00a0duped\u00a0other\u00a0people\u00a0in\u00a0the\u00a0same\u00a0manner\u00a0and\u00a0that\u00a0he(3 rd\u00a0<\/p>\n
        party)\u00a0\u00a0owes\u00a0several\u00a0people\u00a0large\u00a0amounts\u00a0of\u00a0money.\u00a0\n<\/p>\n<\/p>\n
6.      The\u00a0Counsel\u00a0for\u00a0the\u00a0Respondents,\u00a0suggested\u00a0that\u00a0the\u00a0Appellant,\u00a0may\u00a0if\u00a0he\u00a0\u00a0so\u00a0wishes,\u00a0receive\u00a0the\u00a0<\/p>\n
        present\u00a0information\u00a0by\u00a0approaching\u00a0the\u00a0Court,\u00a0who\u00a0is\u00a0empowered\u00a0to\u00a0call\u00a0for\u00a0any\u00a0documents\u00a0of\u00a0the\u00a0<\/p>\n
        public\u00a0authority.\u00a0\n<\/p>\n<\/p>\n
7.      The\u00a0 \u00a0Commission\u00a0noticed\u00a0that\u00a0efforts\u00a0were\u00a0made\u00a0to\u00a0call\u00a0upon\u00a0the\u00a03rd\u00adparty’s\u00a0submission\u00a0by\u00a0issuing\u00a0<\/p>\n
        notice\u00a0to\u00a0him\u00a0which\u00a0however\u00a0could\u00a0not\u00a0reach\u00a0him\u00a0on\u00a0account\u00a0of\u00a0the\u00a0reason\u00a0stated\u00a0above\u00a0and\u00a0that\u00a0the\u00a0<\/p>\n
        fact\u00a0that\u00a0Respondents\u00a0are,\u00a0anyway,\u00a0defending\u00a0the\u00a0interest\u00a0of\u00a0the\u00a03rd\u00adparty,\u00a0who,\u00a0as\u00a0experienced\u00a0by\u00a0<\/p>\n
        the\u00a0Commission\u00a0in\u00a0the\u00a0past\u00a0cases\u00a0in\u00a0respect\u00a0of\u00a0other\u00a03 rd\u00adparty(s),\u00a0would\u00a0perhaps\u00a0deny\u00a0the\u00a0disclosure\u00a0<\/p>\n
        of \u00a0 the \u00a0 information. \u00a0 Considering \u00a0 this, \u00a0 it \u00a0 is \u00a0 decided \u00a0 to \u00a0 take \u00a0 decision \u00a0 on \u00a0 the \u00a0 present \u00a0 request \u00a0 for\u00a0<\/p>\n
        information,\u00a0barring\u00a0the\u00a0Visa\u00a0No.\u00a0as\u00a0it\u00a0is\u00a0admittedly\u00a0not\u00a0held\u00a0by\u00a0the\u00a0Respondents.\u00a0<\/p>\n
8.      It\u00a0is\u00a0observed\u00a0that\u00a0all\u00a0that\u00a0the\u00a0Appellant\u00a0is\u00a0wanting\u00a0to\u00a0know\u00a0is\u00a0the\u00a0Passport\u00a0No.\u00a0and\u00a0date\u00a0of\u00a0its\u00a0issue\u00a0<\/p>\n
        and \u00a0 that \u00a0 he \u00a0 is \u00a0 not \u00a0 seeking \u00a0 any\u00a0 personal \u00a0 information\u00a0 such \u00a0 as \u00a0 name,\u00a0 address, \u00a0 name\u00a0 of \u00a0 spouse,\u00a0<\/p>\n
        occupation,\u00a0date\u00a0of\u00a0birth\u00a0etc.\u00a0 \u00a0Besides,\u00a0the\u00a0Appellant’s\u00a0case\u00a0is\u00a0also\u00a0held\u00a0to\u00a0be\u00a0genuine\u00a0one\u00a0by\u00a0the\u00a0<\/p>\n
        Court\u00a0of\u00a0Law\u00a0(para\u00a05\u00a0above).\u00a0\n<\/p>\n<\/p>\n
9.      In\u00a0view\u00a0of\u00a0the\u00a0above,\u00a0and\u00a0also\u00a0having\u00a0noted\u00a0that\u00a0that\u00a0the\u00a03rd\u00a0 party\u00a0had\u00a0 \u00a0allegedly\u00a0duped\u00a0several\u00a0<\/p>\n
        people \u00a0 into \u00a0 believing \u00a0 him \u00a0 and \u00a0 selling \u00a0 him \u00a0 crops, \u00a0 the \u00a0 Commission \u00a0 holds \u00a0 \u00a0 that \u00a0 the \u00a0 disclosure \u00a0 of\u00a0<\/p>\n
        information\u00a0i.e\u00a0Passport\u00a0No.\u00a0and\u00a0date\u00a0of\u00a0its\u00a0issue\u00a0involves\u00a0public\u00a0interest\u00a0in\u00a0the\u00a0sense\u00a0that\u00a0it\u00a0a\u00a0matter\u00a0<\/p>\n
        of\u00a0whereabouts\u00a0of\u00a0a\u00a0person\u00a0who\u00a0allegedly\u00a0is\u00a0a\u00a0trickster\u00a0and\u00a0therefore\u00a0directs\u00a0that\u00a0the\u00a0Respondents\u00a0<\/p>\n
        supply\u00a0the\u00a0above\u00a0information\u00a0to\u00a0the\u00a0Appellant\u00a0by\u00a010\u00a0March,\u00a02011.\u00a0<\/p>\n
